One of my friend got EAD 2 year back even though his priority date was not came. Ofcourse this was even b4 this mess created USCIS. He was still using his H1 till couple months back, he is afraid of USCIS may roll back his EAD since PD is not yet reached.
I do heared 11 people from Infxxxx company got EAD even though their PD was not current. They are saying by mistake send the package but they got EAD.
I do know personally that person on the 1st paragraph, on the 2nd paragraph I dont have any evidence.....
Just sharing this information to help this thread, hope there may be lot more cases got EAD without PD even before this mess they have created.:D

Thank you very much for the response. My lawyer just responded back to DOL like around a week ago. It is very frustrated that I still don�t hear anything from DOL so far. I wonder if I change my visa to F1 by attending the school full times such as attending college. Can I stay in US and wait until I got my green card approved? Is it possible to do so?

I too have become obsessive compulsive about the back focus issue.
I can see it (barely) when I use the kit lens.
It is Not there with the 50mm 1.8 Nikkor I have tried as well.
To the average user, you would never notice it. As far as I can tell, my BF is about 5mm behind what I lock on to. You really only see it if you are wide open and zoomed way in.
Im not sure if I want to bother sending it in. (Hassle)
Other than this issue I must tell you that the D70 is a fantastic camera!
I've used tons of cameras and this one functions beautifully.
It gets excellent color. (Skintones blow Canons away)

I was in a similar, but slightly different, situation. I got my 3 year extension while my previous extension was still valid (a couple of days left).
So at the POE, the officer gave me on the I-94 a date that was 3 years from the date of entry (that's the max their system was designed to handle) and said that since I have the visa on the passport, the next time I reenter I would get the later date on the I-94.

Why don't we just voluntarily mention the amount that we contributed in our signatures ? Since contributions are voluntary, so should be the option of disclosing information on it. When many contributing members start furnishing their contribtion information voluntarily, it becomes the "fashion" and others will follow suit, as no one wants to look like a free-rider.
As for the veracity of the information, we got to trust each other on that and follow an audit policy- I assume the core members/ administrators have the ability to cross-check the contribution information if someone looks suspicious. Anyone caught furnishing false information can be blacklisted. Such a policy minimises the work of the core team, without being overly intrusive.

I don't think it'll be brought to the senate floor if there's even a small chance of it being voted out. It'll be brought to the floor only after all the horse trading is complete and it's certain that the required votes will be met. If it's brought to the floor, it's 100% certain to go through.

Hi,
The question I have is : where to return my I-94 (expired and the extended one that came with I797) when I leave by LAND as there are no "US CBP agents/office" when we leave US by land. I went through US CBP website and find that there is a process to send I-94 after leaving the country to "ACS - CBP SBU , KY".
Unfortunately as I will be entering as a Canadian PR, there will not be any stamp in my passport to record my entry to Canada and hence won't be able to prove to "ACS - CBP SBU , KY" my date of departure from US. The reason I am worried is that I don't want to get in to any overstay issues if I need to come to US in future.

When you handover your I-94 to the airline staff there is no recorded evidence of when you handed it over, there is no date stamp per se. Some airlines will not even take it out, esp. if you are travelling to Canada unless you ask them to. Also there is no gurantee that when airlines collect the I-94 it will indeed reach CBP at KY. As far as the entry stamp of the country you are visiting/moving that may not be clear enough to show that dates and some countries will not even stamp passport if you are a PR. Besides USCIS might or might accept it as an evidence of departure. US and Canada do not stamp the passport upon entry for Permanent residents.
The point of all this is, there is no certain way of showing that you have departed with-in the duration of stay. Sometimes USCIS takes boarding pass as the evidence. I think you should just take it easy, go to Canada and send the I-94 that is acctached to your H1-B on the same day with a post mark and make a copy of the receipt etc. That post mark from Canada is an evidence that you were actually in Canada mailing the damn I-94 on your first day of arrival. Other evidences could be the entry receipt of the Car that you will be taking to Canada (not sure about this though).

Olny thing is this time my I-140 is approved and I have disclosed that info in my application. I am hoping that nothing will go wrong. PM me if you want feedback after my interview.
Well ...I know a friend who was asked bu consulate to provide the proof that he has a labor pending...So they already know your immigrant intent..and they have accepted it...So your I-140 info should not be a problem...

Note that DoS has not wasted visa numbers after 2006. For all practical purposes, days of visa number wastage is history. Why do you think the July 2007 fiasco happened ?
That's exactly why they may want to release fall-across/fall-down numbers in July so they can make sure nothing gets wasted. The only point i am trying to make is there are good possibility that dates may start advancing in July

I got my FP done on 11/21.I did open a SR on 10/05, based on which I got my FP notice on 11/06.

485 filed at NSC on July 6th
Receipting done by CSC on 09/05, EAD and AP sent by CSC

In the present situation i believe it would take around 1.5 years to 2 years if you start by preparing for labor and by the time you get your labor and new I-140.
If you ask me about audit, its better i don't scare people, i started this porting process in Jun 07 by applying labor and it got audited after a long wait it got denied, my lawyer filed an appeal and we waited for 10 months still no answer so we applied for withdrawal even that took long time and finally applied for new labor in Apr 09.. so don't get scared it doesn't happen to everyone.. maybe 1 in million case :)

Basically to retain the PD you should have the copy of the I-140 approved and you could retain the PD. Having said that, different lawyers have different interpretations when you switch jobs and retain the PD. Basicallly some lawyers say you could retain the PD even if your old employer uses it for another person after revoking yours, while others say you can't retain PD if your old employer revokes your I-140. However if your old employer willn't revoke your I-140 then you could definetely port your PD with your new employer. If you employer is hesitant to give, you could try asking him other ways if possible for H1B stamping etc.
