Thousands of people are paying thousands of dollars to port to EB2 but they can't spare even a shameful 5 bucks to support a truly great initiative.
By the way , I am serious about lawsuit. As it will block an easy way out for most people.
I guess everybody should support Rolling and Sunny because this initative will create an opening for all other immigration issues.
Everyone waiting for years to get their GC has a real reason to think why USCIS didn't do their job right.
I would say if Sunny and Rolling stone really file a lawsuit, it is like they turning the spotlight on USCIS and from there the rest us can work to bring more light to the bigger issues with USCIS

This is a non issue now for all practical purpose because of recent Job Zone change for Computer Information Manager.
The porting to begin with was unethical in our mind and we took a stand. We were challanged by several people on this forum but they did not realize the extent of our convictions.
Unlike others with their lawsuits Ideas, in this case we did follow up on this issue by contacting DOL in early September with our greivance along with a famous lawyer on our side. Enclosed is our letter to Secretary of Labor Elaine L. Chao and other senior officials. We would like to think that our effort has contributed to the recent change in the Job Zones for Computer Information Manager, as that was specifically mentioned in our letter.. This was not exactly our intention as we just wanted DOL to put some more control around the process. Hence our apologies for the unintended consequences of this effort on the future applicants.
Thanks to these members who actively/morally supported us.

Well, Me being a devils advocate I will agree with you. Because I recently saw Gandhi movie. Gandhi took 50+ years being the citizen of the country. Some people think that is very slow. Some think thats the most effective strategy. So from your perspective its waste of money and time as there are no quick returns.
Vinabath i do NOT expect the nation to put Legal Immigration before the IRAQ WAR. Ofcourse I do not expect that. What I am trying to point out is that this is going to be a LONG LONG ongoing issue and if not the war, there will be OTHER issues like the presedential elections etc.
On another note, the US is a capitalistic economy. If you are not selfish, ur a nice guy and nice guys finish LAST.

Yes you can port it using AC21. IV will need to issue a new memo for it though. But your designation should be same. If you are a junior member, you need to post only as a junior member on IV forums.

I have a question on your solution#4) "granting citizenship to people who have stayed in US for 10 years by rules to pay taxes". The 10 years ----are you talking about several years of study plus several years of working in US in H-1B visa ONLY or for any people who have legally stayed in US for 10 years??? I raise this question because I am curious to know whether I will fit this category. I was a foreign student in US for 10 years and pay foreign student tuition fee in full for 10 years. The first 6 years in several degrees and then back home and then come to US again for professional doctorate degree in 4 years. Originally I find employer to file me the H-1B visa but the quota for Master degree or above is full and then I back home until now. I am sure someone has similar situations to me!!
From other forum, someone said that it is extremely difficult to legalize the illegal aliens due to recent huge economic recession. But if each illegal aliens give non-refundable $5000 immigration entry fee to the country, the country will have about $60 billion fixed income. Then I immediately have thought about if our international students who have stayed in US for 5 years or above give more immigration entry fee to the country, the country will have tremendous cash flow into the economy and may help the economic crisis. There has been some requests for the letter format that I sent to Napolitano and Mr. President. I can't put them in the public domain but I'll be happy to send them if you give your personal email ids.
Yesterday was a very eventful day for me...in the afternoon my wife got approved and 12 hours later we had to call in emergency 911 to take her to the hospital as she was having such strong chills and violent shakings..we all got scared and we have a 2 and half month baby on top of that.....but with strong dose of antibiotics and drips she is better and back.....wow what a day and night.....
In any case I'll answer all your queries....I feel the option 4 is the best way to get to TSC...I have always used that....congressman's office has discretionary powers and you should use that.....use strong words it is your right......they are here to serve you unlike in India where they are there to get pocket your money....no pun for my motherland but unfortunately it is true....
Try a time frame of 4:30-5:30 EST to call the TSC or NSC for that matter...ppl are in a better mood at the end of the day and on thursdays and fridays.....ping your lawyer and ask him or her to intervene......if you know for sure your case is preadjudicated write it strongly in your mails to DHS and others.
I had in fact attached the previous year letters and their responses back to me in my last mail to Napolitano and it was really quite strong.....I am sure it is hard not to take a note of it......I don't mince words and I believe that one should fight for one's rights....
I have been associated with organizations like ASHA, AID and DISHA for long and that have taught me a lot too.............

VO doesnt keep your passport if a via not issued at the time of the interview . He gives it back after the interview. Once you receive the email , you have to go the VFS office and then had in the passport.
My bad. I was thinking he/she got visa and waiting on PIMS verification. For PIMS verification, consualte keeps passport and issues visa after PIMS validates the I-129.
