Job Zone 4 does not automatically translate to EB3. Even though the title maybe EB-3, if the requirements exceed normal requirements for jobs in Job Zone 4 then after a (successful) business necessity audit the candidate maybe able to file in EB2.

I am the primary applicant. Mine and kid's case is at TSC, but my spouse's case transferred to Detroit offcie , for the interview. We had the interview 4 months ago, and the DAO said that she would recommend my spouse's case for approval, however it has to wait until the approval of my app. My kid and I got the approval on Oct 22.
So, now do I have to take an infopass, and request for the yellow form to get approval on the case. Do we get approval from local USCIS office itself or will it come back to TSC? Do you know how long would it take for the approval to come. Or can I call Senator, Ombudsmand, ans start all those cr.. again.

This info is for the cases who had the interview local USCIS offices where they live.
After interview ,pls take info pass for every 2 or 3 weeks and when you meet infopass officer, please fill up one yellow form (this form used to send any request to any other department who handled 485 cases.) to adjudicate your case.Make sure you give your i-485 copies and i-140 copies, You can write at least 5 or 6 sentences at the end of the yellow form to supervisor epalining when u r intervew is completed ,,u r PD is current etc etc.
The way it works like this :
The dept that takes care i-485 interviews is different from the dept infopass officers in local office.Even though they are in same office, the only way infopass officers can send request the 485 dept is using the yellow form..Pls request for it. Then most of the times info pass officer fils up the form and you will add any additional info at the end of the form. Then infopass officer will send the form to 485 dept supervisor.Supervisor will see the yellow form..if you are lucky he/she wil take action imediatly..otherwise go again after 2 weeks..Request the info pass officer twice or thrice..

Knowing the fact that so many applicants have been waiting for YEARSSSS and USCIS not doing anything about makes me sick just thinking about it. How can agency be so ignorant and continue to make thousands of people live in dark black hole for years? Has anyone heard about the new plans or action taken by either agency to reduce the backlog. According to what ombudsman said on july 20 2007 teleconference USCIS will dramatically reduce the backlog for people waiting 33 months or longer in immediate future, apparently it has been 4 months and nothing seems to have been moved yet.

Hi,
I received I485 approval mail on Sept 9th 2010, but have not received my cards yet. There was a soft LUD on Sept 17th. Anyone in this situation?
What was the LUD you received on Sep 17th? I got the same msg on 09/09, but nothing after that. Is your online status changed to card production?

Everyone makes a mistake. That does not mean they would not have any after effects. They will.
Congress have a bigger issue on their plate right now. That is Iraq. I am pretty sure Congress would take up this issue in near future. Make your voice heard to Congress. Then pray to God/Almighty.
We have congress "helping us out" by doing WHAT exactly?? So far we have exactly ONE congresswoman who made a statement. After that no one has even BOTHERED to do anything.
It may be bad publicity for the USCIS, but guess what? NO ONE GIVES A S**T. The USCIS is an INDEPENDANT body and it made a MISTAKE. Everyone makes mistakes, remember?

Man this is Federal government dude and more over part of DHS. This is not a privately owned corrupted company where they can dick around with people.
This is nothing new, things like this happen in almost all parts of the world. Remember Enron, one fine morning thousands of people found that their life savings or retirment savings got wiped out clean with nothing to fall back on. Same could be said of about a lot of dot com millionaires. Life is very very unfair, what other explanation do we have other than that.

First and foremost thing we have to understand is that these Memos (Yates and Aytes Memos on AC21) are not legally binding on neither USCIS, nor the IO issuing denials. They are mere "internal" USCIS guidelines that have no legal standing. There is no option available to us right now, other than requesting (pleading) with USCIS that they follow these guidelines as it's hurting the applicants and their families. And that's what we are doing now, by sending these letters to USCIS top honchos.

Yes, we must all understand that AC21 is not a law. USCIS issues internal memos to adjudicate petitions based on guidelines.
All we can do is request USCIS not to send denial notices as it creates hardships to us and our families.

Opened a SR on 7th Sept and wrote a request to local Congress man.
Approval: 10th Sept
Got a email approval for spouse on 10th Sept ! No changes seen in my status online but I got a response for my SR request that my case is also approved on 10th Sept, the email from SR came on 10th Sept.
Till date no changes to my status online but when you call the USCIS toll free number, I do here my case is approved on 10th Sept.
Just sharing my experience and thanks to Immigration voice forum.

Do you have F1 stamped or you just changed your status from F-1 to H-4?
My wife has H4 stamped on her passport which expired last year. We had got H4 extended last year, but has not been stamped. After that she changed status to F1 again not stamped. Now as per my lawyer's advice probably we will need to change her status back to H4.
My lawyer has suggested that it is not advisable to be on F-1 while applying for 485. You might argue that you are not the primary applicant ( on F1), and USCIS might buy that. But risks remain. Specifically if you have to travel out of country before your I-485 application is adjudicated you will have problem.
Since we all know that right now USCIS is just taking applications, and it might be mighty long time before applications are adjudicated, I have decided to not take risk applying on F1 status.

if she applied for H1B the first package the lawyer sumitted should have copies of her I-20 and EAD. Look through the package you may find a copy in it.
she didn't apply for an H1B unfortunately
went from OPT to J-2- which was stamped in Delhi
and then to H4 briefly (attorney was involved- wonder if we made a copy- good point)
and then back to F-1 which is the current status.....

I understand your frustration. I have heard similar things from employers about hiring people on H-1B.
Are you just assuming or have you actually tried to find out if there is indeed some law which allows employers to not consider a candidate solely based on the fact that he/she has an EAD as opposed to a green card? I can certainly understand that you don't want to get involved in a lawsuit and pay lawyer fees when you can easily find another job. But its not that difficult to contact OSC.
Having said that, I do understand that the employer can find a number of reasons to not hire somebody and all that would be legal. But here we have a case where you have 5 companies who have refused to consider you solely based on your immigration status. Somebody earlier has this in writing from Capital One.
I urge you and anybody else who has gone through this to find out more about this by calling the OSC's hotline. (http://www.usdoj.gov/crt/osc/htm/engperliwdiss.htm) If I were in your situation, I would at least want to find out what my rights are, what is discriminatory and what is allowed by law. Call them and simply explain that you believe that you were not considered eligible for a job because you have an EAD card as opposed to a Green Card.
