    ......You are NOT supposed to have immigration intent when you apply F1. .....

    Correct. You are right.

    One must not have immigration intent at the time of applying for F1 visa or entering USA using F1 visa. However, intent can change over time. Please google for 30-60-90 day rule.

    In fact, one can file for I-485 after 90 days of F1 visa status, if he/she is otherwise eligible.

    There has been some requests for the letter format that I sent to Napolitano and Mr. President. I can't put them in the public domain but I'll be happy to send them if you give your personal email ids.

    Yesterday was a very eventful day for me...in the afternoon my wife got approved and 12 hours later we had to call in emergency 911 to take her to the hospital as she was having such strong chills and violent shakings..we all got scared and we have a 2 and half month baby on top of that.....but with strong dose of antibiotics and drips she is better and back.....wow what a day and night.....

    In any case I'll answer all your queries....I feel the option 4 is the best way to get to TSC...I have always used that....congressman's office has discretionary powers and you should use that.....use strong words it is your right......they are here to serve you unlike in India where they are there to get pocket your money....no pun for my motherland but unfortunately it is true....

    Try a time frame of 4:30-5:30 EST to call the TSC or NSC for that matter...ppl are in a better mood at the end of the day and on thursdays and fridays.....ping your lawyer and ask him or her to intervene......if you know for sure your case is preadjudicated write it strongly in your mails to DHS and others.

    I had in fact attached the previous year letters and their responses back to me in my last mail to Napolitano and it was really quite strong.....I am sure it is hard not to take a note of it......I don't mince words and I believe that one should fight for one's rights....

    I have been associated with organizations like ASHA, AID and DISHA for long and that have taught me a lot too.............


    Again your attitude should be "You have nothing to loose"...so make a best case for yourself and go for it...

    We need some numbers to back this up. I think you are saying EB2 will not become current even with the recaptured number. There is another thread for requesting numbers from USCIS about pending applications per category, per country. So, participate in that campaign as well.

    We need the numbers. I would have guessed roughly 50% of pending 500K applications are from India, 50% of that is EB2, so recapture of 200K visas should help.

    I am saying Recapture will only help EB2 and not EB3. Bcoz all the recaptured numbers will be used by EB2 first. So EB2 dates will move forward and then people with PD in 2007 and 2008 in EB2 will use up captured numbers and EB3 will still be waiting to get any leftovers.

    While the USCIS numbers of pending I-485 make me relatively pessimistic on movement for India and China EB-2, the State Department�s internal case management staff are feeling more optimistic. In fact, we are seeing the National Visa Center issue fee bills for EB-2 India immigrant visa files with priority dates as late as November 2007, which would seem to indicate that NVC, at least, thinks the visa numbers will move at least that far ahead this year.

    A caveat against reading too much into the NVC action: recall that it was imperfect information-sharing between USCIS and the State Department that led to the July 2007 �Visagate� debacle, and NVC likely has a small minority of the overall number of visa petitions with India and China EB priority dates in 2006 and early 2007, since so many of those beneficiaries could file for adjustment of status in July of 2007.

    It�s also possible that NVC is simply trying to get cases set up with fees paid and documents submitted in case the numbers stay current for the rest of the fiscal year � but applicants would lose their filing fees if the numbers retrogress later this year.

    We will have to wait for the May Visa Bulletin from the State Department, likely released by April 13 or so, for more detailed information on the State Department�s thinking.

    Today got the magic e-mail Card/ Document Production . Looks like the SR submitted 3 days back worked in my case. Prior to my SR the IO said that they don't have FP cleared, I called FBI and confirmed that they sent back my FP's and in my SR I request the IO to input the details that I got from FBI, Looks like that did the trick.

    All the best for the folks who are waiting for approval.

    What happens after sending letters to the ombudsman?
    Is it necessary to have MTR before sending to ombudsman?

    Isn't it part of her job? There is nothing like being servant. Moreover, it was just asked to rinse the bottle with hot water, to be sure it is hygenic, in a circumstances when baby was making tantrums. Another reason for asking was because bathrooms were full, otherwise there wouldn't have been a need. We have travelled many other airlines, and there was never an issue for such requests. Many airlines go extra mile to please you. It is what is called customer service.

    I don't understand why is it hard or degrading? Maybe then they are not supposed to serve you a cool cup of water at your seat as well. Is that demeaning as well on part of her job?

    no its not part of her job. I know a stewardess, and this exactly the part she dislikes about her job. people think its her job to attend to all little demands of the passengers.
    She has two duties on the plane, in order:
    - safety of the passengers. this is #1.(ensuring luggage is stowed, seatbeats are on, people are not wandering around the aisles; co-ordinate and help in case of emergencies)
    - basic service (serve food, clear the trays, handle simple requests like juice/water, ice barfbags etc). This does not include cleaning out your babies bottles. Some airlines have stewardesses who would go out of their way (I have seen Singapore Airlines do this) but again, rinsing a baby's bottle is NOT part of her job. She can get you a bottle of hot water if you want and you can rinse it yourself either in the sink or into the barf-bag.

    Hundreds of legal immigrants are resorting to a new tactic this week in their pursuit of green cards: sending flowers to the head of U.S. Citizenship and Immigration Services.

    The publicity stunt follows lobbying efforts and lawsuits protesting a sudden change in the rules that govern employer-sponsored immigrants. After rushing to submit green-card applications by July 2, the immigrants were told at the last minute to keep waiting.

    Notes being delivered to Emilio Gonzalez, head of USCIS, along with the bouquets skip over the pleasantries and speak directly to the bureaucracy.

    "Kindly do not return our I-485 petitions in July," the messages say, "and honor the original DOS visa bulletin."

    The dispute concerns a U.S. Department of State bulletin from mid-June, dictating who could apply for an immigrant visa. The application is the final hurdle in getting a green card, or permanent residency. Because of a backlog, immigrants spend years waiting their turn, but the unusual June bulletin gave most job-based immigrants the go-ahead to apply.

    Jakub Gorecki, who lives in Spring Valley, hurried to get his paperwork together in time. The thick packet of documents - medical exams, vaccination records, a birth certificate from Poland, a $325 application fee - was to arrive July 2 at USCIS, he said.

    But that morning, a new bulletin came out, canceling the offer. No applications would be accepted until the new fiscal year in October.

    The reversal sent Gorecki and others back to a limbo state.

    I had bought a house 2 years back thinking that i will sell it after couple of years and make money. I know many people might have done that. I didnt knwo that having a house will become a burden for me wrt moving to a different place in search of a job. I do see jobs in cities outside my state and was thinking of applying for those jobs. My problem is that if i sell my house, i will have to pay from my own pocket.
    Having a house in this market has become a pain as it has made me immobile with respect to good job offers.
    I was thinking that incase i find a job in a different state and cannot travel back home frequently and also renting is not a good option then should i leave the house to the bank for foreclosure?
    Will this affect my GC process. I have no plans of buying a house in coming years.
    What might be an outcome of foreclosure, keeping in mind that i am wiating for my GC process.
    If anyone had an experiecne like this or may know someone, please share ur thought..


    My suggestion is to explore short selling to avoid foreclosure. This will not affect your credit as foreclosure does. And mortgage lenders are going ahead with this option.

    Thanks for the quick response, Logiclife. That makes perfect sense in your case. But as for me, where my attorney is pretty good and my employer was treating me well till now. Should I just let him file 485 for me and 485/EAD/AP for my wife? And can I file my EAD and AP on my own later? What are the consequences of doing that??

    For me, its 1 and 3. I am sick of my company's lawfirm. They are slow and they always end up filing things late. I almost lost my driver's licence renewal in April due to their procrastination and slowness in apply for H1 extension. If they do the same thing in this, then dates can retrogress and window of opportunity closes.

    Besides, I somehow feel that errors on forms are more likely when paralegals do your paperwork rather than you doing your paperwork.

    I am planning to keep a backup of all paperwork to file on my own if the lawfirm fails to file it by the 7th or 8th July. I will fire them and tell them to back off and do this on my own. I think that if they cant burn the midnight oil and work overtime during such critical times, then they deserve to lose business and we deserve to take care of our problems.

    FYI, there will be a manager from TCS/WIPRO/IBM side to whom all these L1s will be reporting... This shows your poor understanding of how an Indian company is being operated...
    They will "work" with client MGRs but report to employer MGR....:D


    Let me guess something .. you are from CTS ... :-)

    Your rocket science of 'report' to employer manager can be easily busted just by producing couple of emails from client managers assigning work to these L1 babies... true these companies would have a so called psuedo manager in their client locations just to fool USCIS BUT unfortunately ICE investigators are trained and informed about such fraudulant arrangements. Once we produce couple of emails (hope atleast few of us would be copied in those work assignment / weekly status emails) proving the direct work assignment from client these phony arrangements doesn't hold good. Second if we could prove that these so called managers doesn't even belong to our team (look for org charts/team list/email lists where these phony managers name would never be mentioned) just produce those evidence along with the above mentioned work assignments.. ICE investigators would take care of our 'rocket scientists'.

    My dear 'new born' ...what ever you do ... every crime leaves its own trail ... how long you guys would continue this shady mode of operation.. WHY THE HELL ARE YOU VIOLAITNG THE RULES.... GREED JUST CORPORATE GREED, individual resources are just pawns in this fraud.

    wow...u guys have made my decision easier...better to go via ny directly to mumbai

    I have flown on Continental from Newark to Mumbai non-stop. The best international flight experience so far! I bought the ticket online at their website. Guess what! It was almost 60% the price of lowest price travel agents were quoting on other airlines!

    The flight is a bit long lasting just under 15 hours. But, it leaves at around 8 PM. After an in-flight dinner, it is bedtime. People who have taken overnight bus journeys in India, this is not much different. If you can manage to sleep in that half sitting position (I cannot!) then it is that much better. You wake up, eat breakfast, spend 3-4 hours enjoying their inflight individual entertaintment unit, and soon it is time to land in Mumbai.

    There is no hassle with food either. Indian veg is part of their standard offering. So, no hassle of ordering AVML and hoping that they will remember to serve it to you.

    The down side:
    1) The length - at 15 hours (16.5 hours during return), it can get too much.
    2) The service is as bad as any US domestic flight.
    3) If you do not live in Mumbai or Delhi, your journey would not end with this flight.

    I see that more airlines are moving towards this long haul model with flights lasting over 12 hours. I think it is great, because we avoid all transit hassles, such as security, transit visa, etc., etc.

    Soon, AI, Jet and Kingfisher are going to enter into this market. Hopefully more cities in India will connected to more cities in US this way.

    my lawyer's office just called me saying they would want to file ASAP, for which they want my signatures tomorrow. I met her an hour ago, when she was saying things like "hopefully by next week".

    So whether or not this is a rumour, it sure has clicked the panic button for lawyers too!

    If this is true, it is unimaginably bad. (Personally I still think it won't happen till end of July.)
