    So I was having lunch at the Four Seasons with Lou Dobbs the other day, locked in disagreement over who cared more about working people, him or me.

    Him: CNN host, biggest and loudest gun in the battle for tougher immigration policies, leader of a nightly crusade to expose the misdeeds of those he views as elitist fools and scoundrels.

    Me: editorial writer whose views on immigration qualify, to Mr. Dobbs and many others on his side of the debate, as elitist, foolish and scoundrelly.

    Meeting at the Four Seasons was his idea, to continue a long, civil and inconclusive phone conversation about immigration. I got there early and waited at Mr. Dobbs�s banquette. I looked around the hushed room, full of dark suits and a wintry glow. Mr. Dobbs appeared and settled in, his drink, cranberry juice and seltzer, materializing at his right elbow.

    In the spirit of the occasion, I ordered strictly within our borders: lobster bisque, filet of bison and New York tap water. He had the Dover sole.

    Among people whose immigration views I admire, Mr. Dobbs has a reputation as a hopeless blowhard. I did not dwell on that at lunch. I was his guest, and I had seen what happens if you try to skewer him with insult or accusation. Mr. Dobbs is unencumbered by self-doubt. The granite fortress of his certitude is smooth and featureless, and whatever boulders you hurl at it will end up on your head. Besides, I was looking for something better than an argument. I wanted to convert him.

    An honest person must concede a lot when arguing immigration with Mr. Dobbs: Yes, the borders and ports are insecure, and poor countries like Mexico have done too little to solve their economic and migration problems. Yes, illegal immigration hurts some Americans, globalization causes many global problems and big corporations love to stick it to the little guy.

    My point to Mr. Dobbs was that the little-little guy � the �illegal alien� crossing our �broken borders� � was the wrong target. His overriding emphasis on solving globalization�s many ills by urgently sealing the borders strikes me as populism gone astray.

    First, it�s ineffective, because the country will never be ziplocked as tightly as he wants it to be. The price of trying is too high, and it ignores the millions who enter the country legally but overstay. Most shamefully, it does nothing to resolve the fates of the 12 million undocumented already here.

    Second, the obsession with enforcement dovetails with the agendas of some nasty people: the nativists for whom immigration is a simple case of brown and white, of preserving �American� culture by keeping Latinos out.

    Third, it does too little to attack the evil corporate elites that are Mr. Dobbs�s sworn enemy. What makes illegal immigrants so delectable to big, bad business is their illegality � their willingness to work cheap and under the table. So why not legalize and tax them? Assimilate the good guys, as this country has always done, and save law enforcement for the bad ones.

    The idea is to confront abusive corporate power with worker power. If day laborers end up in our suburbs, where the money and jobs are, then give them safe places to gather and help them work together to keep from driving wages and working conditions down. If companies take advantage of workers, empower the workers to fight back: as union members, legal residents, citizens.

    But that�s �amnesty,� a Dobbsian expletive. It�s the opposite of the crackdowns endorsed by him and the hard-liners he praises, like the Minutemen.

    Mr. Dobbs listened graciously and budged not. He said he respected immigrants, even illegal ones, who he felt had gotten an unfair shake from their governments. He reminded me of his fondness for Cesar Chavez.

    Then he repeated his immigration credo. It went like this: the 1986 immigration law was an amnesty promoted by corporate interests waging war on the middle class. Thus the 2006 and 2007 reforms were also amnesty, pushed by the same self-serving plutocrats. So nothing they want is worth doing � at least not until the border is sealed.

    That could be a long time. While we wait, I am going to keep trying to convince Mr. Dobbs that a comprehensive solution � enforcement plus assimilation � is the best expression of the populism he espouses.

    Mr. Dobbs admits that mass deportation would never work, although if you press him on what to do about the 12 million, he has no answer. He wants to hold that question �in abeyance� until the border is sealed. I find that oddly passive for someone so convinced of the dangers from the aliens in our midst.

    I told him that, and he smiled. The lunch was over. I didn�t wrestle over the check because there was no check, just a goodbye from the staff. I got my coat and walked with Mr. Dobbs to his car. We shook hands and I thanked him for the discussion. He made me promise to continue it. I assured him I would.

    I am a big supporter of Obama and a big fan and am eagerly looking forward to see him as our next President of United States. As a legal highly skilled immigrant what can I expect? Well, not sure if I would see myself living here anymore. I have been in the green card queue for more than 8 years now and still waiting. Will Obama's administration do anything for people like me to help reduce backlog? I doubt such a thing will ever happen. I would see myself and people like me discouraged and start packing our bags and move on with life.

    Why do I feel discouraged? If anything is going to happen for the immigrant community when Sen. Obama becomes the President, it is going to be in the lines of CIR 2007. There would be provisions to make illegal immigrants as legal and remove backlogs to family based quota whereas posing harsh restrictions on H1b visas and reducing Green Card quotas and scrap AC21 portability and try to experiment with some new kind of skilled immigration system.

    The above is very evident based on the fact that Senator Durbin has been very hostile to EB immigrants. I am afraid that Senator Durbin will make the calls when Senator Obama becomes the president.

    Please post your opinions. This is a very important discussion. It is very important that the community see what is in store for us when the new Administration takes charge.

    A lot of folks in the EB community are looking forward to 2009 thinking something will definitely happen. Yes, something will definitely happen - and that may not help us

    US is made by immigrants and the immigrants should feel great about this country since this country gave us opportunity. Look at the things that is happening to us since last few months.

    1. CIR bill introduce with lots of provision for Legal immigrants such as reduction of visa numbers to 90k, some people need to apply under new points system, and higher fees for renewing H1b visa. (Supporting US government)

    2. Amendments introduce for legal immigrants coming to US on H1B visa or who are on H1B visa. No renewal of your H1B visa since AC21 was removed from the original bill. (Immigrants can go back to thier home country quickly).

    3. VB came out with all the dates current. Majority of the people spent approx. $4000-$5000, and time so that they are their family can have better life. On July 2 2007 VB dates will show 'U'. (Supporting US economy)

    One question to all the smart people on this forum:
    In the old system, if EB1, Eb2 and EB3 ROW are current then "all" unused visa from all the EB category be given to which category first:
    a) EB1 Non Row
    b) Eb2 Non Row
    c) Eb3 Non Row
    d) None of the above

    Now second part of the question is :
    If that category already has enough people in line, will the spillover to the next category will take place:
    a) Yes
    b) No

    Not saying I am smart, far from it (otherwise, I probably would have been eligible for citizenship by now) but USCIS seemed to have given it to the oldest in the line regardless of the category.

    I occasionally happen to say something they like to hear. I may criticize, but I try to appreciate where it is warranted. World doesn't run by criticism alone.

    The plus point with you is, you never use abusive language and your arguments (at least for the most part) look sane and rational. I wish more intelligent people would interact with you so that the discussion results in some good knowledge being produced.

    Apart from that, what I dont understand is that you say that unless spillover is fixed not even visa recapture can help EB3i. Are you familiar with the numbers for this?

    (1) 1 am currently the Section Chief of the National Name Check Program Section ("NNCPS"), formerly pa rt of the Record/Information Dissemination Section ("RIDS"), Records Management Division ("RMD"), at the Federal Bureau of Investigation Headqua rters ("FBIHQ")
    in Washington , D.C. I have held this position since March 7, 2005 . This declaration supplements my January 30, 2006 declaration previously submitted in this ma tter and is intended to provide further information in accordance with the order issued in the above captioned case
    on February 9, 2006 by the Honorable United States Dist rict Judge Ursula Ungaro-Henagcs .

    (2) This Honorable Court is seeking additional information on the FBI' s name check process, including the amount of time, on average, required to complete a name check requiring a secondary manual search; the average time required to retrieve and review an FBI record for

    (3) The amount of time, on average , required to complete a name check requiring a secondary manual search varies from case to case. Because there is a backlog of cases currently pending, it is difficult to compute an overall average. As mentioned in my January 30, 2006
    declaration, approximately 68% of the name checks submitted by the United States Citizenship and Immigration Services (USCIS) are electronically returned to USCIS Headquarters as having "No Record" within 48 hours, with a secondary manual search usually identifying an additional 22% of the requests as having a "No Record," for an overall 90% "No Record " response rate . The additional 22% identified as having a "No Record" are returned to USCIS Headquarters within 30 - 60 days of the date of their original submission. As mentioned in my
    January 30, 2006 declaration, the remaining 10% are identified as possibly being the subject of an FBI record, which requires the retrieval and review of the record .

    (4) Many times, the delay associated with the processing of the remaining 10% is not so much the actual time it takes to process a name check, but the time it takes for an analyst to get to the name check request in order to process it. This is due to the constant volume of name
    checks submitted by USCIS, in addition to the FBI's other customers, combined with the FBI's current work on processing the residual name checks from the 2 .7 million name check requests submitted by USCIS in November 2002, as compared to the National Name Check Program's
    (NNCP's) limited resources. So far this fiscal year, the NNCP has received a total average of over 62,400 name checks per week, with over 27,700 coming from USCIS on a weekly basis .

    (5) The average time required to retrieve and review an FBI record for possible derogatory information is case specific, it depends on the number of files an analyst must obtain (which is dictated by the number of "hits" on a name), the location and availability of those files, and the amount of information contained in a file . If a file is located at the Alexandria Records Center located in Alexandria, Virginia, an analyst will be able to obtain a file within a matter of days . If a file is located in a field office or other FBI location, the applicable information must be requested from that location. 'here are over 265 different FBI locations that could house information pertinent to a name check request, If a file is electronically available, an analyst will have immediate access to a file. Additionally, once an analyst receives the file, or the pertinent information contained in a file, the analyst must review it for possible derogatory information . The length of time this takes depends on the amount of information in a file and its complexity.

    (6)The name check request for the plaintiff Maria Trujillos was submitted by USCIS 28 on March 25, 2003 . The timing was such that the submission of the plaintiffs name check request immediately followed the submission of the 2 .7 million names resubmitted by USCIS November 2002 , which unfortunately delayed NNCP' s ability to immediately address the plaintiffs name check request. Plaintiffs name check could not be immediately addressed because the submission of the 2.7 million name checks further depleted NNCP's ability to quickly address its current workload at that time , in addition to hindering NNCP's ability to address future submissions, which included the plaintiff s name check . This, combined with the factors outlined in paragraphs (3) - (5) above, contributed to the time it took to complete the plaintiffs name check .

    I am a july 2nd filer and filed my second application on Aug 15th.
    Now that I have got receipts for July 2nd applications, I have put stop payments on the checks on Aug 15th application.
    My hope is that my 2nd application will not be processed.

    From IV: IV commends the initiative taken by it's members nk2006, pd_recpaturing, ItsNotfunny and others. As these members have observed, we all know that any one who has filed for AOS/I-485 can potentially be hit with this issue, especially in the current job market situations. If you believe in the old adage prevention is better than cure, this is an action item you have to subscribe to. It will be only a matter of time the number of such denials is going to spike.

    In recent weeks there has been a spate of I485 denials by USCIS in the AC21 cases. In most of these cases, the underlying I-140 has been revoked by previous employer. But AC21 regulations and related memo�s require that I485�s should not be denied based on that � provided I485 has been pending for more than 180 days and the applicant has changed to a new job that is same or similar. USCIS has been rejecting cases without even issuing a NOID � again required by AC21 regulations. So USCIS is not following AC21 regulations and related field memo�s for whatever the reasons.

    Obviously this will have a very bad impact on us � in addition to tremendous amount of stress it can have very bad economic implications including loss of job. In the current economic conditions we cannot afford to lose the job change flexibility provided by AC21 regulations. IV has started a campaign to fight this.

    After a brief campaign to write to Ombudsman, it has been decided to intensify this campaign and write to various officials in USCIS hierarchy. IV core members have been actively involved in coming up with a strategy and are actively supporting this effort. By sending large number of letters we can draw their attention to this issue and resolve as quickly as possible. There are other strategies that are being discussed and will be underway soon to tackle this issue. This is the first and the most important step up on which other steps depend.

    I request all the members to start sending the following 4 letters. For your convenience the letters have been completely written including addresses to be sent � all you have to do is download following 4 google documents � add the date, your name and address � and send it to the address provided on each letter.

    Hi,

    Maybe this qn. was answered before. Tried to look for answers. But was not lucky to find the exact answer. Also, my qn seems a bit out of context w.r.t this thread (I dont even know how to start a thread).

    Anyways, my qn is:

    If one starts actually using his/her EAD via (eVerify or signing I-9 form), then how will the USCIS know that he/she is on EAD and not on H1B anymore? As per the link below, the I-9 form stays with the employer and shouldn't be submitted to the USCIS.

    So, how does USCIS know that u are on EAD? Is it via payroll? Also, can ADP still run payroll even if one's H1B has expired? I'm just trying to find how does the H1B get invalidated as soon as EAD is used. Where is the link between the two?

    My situation is...my H1B is expiring on April 24th. I've asked my employer to do an h1b extension (as its safer). But he's kinda unwilling to do that. So, as a worst case scenario if he asks me to use EAD only, then I'd be forced to use it. So, how will the USCIS know about that? Lets say, I use it on April 15th. Then will my H1B inactivated starting April 15th? Where and how is it recorded? Just curious.

    USCIS would not come to know and does not care to know. USCIS knows that it has issued an EAD to you, Now whether you use for a job , do not use or open the locked door with it, it does not care. Yes, while processing 485 if it generates RFE then depending upon the nature of RFE if your new employer is contacted for employment proof, perhaps USCIS may know that you are really using it.

    IV has provided a template for the members to get a print out sign it and send it to IV address so as to be forwarded to the President

    Many people have been responding to this and is a good sign. However there are few more lazy folks who doesn't have patience to download, take print out and send it to IV. For these guys, how about creating an online form with the same template and an ability to modify the template as well plus the provision to provide the Name and address and such details that make the letter personal. Once this form is filled and take a print out, put it an envelope and send it to the President. This is some thing similer to online petition except that it is customized to provide the personal details. This is jus to motivate even those lazy guys!!!!

    Right, it will not be good for anyone- nonimmigrants, employers or american economy. They are trying to take advantage of the current state of the economy to promote their anti-immigrant protectionist agenda. This is going to make anti-immigrant groups happy. Btw, I think these anti immigrant groups are a very small minority compared to people who support legal immigration but these are the most noisey ones.

    so, yes -it is not going to be helpful for anybody. Only results in large scale outsourcing and/or companies would not be able to place right candidates in the right roles which is going to hurt America in the long run.

    Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. :rolleyes: That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right.Why cant you guys understand this simple fact?.     BTW, i am one of the guys who couldn't file I-485 because of this fiasco. But i understand the reality.:)

    The following is the response I got from an american friend and my previous roommate who just came from vacation .

    "I feel so bad about what happened with your application.

    Can you send me the letter you wrote to the congress people?
    If I can read it and understand it ok then I can send it myself (as a registered voter) too. "

    No one is here is foolish to say that Green card is a right or no one here is saying ones life is miserable than the soldier who made sacrifices for ones country.
