My AP is expiring very soon. I do not have any travel plans to India in 6 months from now. Is it mandatory that I have to renew the AP before the old one expires?

This happened in 2007. USCIS conducts random audits on companies to verify their authenticity.
USCIS conducted an audit on his company. They fixed an appointment with him in his office. They asked all the tax returns, W2, Paystubs etc. They also talked to his client manager and verified his duties.
After that everything went fine. He works for the same employer now.

So this is actually 16 years of education overall and not 14 as suggested by other member. Sorry to ask, could you confirm this again, or did you mean to say 10+3+1? as you said this is accurate about what other member said.

EB2 I should get more spill over from EB2 ROW that what it got last year. The number of labor approvals is very less after June 2008( someone posted it earlier in some other thread). EB2 ROW is always current and I think the usage should be low this year.

Here is what you do if the bill passes without amendments:
Get some sun-tan. Wear a baseball cap. Put in jeans with oil stains and bad quality collarless t-shirt. Grow an untrimmed mustache. Lose the dress shoes and wear cheap jogging shoes.
Go to the nearest USCIS office (after this bill passes) and say that you have been working off-books illegally at a nearby restaurant since 5 years and now you would like to apply for Z visa.
They will give you a probationary that will work like an EAD card (maybe better quality than EAD with it being tamper proof and wear proof). In the meantime, once the borders are closed and certain benchmarks are met, you will get Z visa with Advanced parole to replace your probationary card. With that advanced parole you can travel outside and come back in guaranteed (Guaranteed return due to AP). When outside you can file for GC, visit your parents and relatives, spend a few days in vacation and come back with full freedom to work anywhere without LCA restrictions and enjoy the Z visa that you can renew on your own (no need for employer sponsor).
They will give GC to all Z visa applicants within 5 years thru supplemental increase in GC (based on survey done by DHS). The annual cap will be total Z visa holders divided by 20%. If there are 11 million illegals who end up getting Z visa, the annual cap will be 2.2 million.
That 2.2 million beats the hell out of the 140,000 we have today for legal skilled immigrants or the 90,000 we will have with this new bill.
Advantages:
1. No need to comply to speciality occupation. Work in any line of work.
2. No need to get labor cert for GC.
3. No need to depend on employer for temp visas like H1B and GC sponsorship.
4. More travel flexibility due to advanced parole that comes with Z visa.

Yes I believe my attorney did provide the educational evaluation documents. It was the same documentation used for the H1B & the PERM Certification. Any idea of what my chances are with the appeal?
i hate to say this, in my opinion, urs is a little tough case. This is just my thought. Other gurus here may have a better advice for u. But this is uscis, you are dealing with. So you never know. Provide a better educational evaluation and keep your fingers crossed. All the best.

So those guys who attended the hearings or met with senators. what was the result? what did they accomplished? did they get the opportunity to participate with the senator or law maker in an action plan? or we just wasted that opportunity asking for autographs? please those guys post your comments. - I strongly object to the language used in your post. How can you say the IV members just went to get the autographs. If you were involved in any of the meetings with the lawmeekers, you would know the difference. My PD is Aug 2005. My employer by mistake sent the 485 application on June 27 and USCIS received on June 28. Today Aug 21, I received the rejected 485 full package back. Employer is following up whether it can sent back. Anybody has any idea of any luck in this case, or has to wait till dates are current again?:mad:

Pineapple .. you hit the nail right on the head. It is a misconception that everything is cool in India. There are a lot more problems than just your salary. Money is not everything . I think standard of living and less corruption , cleanliness and less crowd do count towards life.

outsourcing is a phenomenon that will slowly expand in scope beyond low-end IT jobs - but the larger issue is that overall economic activity, which was concentrated in a few cities around the world - like NYC, London, Singapore, Tokyo etc., is getting geographically distributed - today more cities/ countries have world class higher education schools, stock exchanges, hospitals, manufacturing companies, banks than ever before...as a result - starting with tier II and tier III cities and eventually NYC, Chicago etc -the pride of place held by many US cities is now going over to places like Mumbai, Jo'berg, East European cities, Brazil, Chinese cities etc......companies are choosing to list their stocks at hitherto unknown exchanges, people are travelling to India and Thailand to get medical treatment done and so on
obviously jobs of all kinds - not just IT jobs - move alongwith the shift in economic activity - and this is not just about saving labor costs - but about overall balancing of demand and supply for land, labor, capital and entrepreneurship.
So, those who have high skill adaptability, geographical mobility and a strong network of professional peers are likely to continue to succeed in this game...having a GC or not would become irrelevant sooner than we probably think..
A personal comment for hpandey - not sure where you live in US- but i cant imagine how living in 300sqft lofts in NYC or shabby NJ suburbs (for many of us) and doing all grocery/ laundry/ housekeeping/ NYC type commute on your own can be any worse than living in delhi or mumbai or bangalore with driver, domestic helps etc. :-)

Attorney fees for the spouse thru husband's company -> $800
Attorney fees for the spouse through my company -> $3500

u can easily get an affadavit from someone with a business that says u worked there for a period of x days while ur h1 was with yyy company... that puts u into an illegal category too.
i m growing some tomatoes this summer....maybe i can get additional points if i grow them for 100 days every year and then after another 5 yrs i can get some more points in the new merit based system
Well they will easily find out from your SSN number if one is on payroll or not. I am seriously looking into this matter of getting illegal and many of my friends agree. Once the bill passes in its current form we should get advise from a good lawyer to convert status from legal to illegal. It sounds so insane when I say changing for legal to illegal..but that is the hit thing these days.

When I used term misguide, I was reffering to "I-140 Approval". Here is another attempt to clarify:
If you concurrently filed your application and if it is more than 180 since you filed and your I-140 is not approved yet, then can you use AC21? The answer is yes as per Yates memo. Even though your I-140 is not approved at the time you invoked AC21, USCIS while adjudicating the petition should determine whether the I-140 was approvable at the time of filling? Please read the memo, if you have not done so.
In nutshell, I-140 approval is not required for invoking AC21, if application was filed concurrently and has been pending for 180 days or more. Attorneys ask you to remain in your job, so as to minimize the risk.
Kindly see the context of the post and please read the post completely before going ballistic �

A lot of us can do and will do many things. Your argument does not stand ground. I dont ahave anything against this guy. I have a problem with the system that permits this activity. Because its not fair. By the way I seriously doubt this happens to people in my situation. This is typical of "desi consultant companies". So once again pontiff i dont have a grudge against this guy but the system that allows this to take place.
