    I agree, I was so upset when I read it... Thank you Logiclife for bringing that to our notice.
    I just wrote an email to the editors with the email address provided by walking_dude. My email says this:

    Dear Editor

    You mention in an article dated today that "HIGH-TECH EMPLOYERS get lift from House Republican letter to Speaker Pelosi urging passage of immigration bill to help "attract and retain" high-skilled workers". And in the same breath you say that "In a poll 56% of Republicans earning more than $75,000 annually would "strongly" or "partially" agree with candidate who would bar illegal immigrants from path to citizenship." Do you know the difference between highly skilled legal immigrants and illegal immigrants?. Why do you have to imply that all highly skilled are illegal, infact 99.99% of highly skilled workers (Tech workers) came to the USA legally and continue to live legally. They are here at the behest of their employers.
    So please correct your article to reflect that.

    I don't think they mean to say that High tech workers are illegal. They say that their poll indicates Republican voters who earn more than $75000 would like a candidate who opposes illegal immigration. Atleast, that is the way I read it.

    They have to say they oppose illegal immigration because it is the WSJ. Republicans read it and they like bashing the illegals and it increases circulation.

    Of the hundreds of thousands of July 07 filers, who paid a mere $325 for their I-485 application, do you think USCIS will devote the time/effort to constantly keep track of the applicant's eligibility of 485 over the next several years???? It will take atleast 4-5 years for several of us to finally get a visa number. Several of us will move/have address changes during these years.

    It took them 2.5 years to process these...imagine the nightmare if they were to try doing subsequent rounds....

    Keep in mind that 485 eligibility is not just tied to employment but also FBI name checks etc. Do you think USCIS will keep on doing name-checks every other year, or issue EVL's every other year if/when they see for instance, an address change?

    Dude...USCIS is already on its way of bragging to the congress that it has pre-adjudicated all these 485 applications. I think if they touch these pre-adjudicated applications, then someone has to answer to someone of what is going on...why haven't you still worked on this? why are you devoting your time to these old 485 applications when there are new ones yet to be processed.

    I think once the application is pre-adjudicated...that's it!! I don't believe USCIS will spend anymore time and resources to these applications again...until a visa number is available from DOS and they apply the number to the pre-adjudicated application....my 2 cents!

    Hi All,

    I filed my I485 in 08/05 and my labor date is 07/05 in perm. My I140 got approved in 2007.
    I was in bench for around 6 months in 2008 starting from Jan 1st to 06/20th. I took full time position in last week of 06/08 and continuing in the same job. I got RFE on my I485 and asked for employment verification in 12/09. My attorney replied with presnt employment letter and applied for AC21 also at the same time. Now i got another RFE asking for last 5 years employment letter, w-2 forms and tax returns.

    Can some one please let me know how i can handle the period that i was in bench in 2008.

    Working with new employer since: June <last week> 2008
    RFE: Dec 2009 (for EVL) filed AC21
    second RFE on last 5 yr employement, W2 and Tax returns

    Instead of Assumtions, answer the following questions may be others can give some guidance before you talk to your attorney

    Questions:
    1. When did you start using EAD

    2. If you were on H1 before Jun 2008, then did you file taxes for the appropriate amount for 2008. if not you have an option of tax amendement and you can talk to your previous employer and if he does not agree you can file a case on him and he has to do back wages and that if fine according to law.

    If you filed taxes appropriate to 2008 then you are just fine

    talk to your attorney about back wages and he can send a letter to your previous employer or you can talk to your previous employer in case you missed taxes in 2008 assuming you were on H1 else if you have used EAD for half the period then you should be able to show taxes for first half.

    Please provide all the facts before some one can help

    It will be intersting to see how Indian Economy will flare, which is essantially driven by Outsourcing, which will take the greatest hit.

    Remember Indian Economy's engine is outsourcing, once it starts to see the $ exchange pressure, forget about people coming to US, think of what will happen to standard of lving in Inida.

    Can India still maintain the new glow with dollar coming down , I doubt as the Govt of India has not made any big steps to make permanent changes to infrastructure set up.

    Well, I don't think I am at the end of line of 300,000 people. There must be lots and lots of people whose priority date is after April 2004 might have filed. This includes 2004, 2005, 2006 and 2007.

    So I think 3 years is intelligent guess. But who knows I am just trying to make myself happy and trying to stay positive.

    While a fierce battle is raging over immigration reform for unskilled and undocumented workers, we the high-skilled, legal immigrants are struggling for employment-based permanent residency. The wait, intended by Congress to be one year or less, can now be up to 10 years in certain categories.

    I am a high-skilled, educated, legal, tax-paying resident of Stillwater, having dual master's degrees from Oklahoma State University. My wife obtained a Ph.D. from OSU and works there as a post-doctoral research scientist. After filing a plethora of immigration forms, paying exorbitant fees and waiting almost 5 years, our permanent residency application process is still in a state of limbo with no end in sight. In the absence of permanent residency and the associated uncertainty, we have missed several opportunities of economic investment and scientific research.

    People presume that since we are highly qualified and legal residents, it would be a matter of one to two years to obtain permanent residency. On the contrary, I, my wife and thousands of highly skilled, highly educated legal immigrant members of Immigration Voice ( www.immigrationvoice.org) are stuck in a bureaucratic mess that has shattered our American dreams, stagnated our careers and prevented us from realizing our true potential.

    The U.S. employment-based green card process is in need of a major overhaul. Hundreds of thousands of applicants have been stuck in the three-stage green card process � some since 1999. These highly skilled workers take up jobs for which qualified American citizens cannot be found. Though it's hard to imagine that a qualified American worker cannot be found for some high skilled jobs, there are several explanations for this disconnect.

    More than 50 percent of American graduate degrees in science and engineering go to foreign students, a majority of whom continue to stay in the United States and work on H1-B visas. A shortage of American graduate students translates to a shortage of American workers in skilled positions such as chip design, materials science, microbiology or nursing. Also, qualified Americans may be unwilling to relocate to a particular location. This is especially true for physicians working in under-served areas.

    Many misconceptions about H1-B visa holders have been propagated by largely anti-immigrant lobbies the most prominent being that they take away American jobs and are low-wage workers. The truth is that an H1-B visa holder can only be hired if a similarly qualified American citizen cannot be found. Also, the minimum H1-B wage, determined by the Department of Labor, cannot be less than that offered to an American worker in a similar job.

    Another myth is that H1-B workers don't pay taxes. Be assured that all H1-B workers pay taxes equal to what American citizens pay, including Social Security and Medicare taxes.
    If Congress passes S. 2691 and H.R. 5744, which Sen. John Cornyn, R-Texas, and Rep. John Shadegg, R-Ariz., have respectively introduced, America would undoubtedly become more competitive by ensuring availability of adequate high-skilled immigrants and by eliminating some of the red tape that plagues our legal immigration system.

    Congresswoman Zoe Lofgren (D-CA) has introduced H.R.5882 to improve the reliability of the system in which employment-based and family-based visas are issued to foreign nationals. As you may know, many of these category-based immigrant visas have not been issued over the past few years due to backlogs and processing delays at U.S. Citizenship and Immigration Services. H.R. 5882 would help prevent such losses by making available an estimated 218,000 employment-based and family-based green cards that have been unused in past years.



    In addition, Congresswoman Lofgren has introduced H.R. 5921, the "High Skilled Per Country Level Elimination Act," to remove the per country limit on employment-based immigrants. You may be aware that U.S. immigration laws limit every country to 7 percent of the worldwide level of U.S. immigrant admissions. This per-country level is established by the U.S. State Department to act as a "barrier against monopolization" and to provide fair opportunities for all skilled and professional workers from around the world. H.R. 5921 would remove per-country limits and would no longer allow unused family- or employment-based visas to be used interchangeably.



    Please know that both H.R. 5882 and H.R. 5921 are under review by the House Committee on the Judiciary. However, no companion bills have been introduced in the United States Senate. I think it is important to recognize that our immigration policies must make national security a central priority while at the same time helping to facilitate family reunification and labor demands here in the United States. I will continue to pressure Department of Homeland Security Secretary Michael Chertoff to ensure that any policy to expedite visas does not compromise our standards for accepting individuals into the United States, nor the integrity of our immigration system. Be assured that I have taken note of your support for these bills, and I will keep your thoughts in mind should related legislation come before me in the United States Senate.

    Roy, 14, an eighth-grader at Abington Heights Middle School, Pennsylvania, said she knew as soon as she heard "cymotrichous" that she'd get the word right and win the championship Thursday night.

    "My heart started pounding, I guess," she said. "I couldn't believe it. . It's just amazing. It's hard to put into words."

    It was Roy's third trip to the national spelling bee, and she had credited her past experience with keeping her calm and relaxed heading into the finals. She tied for 12th place in 2009 and 20th place in 2010.

    Roy speaks Bengali and every summer travels to India to visit family. She hopes to pursue a career in international relations.

    Roy is the ninth Indian-American in the last 13 years, a run that began when Nupur Lala captured the crown in 1999 and was later featured in the documentary "Spellbound."

    Let us differentiate ourselves. Legal immigrants include people who come here on family based PR petitions. We are Highly skilled legal Immigrants.


    IMHO, WE SHOUD USE "WE ARE HIGHLY SKILLED LEGAL IMMIGRANTS" INSTEAD OF "LEGAL IMMIGRANTS". Going by what is happening in the hill and elsewhere, this distinction will work favorably for us.

    You mean to say sell US real estate for GC/citizenship? I don't see this going very far. I can see anti immigrants waiting for this one. Best is to lobby using aides of big corporations, developing relationship with lobbyists who already have connections, hiring lawyers, developing strong case, donations in election campaigns etc. All of this needs loads and loads of money. Are we ready to donate to IV and build strong lobbying group for our cause? That is the only way to change our current situation.

    Sending flowers, sending pizzas, sending all these proposals will only fall on deaf ears. Congress understands language of money to pass laws, Rest of the country/orgranizations understand language of laws/court.

    Hey guys,
    I have a question to all of you...

    AILA prepares the lawsuit and some (probably most) of the lawyers are supporting that.

    For several days I keep hearing that WHEN you file (in July) is not important and I am wondering how that could be true...
    I understand that the people who filed on July 2nd are beneficiaries of this but in my mind, everybody who files after falls under a different category because technically they would file after the revised bulletin was announced therefore have no argument. I understand that everybody else prepared (legal fees, medical exam and so on) and they are affected even if they didn't file but I am wondering how that can be justification enough after the dates (retrogression) were announced.

    I am trying to understand why they say that it does not matter when you file. They need more people to back this up or is just so they can justify billing you for their work...

    Is just scary, how many people play with our hopes and I need to understand if this is just to serve somebody's interests or it is what it is .

    Please post your 2 cents ...

    Even if its multiplied by 100 we should be ok, if the USCIS does a good of not waisting visas by doing their best in the month of Sep. Say we have 6500 * 2 .25 (Family) = 15000people waiting from EB2 2004. Looking at the spillover numbers from last year, we might be lucky enough. Just trying to be optimistic for the next 35 days.

    We received our 2nd biometric appointment notice for Sep 11th. Our Notice date is Sep 19th 2007. Just keeping my fingers crossed and hoping for something good. :)

    It may sound crazy, 2nd biometrics may not be good sign when dates are current. I had my 2nd FP in June09. I spoke with IO out of curiousity to know of any update- more so to know whether my case is pre-adjudicated (as there was lot of roar on recent preadjudication). IO told me my 'NC is pending'. I told her that around this time, last year, I was repeated told on infopass and on phone that my NC/BC etc is cleared and case waiting for Visa#. She that that is true but 2ND FP TRIGGERs NC and unless they get clearance they have to wait for 180 days before my case is ready for adjudication.
