My wife's H4 extension is sitting in CSC and they are currently doing Oct 16th 06. Even though I gave my docs in mid nov, they ended up filing in Jan with a notice date of Jan 09/07.
My wife would like to move on to H1, she missed it last year as she was out of country. Does she need her H4 to be approved before she can apply for H1?
If I request a Premium Processing for my I 129, will that result in her application being approved along with mine. I 129 & 539 were filed together. It appears that I have to do mine as my DL expires in Apr 1st week and I dont see the H1 approval coming through. Does USCIS consider both different applications and ask for 2 different fees for PP?

In fairness to the OP, he/she said that "...while TSC filer are getting ead adn AP as SOON AS THEY GET RECEIPT...." (emphasis mine).
He/she didn't mean to say that NOT GETTING any receipt is good as long as you get your EAD.

Not sure if anyone experienced this, but on 2 computers this site, antivirus software detected a virus & my work PC (protected with McAfee) is not booting up, IT said my hard drive has been corrupted. My laptop survived with a freeware anti virus. Please don't give me any reds, this is what happened to me, I just wanted to warn any unprotected members of IV.

It will take 24 months to get a result.
Meanwhile he is going to start PERM in EB3.
Got RFE before the denial.
Replied with professor letter and premium evaluations ($750).
Still USCIS insist with EDGE database. It is private, no govt backing, but they are going by that findings.
Lawyer is hopeful for the result, he have 6 year college, they questioned about the 3 year degree, but the labor is for masters, He have masters (2 year) and total 4 year combined bachelors(3+1).
They no need to look the bachelors, when the education requirement is masters.
The evaluator give 20 US universities name which gives masters degree after 5 year course (5 year integrated degree).
Agree with what you pointed out but shouldn't the attorney know this?? If this cannot be apealed this individual has lost valuable time and money (attorney looses nothing). I am curious to know what the attorney says about this:mad:

What will be my status after i file my I485?
My current I-94 will expire on 16th Sep 2007 (on the day my current visa stamp in my passport expires and my current H1 B is set to expire Mid April 2008).
I am planning to make a trip to Cannda or someplace to get a new I-94 as soon as i get my new passport (i had sent it for renewal on june 2nd). But i am a little worried about my status if i am unable to make the trip.
So my question is what will be my status after 16th sep 2007 (once i file for I485 (first week of July2007) and my I-94 expires on 16th Sep 2007)?
Appreciate any responses ...

Do you know any example of I-485 got rejected after using AC21?
My lawyer says they haven't seen any case like this before. I want to make sure before I change jobs.

USCIS has known to send straight denials even though they are supposed to send NOID when an employer revokes 140. There are many examples where people sent in ac21 or not.
However; in just about every case it eventually got reopened. In the mean time there are many anxious moments while waiting for uscis to reopen the case (can't get ead renewed/ if outside the country wouldn't be allowed back on AP).
USCIS sometimes takes their time reopening the case (upto 7 or 8 months). If you don't have h-1b then there is no legal basis to stay here while waiting for the case to reopen. Can't work, etc. However; if you overstay by six months and they don't reopen the case then the 3 and 10 year bars will kick in and you can kick the greencard away.
Key thing is whether employer revokes 140. If they do then it causes anxious moments. USCIS has also started to revoke approved I-140's on their own when companies respond to rfe's on other candidates 140's (ie., ability to pay for all people together). If uscis revokes it on their own then ac21 does not protect you at all.

more H1s is not only good for the employers, but also potentially for the economy. More taxes coming in, more pple putting money into the flow by buying things/cars etc. If they look at it more from economy perspective, this cud get approved/passed. Sorta kickstarting the financial situation.

My wife and daughter planning to go to India next month. They do not have H4 stamping but H4 validity is there up to next year. Plan is to come back after receiving AP. I am thinking that once their AP is approved I will send their AP to India, and they will come back using that AP. Experts, do you see any problem in this. Please share your thoughts.

There could be a problem at Point of Entry if the officer notices the exit date before the approval of AP. I think for you to be able to use AP to enter it should be approved prior to your exit out of the country. You might want to consult an attorney or USCIS on this. If the IO at POE stops them there is nothing you can do. So be very careful on what you want to do here.
