My PD is Feb 2004, so I've been current for almost 2 months now. Though, my ND is 9/12/2007 and NSC is processing 7/14/2007, so that's not current yet...
Receipt date and not notice date is the factor.
Also, NSC has been processing even people with October notice dates and appoved people with current PDs.

I have EAD for couple of years & when I moved to Ohio, I was issued 4 years DL. They did look at I-94 (I travelled on AP having one year validaty on I-94), also they DID NOT looked at my EAD expiry date..They asked very simple question - Do you have your SSN? Thats it..!
C'mon...Guys, come to Ohio..you will get DL for 4 years..
My DL was renewed for four years, much beyond my I-94 expiry, both the times...so guys, come on to CA...Golden land of jobs, good weather, cosmopolitan and accomdating/tolerant ppl of all races/religions :-). I am still on H1-B though..

But remember that this does NOT include 3 LARGE groups of potential EB's:
1. Those who have NOTHING filed with USCIS yet, since their LC is still at the BEC==>THIS IS CORRECT
2. Those whose I-140's have been approved, but can't file I-485 yet.==>I THINK THIS HAS BEEN TAKEN ACCOUNT OF BY USCIS.
3. The dependants of (1) and (2).==>THIS IS CORRECT
None of the above would be counted as having a 'pending' case with USCIS.==>nO.2 HAS BEEN ACCOUNTED FOR

Call the office and tell them you did not get the answer to the questions and issues you raised and want to speak with the person who handles immigration policy matters. Follow up with this person. Letters go to junior staff and issues get lost unless you contact the senior staffers and seek appointment from them.

Libra,
Pestering ad nauseum to contribute and participate will only make things look trite. I think you should give it a rest. We are doing what we can to further hte goals of IV... but don't try to tell us when to breathe.

Do any of you have any information on Foreign currency CD. I am thinking of opening CD account with Foreign currency possibly with Indian rupee.
Rupee is 47.50 today and i think its the best time to buy rupees rather keeping ur money in dollar.
Please throw some input.
Thanks

With premium processing starting/started for EB2, imagine the speed at which non-premium cases will be dealt with.
NSC has historically been slow.

is your lawyer saying? You are paying them to answers these kind of questions.
I have a phone call set with my lawyer. I am going to listen to his recommendation. However knowing how others are handling similar situation will help me in taking decision.

Thanks for advice. Yes my last M.Sc. and Ph.D. from the USA.
Could you please clarify what "find out NIW holders in your / related engg field"? How can I find out?
Do you believe EB2-NIW is easier than EB1-OR?
Thank you,
John
Your situation is slightly different than many I have come across. If your qualifications, research work, project etc have unique qualities, then you may still have a fighting chance. But you may have to do a lot of homework: find out NIW holders in your / related engg field, ask a few lawyers: do not believe right away if somebody promises they could, try to enroll in as many professional associations as possible, enlarge your skill portfolio etc.
BTW, is any degree of you from US?

I find Ron Gotcher's website very informative. Its your choice not to read or to disagree with the speculative part, but he definitely is doing a fantastic job of educating the immigration community by answering the simplest of questions. I dont care if this is a marketing tool for him, but I get a huge relief on the verge of getting laid off, when he quotes from the law-book to assure me that its ok to be unemployed after AOS. He takes the time to do that for me. There are not too many out there doing the same!
(just dont jump on me yet saying that there are other attorneys out there answering the same question, as I just said it as an example)

Hi,
I'm sorry if this question sounds trivial, what is LUD? My FP was done on Sep 19 and I checked the uscis website today using my i-485 receipt #. I don't see any update. Please let me know.

This is something that's doable without legislation. It would be done for employment based visas.
I've been reading the posts all day since yesterday. The most plausible "PERMANENT SOLUTION" has to be this. Please read the msg from IV
1. No change in July bulletin
2. No change in August bulletin
3. Well in that case it has to be this. It would be least controversial.
Please avoid all this sensationalism in your thread headers! You don't seem to know squat and are claiming something without any reference...the red dot/square seems appropriate...why I am replying to this!?

Thanks Krishna and snathan! That answers most of my questions.
snathan:
11) is it possible to switch the GC processing to "future employment", although the Labor/I-140 were approved with the understanding that I was to continue working for the same employer?
12) is the H1 visa/Priority Date of approved labor/I-140 carried over when the individual changes citizenship - from Indian to Canadian?
NO
I guess you meant "NO" to # 11 and "YES" to #12 - right?

I do not think this is standard. I worked for a consultant company for 7 years and never saw an agreement like that!!
The only major issue I see here is "Reasonable notice period"? what is considered to be sufficient notice period? If they say it is 2 weeks, then I dont see a problem in that. Most companies would expect that you provide them with atleast 2 weeks notice before leaving employment. This is normal. But without specifying anything of that sort, it is scary. After you sign the agreement, the company might come back and say, the sufficient notice period is 3 months, Then you are screwed. So, clear those things up.
As far as the accuracy is timesheets are concerned, those are pretty much standard language. Since you will get your timesheet signed by your client manager and always have a copy of this timesheet, you will be safe. Also, tranfering your billing is always part of any non-compete agreement. Not just with Desi consultants.
So, the only thing I see is the broader scope of the reasonable notice period. IF you can get that cleared and have the number of days of notice period expected in the agreement, you should be ok.

Yes I wont be surprised if they come up after 2 years saying "all applicants who already have approved i-140(and retrogressed) should refile to verification and should be filed in "Premium Processing Only"......Hmm thats a juicy amount for the administration.
