Fox news and CNN are right wing media organisations who exagerate and create fear among decent American citizens. I for sure will do all my best from now on to expose this vicious campaign and even complain to organisations in the US about Lou Dobbs/Tom and their hate propaganda. CNN (Ted Turner) and Fox (Rupert Murdoch) also operate in other nations like India and we must let the Indian government (revoke their licences) and media organisations know about this.

Hey its Guidi again,
I too have had that un-even focus problem. The photo was in focus on the right and out of focus on the left. Very wierd. Nikon told me it was a depth of field problem but both subjects were standing exactly at the same distance from the camera.

I will be more than happy to pay $5000 if USCIS allow me to file for EAD and AP after I-140 approval. This way, I can work where ever i want and travel whenever I want. $5000 is nothing to get this kind of freedom. What do you guys think ?

IV is in touch with USCIS, Admin officials as well and continuing our efforts with lawmakers. A year ago it was difficult to imagine. We have covered lot of ground in the past one year and this year due to the support of all our members we feel very motivated. Visa bulletins are very negative and let it be an inspiration for all of us to work harder to get rid of retrogression.

One can work on current H-1B (irrespective on basis it was approved), until the H-1B petition is revoked or canceled or expired. However, beneficiary is not eligible for new/extension of H-1B after I-485 denial.
We can quote memos and statutes all day and it would go nowhere. This is simply a matter of interpretation by USCIS and how it applies to the situtation.
Best advice? Talk to more than 1 immigration lawyer.

Is it adequate if we know the case number? I was able to dig out my case number from there.
A few question related to the database:
1) Is the received date the same as the date the labor was filed (in other words, the priority date)
2) The 2005 and after database structure does not have employee name, and there are multiple records found on "prioirty" date, is there any other field that can be verified from other documents like the case number etc? How to nail down to exact record for me?
3) Is the SOC code the same as what we should be looking for "same or similar" job?
4) Assuming answer to above Q is yes, from where can we find detailed job duties for these codes?

I had a delay on a clients site, they needed something changed which took all my time. Business comes first. Here is my entry. I am dissapointed that my notebook PC won't be finished until Friday/Saturday, was looking forward to using it in the battle. The 3D Render was made by me.

i believe that the unity among indians in UK is far greater than that of indians here in USA.
On my last trip to london I had a brief glimpse at the clout of Indian community there, they are very strong and united to make their voices heard, no doubt Tony Blair acknowledged.
I have almost decided to let my american dream rest in peace, now I am looking at immigrating to Canada, in my last 5 years of study about canadian society , i have noticed it to very liberal and many of my friends both indians and americans who settled there have settled for life, many of them work across border in USA either in detroit or in seattle but they are not interested in moving their homes here. So I think i can pursue my dream of free world and enterpreneurship from there.
H1b status and pre GC status is a big quagmire of blackholes, I am not interested in putting away 10 years of my life waiting for GC.
Screw GC , Canadian PR is there, if nothing works my home-India is there ...

The statements that were enclosed with the checks received from Insurance Company shows deduction of OASDI and Medicare taxes but not Federal and State taxes. When we contacted the Insurance Company asking for a tax statement we were told that they have mailed all the statements to the employer and they should include in the W2 statement. Upon knowing from the Insurance Company, we wrote an email to the HR asking for a corrected W2. The HR replied that we can report those wages even without a W2 from the company and later she replied saying she didn't received any statements from the Insurance Company and also they have changed the payroll company and so they can no longer issue a new one.
We are based in NY. We also called IRS to confirm if we are suppose to pay taxes on those income. The IRS officer said it should be included in the W2 and have asked to wait until 02/15. The insurance premiums nor the cost-plus-fees for the sick pay (maternity disability) were paid by us.
There is a bold note on the statements saying:
1) The tax information must be reported on year-end w-2 forms
2) Federal Law HR4331 states that all disability payments will be subject to the Social Security Tax for the first six (6) months only
3) This tax has been deducted from your payment in compliance with this law

My H1 B expires this December. My lawyer has filed for extension. Looks like I will get my extension approved only in Jan. He mentioned that I can work on a pending H1-B extension for 240 days. Is this true? Also can I get my DL renewed using the H1-B receipt notice? Gurus please advise.

Filed with VT service center in early Dec '07. RFE issued 4/14/08. Lawyer should have already responded to RFE. Hopefully approval is a few days away.

When did you file? did you labor approved?
could you give me an example, how you changed your role and responsibilities for eb2?
If your eb2 gets denied, hope you have eb3 keep running as it is right?
Did you file your eb2 with same employer who filed your eb3?

Hello guys,
My frustration is increasing and patience going down. I am strongly considering moving back to India. When planning the move, a few questions popped in my head the answer to which I am not able to find (yet); hence putting it out here.
1. How can I inform SSN department or credit bureau that I am not longer in USA..hence no one can use my SSN even if it gets stolen? Is there a way to "lock" things down?
2. What happens to 401K? Is there a IRS tax law that says because this guy was on H1-B and leaving..don't charge him the 40% penalty?
2.1 After 40% in penalty and 30% in taxes...with the market beaten down...not much remains...wonder if it's even worth touching it. So if I decide to leave the money here in my 401K account, what happens when I want to withdraw it? Rather what is the best way to withdraw it?
3. Any estimates on how much it costs to ship things back to India? I live in 2 bedroom apt..so have the usual stuff.....couch, bed, tv, clothes of many sizes, lots of kitchen utensils. Just an average...I understand things can vary a lot.
4. PIO card has the passport number of my son on it...the passport will expire when he is five year old. So do I get a new passport number? If so what happens to the PIO card? Do I need to get a new one?

What if Employer & Lawyer are NOT willing to share a copy of Labor and no proof of Labor clearance has come from USCIS? Lawyer only says labor has been clear. What are the options?

Nobody from IV has prevented people from other countries from speaking up. On the contrary, multinationalism is only encouraged to give a global face to this issue. But, I don't see anyone from outside India/China bolstering IV's efforts. Why don't they step up and join the core team?
