Just a quick question:
My employer had legal dept and lawer filed G28 form for me when applied for I-485. Do we really need to hire a lawyer to represent us? I am planning to move to client under similar job description this month end and would like to see if I have to file AC21 and change the lawer representation.
I appreciate any response.
you can change lawyers, you cna also revoke the G28 to make it self representation. Its not a bad idea to do self-representation because:
- EAD/AP renewal is straightforward and you cna file it yourself.
- if you ar elucky you will get GC straightaway.
- if you get an RFE, then depending on how messy hte RFE is, you can decide on a lawyer.

I was not bragging. I was just thinking out aloud, so to speak. Economic ups and downs like this this are a normal part of economic cycles in a capitalist economy. My observation is that IT industry is not as badly affected as other sectors. I have not seen people sitting without jobs for extended periods. I mean, some people do loose jobs but they get something else within a couple of weeks. That is pretty much normal functioning of markets.
This is not your normal recession... Whats happening right now is once in a lifetime event... This is the kind of stuff you will be telling your grandkids about! This is payback time of the excesses of the past 25 years of loose monetary and fiscal policy under Greenspan... Your observation about IT industry not being as badly affected is true only till the month of October... Till then things were in sort of slow motion esp in IT sector... Not anymore!

After some procrastination, finally i will be posting the mails out tomorrow. You guys are doing great jobs. I will talk around to my friends to send out too.:)
If you could that would be awesome, I found that just printing out a bunch of the templates made it easy for folks to hand write their name and address. I have been doing the envelope and stamps myself, that way you can be assured it is acted on and sent :) Thanks Skc526

I think USCIS is working towards reducing the backlogs. It could be starting point for all EB community to feel better
With IV success, I foresee the EB categories as current at any point of time. And GC process is less than 3 years for any EB category

Is there anyone on the forum who is currently doing a daily commute between Canada & US in general, or Windsor and Detroit in particular ?
Can you please share your experiences ? Good or Bad
What are the frustrations,hassles, issues in doing this.
I have heard that during work commute hours the cars kleep moving fast and officials doint delay if you have proper papers, but on weekends its a nightmare (so wont affect us).
Any real experiences you can share will be appreciated.
Also p[pl from Detroit, MI can you share info on your city. Major employers, good areas to visit/live, desi life and culture etc.

but, Once I was stopped at the airport by a security agent while travelling within US and he asked me abouit my status. When I mentioned I am on Work Visa he asked me to show the passport and Visa, I was not carrying one. I showed him my DL, He was on call with someone for 20-30min and come back returned my DL and istructed to carry the passport whenever travelling.
Per law, all H1B papers (atleast LCA) should be kept where non-immigrants work. There is no clear law for non-immigrants to hold passport/visa/EAD always with them. They recommend always to keep with you. Further, consulates( when they issue visa), won't give any specific instruction to non-immigrants to carry passport/visa always with them. However, for immigrants (LPR) it is very clear that one MUST hold orginal GC always with them. It is rule/law. The welcome notice clearly shows. Although, many dont practice, it is still a rule. I empathize with your position. I think when one door closes other windows open up. 10 years from now, you may feel that this was the best thing that happened to you - going to Canada. Your son is a USC, so he can come back anytime he wants. Best wishes in any case.
well..I have been waiting for my labor certifcation to get certfied for too long. just after Sep 11 I applied both for US GC and Canadian PR. My wife also applied for her GC. meanwhile her GC moved to regional when suddenly DOL thought it was time to regroup and there it went into BPC. In the meantime we got canadian PR some 2 years ago but we did not move thinking that we have jobs here.Then she got pregnant and lot of complications ( premature labor) and during those complications her company got acquired by another bigger firm who thought they don't need her..and result was job loss plus GC into the trash....meanwhile my labor certification even after 5 years was still sleeping in EB3 category(PD Oct, 2001) when i still have Masters( god knows why my lawyer put into that category)..Now my canadian PR was set to expire in march, 2007..so I thought i should decide fast..and i applied for jobs..and I got offer in vancouver with moving expenses paid from califronia..It has been the toughest decision because my employer is Indian here in california..and I have had good growth(10% average) but not the way I had wanted..I guess he also exploits..Indian exploiting another Indian..because they know I am not going anywhere..plus we work hard.. I asked him to match what was being offered in vancouver..and he started converting CAD into USD..well..it is not fair..So I have decided to heck with US and the Employer..and move on...at least I can come back..it is not an easy move because my son being premature child had lot of free facilities in california..hopefully he will get the same in Vancouver until he gets to 3 years ..and then it stops..
I have been in this country too long..and I guess one should settle down rather just wait for them to give GC...reading the other post about one lady whose EAD card got expired just tells me that how inconsistent this GC process can be and right until the end...

I applied my first H1B extension through my company in June 2008. On 11th Feb, I received REF. I am very much tense about it. Since I am out of project. I got cleared my I 140 with this company in July 2008.
I applied H1B transfer(Normal process) also in October 2008 to other company . This one is still pending.
I am very much tense about my status. Please suggest me what to do?
Is it better to answer to RFE for first company?
or
Can I do PP with second company? or else any better thing?

months you are out of projects? if its more than 60 days then even though if you transfer to other company they will ask for pay stubs..... which you may/may not have......

YES you can convert into EB2. If I were you and get some offer to convert into Eb2 I would do it. Eb3 is not going to move until Eb2 will become C. and chances are that Eb2 India may become C in next 2 years if same rate labor get approve. If you go on convert route. lets assume that labor takes 18 months and I 140 takes 6 months. that is 24 month it self. Now after 2 years your case can be current but if you stick on Eb3 then after 2 years it will start from 2002. So if your PD is in 2004 then you may need another 2-3 years for that.
So bottom line is you need to find some one who has job opening in Eb2 and ready to file for you. Which is very rare opportunity in given environment. almost like a winning a lottery with 10k prize.

I filed mine on May 12 and sent to Phoenix Lock box and had the same issue. My checks are not cashed and am going through the same pain as you do. My lawyer suggested its not unusual to have these delays and it could take upto 4 weeks for the receipt notice to come. I am still tensed as the checks are not cashed and there is no receipt for the renewal. Please let me know how you are proceeding or find any new info

I am July 6th filer and I opened a SR on Oct 6th and got my FP done (including my wife's) on Nov 23rd. I guess opening a SR is a way to expedite this FP process...

My H1b is going to expire on April 17th. I had found a new job and they had applied for my H transfer on March 27th. I would like to know
1. How many days is required to get a H1b transfer receipt.

That decision has no relation to pending h1. You can choose to go to EAD anytime. Looking at your situation, you are probably better of on EAD. Anyone can throw light into this one. Can we track APs now for NSC.
NSC is receipting late and also their AP documents are mailed very late. Please let us know when we receive our AP document after getting the receipts? for eg. 10 days, 20 days etc..
It will help lot of us who want to make some travel plans.. [some like us are eagerly waiting for past 4 yrs!!!]
