Hi,
I'd posted a note earlier. I haven't received any updates yet. I am in contact with 4 other people who interviewed on 4th Jan and are still awaiting a reply. The kentucky number mentioned in one of the replys confirms the date on which our H1 was approved. When you call up the number, on mentioning your case #, it pulls up the date on which H1b was approved.
Could anyone who's received a email/ call please post a message to the group, indicating the wait time and date of the first interview?

This is plain stupidity. These employers should first take a good look at an EAD and a GC. As for as work authorization is concerned, both these cards provide us with the same rights. The EAD says �The person identified is authorized to work in the US for the validity of this card� where as the GC says �The person identified by the card is authorized to work and remain in the US�.
So why does the legal department come into picture here? Is it because of the expiry date associated with EAD�s? If that�s the case even a GC has got an expiration date (a later date maybe). Does that mean that an additional budget is required to hire GC holders?
I was thinking exactly like you until she educated me on this yesterday.

I spoke all the the reps that someone posted not on this list.
To add to the list of sponsors/co-sponsors, Congress Debbie Schultz is a co-sponsor for the bill (so don't call asking for support, but you can call to appreciate their efforts).
I think it would be better to keep it brief. They don't have time, and we can't spend lot of time, or else we won't be able to call all of them. It took me 30 minutes to call all of them.
I read somewhere that Steve King is not supportive, infact he's opposed to this bill. So it would be wise not to call his office. I don't he'll change his stance 'coz he's part of numbersusa/other nut cases.
Also note the phone number of Robert Scott is wrong, it shows the phone number of Adam Schiff. I realized only after I called twice. but luckily I realised before I could go through the whole talking points.

Have a questions for the Gurus...Is Credit Check performed during any of the processes related to FBI (for people who are present in the US with a SSN) ? IF so, will a Foreclosure in the credit check cause any problems or delays in adjudicating the 485 petition ?

I am a july 2nd filer and filed my second application on Aug 15th.
Now that I have got receipts for July 2nd applications, I have put stop payments on the checks on Aug 15th application.
My hope is that my 2nd application will not be processed.
Hi, I'm in the same situation. I was afraid that my July 2nd application may be rejected or misplaced or ... so I filed a second application in August. Do you think that it's safe to put a stop payment on the check for the second application? I consulted an immigration attorney on that and he thought that it may negatively affect the first application if the second one is rejected. The attorney's suggestion was to withdraw the second application once the receipt notice is generated. Is there an option to combine both I-485s? Please, let me know what you think. Thanks, Leo

Why is everybody so happy? He has just briefly and curtly informed in the message that flowers will be forwarded. They won't be sitting on my desk and embarrasing me. There is no acknowledgement of the issue or any empathy or compassion with the sufferers. Now even the press coverage will make USCIS director look good. I don't see what's the positive development here.
They probably tried to pass the irritant to someone else. If USCIS continues receiving flowers, and therefore passing them on, one day even the soldiers will say "No thanks!". Then they will pass them on to someone else. But for how long?
I think this campaign will NOT lose its effect-- as long as we are persistent. Ideally, we should continue sending flowers at least so long as it does not become a MUCH talked about issue in the print and radio and TV media. My humble opinion.

I have the same situation. CPO change date on 5th, email on 6th. Since then, no LUD, status changes, email, or snail mail.
No need to worry...I got my physical cards yesterday in the mail - about 7 business days after CPO update. You will get the cards soon...

I Have opened an SR on Aug 6th and then sent an email to TSC followup . I got a response from them on friday " We are currently researching this situation and will contact you with an update." HAs anybody this kind of response?

I had created two different SRs, one for myself and kids and one for my wife. The SR which I created for my wife got a response with Card Production Ordered and for the SR I created for myself, the status in the response was "currently under the review". The date was one day before my CPO mail date.
I guess you have nothing to worry. This seems to me as a standard response.

It is a good thing that HR is talking to their legal dept. Legal should state that EAD status is not valid grounds of refusing employment. Consulting with their legal department is actually a good thing, have faith!

a) email with offer of employment and link to I9 form in offer letter
b) accepted verbally
c) background check done and report sent to me
d) called and was chatting when I mentioned EAD, was told sorry we cant offer you employment due to EAD, and that is has to EAD filed by this company only because they cant verify its legality et., one way was for them to do my h1b but they are not hiring h1b right now, so sorry. later they said they would consult with legal and get back to me. however i dont hold out much hope
e) i immediately filled out the i9 form
f) wrote email to them outlining our conversation from d) explaining my surprise (and boy! was a surprised!) and trying to make my case that I was not a risky bet for the company because of how interminably long I have been in this country and my spouse had GC already, but mine was not processed in time before priority date became not current.
g) hr wrote back, acknowledging our conversation and saying that they were not sure and that is why they were going to consult with their legal dept and will talk next week.
All I have are emails and offer letter.
I really dont want to go the legal complaining route if this can be resolved. But I am in a fighting mode. I probably would not have been so upset if I had not turned down other interviews...

It is all very random. The archiving system at the USCIS is designed by a bunch of retards.
The case files apparently go in batches to adjudicating officers and each officer than asks for more when he/she can. Lord knows what crazy method they use. With recent criticisms they have gotten even more rigid in their idioticity. They now do not pull a file out of its queue, even if they know they are screwing up.
They are quite simply unaccountable and do as they please. I completely empathize with Americans who do not want their health care delivered by such individuals. They fail to understand that they represent the US gov't. Speaking to some of them you see a sense of arrogance. Many of them do feel they are being charitable towards you upon approving a case.
Interestingly even congressional inquiries are getting stall messages nowadays. Perhaps it will take more of that to make congressmen aware of what we have to deal with yearly.

Well even if you use AP, you need a passport, dont you? And the passport must be with the Consulate pending stamping. So one way to get the passport back is to withdraw the visa application.
A question though: is'nt it abandoning your H1B1 visa tenure if you enter on AP even with a valid H1B remaining?
I don't know if procedures are different in the consulates..In my country you apply for H1B visa ,they interview you and tell you that you will be granted a visa so we will call you when stamp is ready...you take your paaport and yoiu go home and whenever they call you for stamping you bring your passport and stamp it the same day...Are procedures different these days?

Q: Why is the wait so long for my employment-based green card?

Therefore, some people have to wait in line until a visa is available. The U.S. Department of State (DOS) gives out 140,000 employment-based visas each year. About 85% of those visas go to people seeking a green card in the United States, while about 15% go to people seeking to immigrate from abroad. Currently, about 234,000 people have employment-based adjustment of status (green card) applications pending in the United States and are waiting to get a visa. How long you wait for a visa depends on the supply and demand for your particular preference category, your priority date, and the country your visa will be charged to, usually your country of birth.
Q: How can I determine my place in line based on my priority date?
A: Your preference category, priority date, and country of origin determine your place in line for a visa. The earlier your priority date is, the closer you are to the front of the line. To better assist you in knowing your place in line, we are posting a report of our total pending inventory of applications for employment-based green cards (Form I-485, Application to Register Permanent Residence or Adjust Status) for those seeking to adjust status in the United States. See the �Pending Employment-Based Form I-485 Report� link to the right. Q: What information do I need to have before using the pending Form I-485 inventory reports?
A: You need to know your priority date and your preference category to use the pending Form I-485 inventory reports. For more information on priority dates and preference categories, see the �Visa Availability & Priority Dates� and �Green Card Eligibility� links to the right.
Q: How do I read the pending I-485 inventory reports?

A: Assume your priority date is in January 2007, your petition was approved for third preference, and you are from China. Using the Sample �Pending Employment-Based Form I-485 Report,� below you will see on the third preference chart that there are 2,618 applicants with a priority date in the same month and year as your priority date.
If you want to find out how many third-preference green card applicants have an earlier priority date than yours, you will need to add all the numbers starting with the number at the beginning of the table, January 1997, and ending with the number immediately before the month and year of your own priority date, December 2006. You will see that there are 131,341 third-preference applicants who have a priority date earlier than yours.
Q: How do I know how many applicants from my country have an earlier priority date than mine?
A: Assume your priority date is in June 2005, your petition was approved for third preference, and you are from India. Using the Sample �I-485 Inventory for Individuals Born in India Report� below, you will see that there are 175 green card applicants from India with a priority date in June 2005.
To find out how many applicants born in India have an earlier priority date than yours, add all the numbers starting at January 1997 and ending at May 2005. You will see that there are 42,796 third-preference applicants from India with a priority date earlier than yours.

Because of historically higher demand for visas from China, India, Mexico, and the Philippines, each of those countries has its own separate report. A: All applicants for an employment-based green card may use the pending Form I-485 report to determine their place in line for a visa. A: First, click on the link to the report you want to view. Once you click on the link, the report will appear and you will see a series of charts, one for each preference category. If you want to find out how many third-preference green card applicants have an earlier priority date than yours, you will need to add all the numbers starting with the number at the beginning of the table, January 1997, and ending with the number immediately before the month and year of your own priority date, December 2006. You will see that there are 131,341 third-preference applicants who have a priority date earlier than yours.
Q: How do I know how many applicants from my country have an earlier priority date than mine?
A: Assume your priority date is in June 2005, your petition was approved for third preference, and you are from India. Using the Sample �I-485 Inventory for Individuals Born in India Report� below, you will see that there are 175 green card applicants from India with a priority date in June 2005.
To find out how many applicants born in India have an earlier priority date than yours, add all the numbers starting at January 1997 and ending at May 2005. You will see that there are 42,796 third-preference applicants from India with a priority date earlier than yours.
