I do have both Criminal attorney and Immigration attorney representing me, they say it should be fine. Again they say its upto the VO at POE. can I request the attorney to come to the airport during my POE time, so that i can request the VO to talk to my attorney?

There are 3 work categories,
at least 3 queues each for three stages.
the first queue had at one time, rir, regular and then bec, perm added to the mix.

Yes I am looking at the thread. I am expecting a very good forward movement(At least to 2007 Dec) in EB2 India category in the coming months.
If you see the Visa bulletin Archive for the last three years during April - Jul range theres a sharp jump in Priority dates(more than a year and more) for EB2 category. This happened during vertical fall out (This doesnt include last year because last year its horizontal fall out). So this year I am expecting the cut off dates will move at least two years ahead for EB2 India because of the horizontal fall out. For Eb3 I am not expecting any big change unless theres some immigration reform in the new OBAMA government.

I am very happy for India.
1.Now most of the work that is being done here by H-1B professionals will be done in India.
2.Innovations will be made in India. As more money is available for the companies to pump in to R&D
3.Indian IT infrastructure will improve.
I am not so happy for USA.
1. They are doing a big mistake on immigration. They do not have enough resources with right skill set.
I am not so happy for myself.
1. I am disappointed by the fact that USA is going in the wrong direction.

I'd like to be able to say that those of us on H1B visas are doing the US a favor so we should get rewarded better for it, but I will be honest here and admit that I did not take up a job in US to be a good samaritan to Americans. I would be surprised if there were any H1B holders who moved to US just to do the states a favor.
No, in fact I like many others moved to USA because I got an opportunity to advance my career and at the same time I am young and open to experience life in America and other parts of the world. To top that I love my company.
Sure, I am helping my company and doing work that will touch the lives of millions of people. I pay my taxes. I pay my health insurance. I pay salaries to healthcare practitioners as I and my family needs their services. I pay rent. I shop. I keep money at my bank. You know, if you consider all that I must be a pretty good American resident. Smooth.
Sadly there are some things that are not so smooth. My wife, who is a graduate from a US college and a qualified teacher with over 5 years of teaching experience in her home country, has no right to work here. I hear you say, US needs teachers doesn't it? She could get her own H1B visa.
Life is not so black and white. It is difficult for her to find a compatible job in our area with an employer who could and would sponsor someone for H1B. She is chained by this. There are a myriad of teaching jobs in our area that she could fill right now if she had work authorisation.
That is the #1 reason why I am now seeking a GC. If my wife could work there would honestly be no reason for us to want a GC except maybe when we reach the end of H1B time limit if we decide to stay here longer or permanently.
We're legal, educated, and do things by the book. I'm from UK, my wife from Japan. That means just about every major country of this world is open to us (All EU, Japan and friendly countries like Canada and Astralia).
We'd like to make US our home if we are welcome. Lawmakers, hear our cries.
Could we have a poll for how many IV members are married and how many of those both got H1Bs? My feeling is that there is a very large number of H4 spouses suffering from not having work authorisation.

I will be on EAD for the new job..and the LOA is vacation without pay. My salary is already 30% more than the one mentioned in labor but no promotions..new job has actually lower salary and job description similar.
If i do ger rfe for evl with me in new job then I hope salary doesnot become an issue

Guys MY PD is feb 2008. I am recently watching vias bulletins. I am in EB2.
Based on my watching previous visa bulletions ( after sep 2008) I dont see that it makes major difference if you file in EB3 or EB2.
Both are backloged very much and sincearly I dont hope inspite on being in EB2, I will get EAD or GC till 2015.
What are your thoughts, is it worth filing in EB2?

No alternate degree requirement or equivalency was mentioned. --> just found out that it did say BS+ 5 exp is ok - USCIS mistakenly approved the I-140 (I am assuming OP does not have a US Masters and only has masters equivalent or BS + 5 yrs)
- Sponsoring employer revoked approved I-140
- USCIS checked the I-140 and realized it made a mistake in initial I-140 approval
- USCIS denied the pending I-485 based on incorrect I-140 approval
If all of the above is correct, then I doubt if anything can be done. I dont see any grounds to file MTR based on the fact that beneficiary does not have a US Masters degree which is the requirement as indicated in LC filing. I dont think you can do anything with respect to USCIS's mistake in approving I-140 earlier and now denying it. Got to wait and see what the attorney's view is in this regard.

That one phrase in your LC requirement could turn out to be a life saver for you. Can you further clarify the educational/experience requirements mentioned in LC. Was it Masters or equivalent with zero experience OR Bachelors with 5 yrs of progressive experience? Your educational evaluation should meet atleast one of the requirements mentioned in the LC. Either Masters or Bachelors + 5 yrs exp. I think for your educational background (non 4 yr BS degree), I feel more comfortable with getting the evaluation done to satisfy the BS + 5 yrs requirement rather than going for Masters equivalent. NSC is known to be strict w.r.t 3 yr BS degree when it comes to EB-2 cases. However, since your initial evaluation showed you as holding a masters equivalent, I am not sure if its a good idea now to try to defend your case with BS + 5 yrs equivalence. A good attorney would be able to guide you through with this. I also suggest you to consult any reputed attorney regarding this and get feedback on your company attorney's plans and not just blindly follow what your company attorney says.
