real problem is we are trying to wake up someone who is pretending to sleep and we can never achieve that. I am starting to feel pessimistic too about this whole bill thing, when they debated for the freakin horse shit for so long where as genuine issues like ours getting delayed..excuse my language, i am just so frustrated and starting to feel there is no light at the end for legal immigrants.

There are MS Access database files for each year.Depending on which year your labor is filed, download the Access db.
For eax, mine was Dec 2002.I downlaoded 2002,03,04.My record was found in 2004 database.
If you open the Access db (You need to have MS Access to view these files.If you dont have it, downlaod the free trail version from microsoft.com)
If you open the file, it is the database of all the Labors that are filed in that year.One of the attribute is the Employee name.You can also search on Attorney name.
If I were you, i would first filter on Employee State and then search for the Employee name.
Its simple.Try it and let me know if you need further help.

I was exactly in the similar situation. My wife entered on H4, started work on EAD. Now we are traveling to India, both have AP as well as H visa (H1 for myself, H4 for wife). I talked to our corporate lawyers pretty much the exact same questions you are asking. Here is the response (that I have in writing from the lawyers):
1. H4 status is invalidated the first day you report for work on EAD. While you are working, your status is AOS in the US. There is no consequence of this change (ie you do not have to report anything to the USCIS).
2. When you reenter the US, you can use H4 for reentry. (Yes, even if you are still employed the employer with an EAD and went to India only for "vacation"). This is because at the point of entry, the definition for "working on EAD" is actually reporting to work. As long as the H1 is valid, you can enter on H4. Your status at the point of entry is H4 admission. However, if you report to work the next day, your H4 status again is invalidated and you are back on AOS.
This is a pretty confusing scenario for many and multiple lawyers that I consulted have agreed with the above legal advise.
So, even though we have AP, we would be using our H visas to enter.

I only have something to say, everyone is looking for its own turf, and if you really want diversity in the forum, the hard count will not attract anyone else other than Indians and Chinese. I am few months from working due to EB2- Worlwide category (current), so any change on the hard count is not on my benefit, same for anyone who is not from India or China, the EB3 is not current worlwide but the line of all the other countries is still shorter, if you really want to reach more than Indians and Chinese the goal has to be good for everyone, and the hard count is not. Thanks.
Latest update: Latina explained that the hard count doesn't affect the place in the line for the Worlwide category, it just affects the unused numbers and that this will go to other skilled workers from no worldwide categories other than to not skilled people, I am all for that, I just do not want to have to wait any longer and if Latina was correct my assumptions were mistaken.

Can any one tell me is it necessary to Get medical done by Dr. only around ur location.
Reason for asking is I live in NJ. And i got an appointemt with DR. Kim in NY as i know him through somebody else.
He is also more reasonable asking around 190/-

As far as I know if the old I-140 is revoked or withdrawn before new I-140 approval one can not port PD.
My old I-140 is still active so it was safe while porting. I am not sure what happens if the old I-140 is revoked, sorry i don't have answer for this..

I have used AC21 and have not sent a letter yet to USCIS as it is optional and that is what my attorney recommended...that is to wait for an RFE (I have changed address as I moved to a diff. state; chances of an RFE increases)
That said, I am wondering that with a G28 representation on the files with USCIS, if I send a AC21 letter all by myself (without attorney), will it be honored by USCIS ? I am comtemplating of doing this as I wanted to prempt the RFE thereby saving precious time (when date is current) and the money that I would have to pay my attorney when the RFE reaches him (I would rather he reply to an RFE but want to give my best to avoid it)
any ideas ?

basbawa10, Well, why they are transfering your case back and forth can only be explained by them. Very fact that your case has been transfered around suggests that somebody has seen your case. Procedures described in link mentioned above, has a protocol on determining proper processing center, which has a complex formula based on state of residence, center approving I-140 etc. If your I-140 was approved by one center, and if in the meantime you moved to a state in different center jurisdiction, or USCIS changed jurisdictions, it might have created ambiguity on who should deal your case. Back and forth transfer suggests that centers are not agreeing on who should deal with your case. You may want to try an Infopass, which would let you know if your case is preadjudicated. If so, you just need to wait for PD to be current again.
