    I spoke to 2 attorneys...we just cant trust them..it will be finally we who will get screwed big time..

    1 said, we can get an RFE asking for the latest i94.
    2nd said...in the worst case senario..we will get the H1 issued without the i94..which means that we have to back to home country for H1 stamping..that will be a nightmare in Madras in my case..!!

    Does anyone know if connecticut is also amongst the states that dont issue driving license if work permit is 1 year or less?
    Did you get an answer to this ? I am planning to move to Connecticut and will be working in New York City, thus wanted to know if you got an answer to this question.

    Hmm...let me guess. Well, I had same issues with my current lawyer who is a official corporate attorney for immigration matters with my employer. Good part is, I didn't have to pay money to him but bad part is he is mostly not-responsive, arrogant, treated us like slaves, rude and what not. He doesn't answer anything about AC21 and we have to go thru' HR if we have any questions. Many a times, employees are completely unaware what is going on with their immigration papers. I did not receive my LC or copy of I-140. Guess this differs from person to person and company to company.

    well, now since I have decided to enjoy freedom using AC21, I would like a good lawyer to represent my case; whom I should be able to ask questions.

    Yesterday on cnn and ofcourse on lou dobbs show there was a statement that I guess Chamber of commerce was drafting the CIR.. he was so pissed off about it .. I donno if it is possible to use IV lobbying to get our goals in CIR through Chamber of commerce.

    I just talked to an attorney. He said that if there is a long gap, your H1 may be approved but with out extension of stay (no I-94) and that I may have to go for visa stampling in the consulate in India. As I already have 1.5 years on h1, I was told that it doesn't go thru the cap. some one mentioned in the thread, that once you use EAD, and if u were to get H1 it would be under cap. I am not sure which one is correct.

    If you are on H1 and switch to another H1- you do not need to worry about Cap

    If you are on H1 and switch to EAD- you have relinquished your H1.Whenever you wish to resume your H1- at that time you will go against the Cap.

    Didn't understand you specifically mentioning "US Stem Graduate" in your signature. What do you want to convey through this statement. Ofcourse other statements looks OK.

    Thanks for taking notice. That is because of a issue a lot of us face, being eligible for Eb2, but filed under Eb3 due to employer, attorney, etc. etc. et al. Any more Q's I would be pleased to oblige. I will put my category next to that to make it a little more clear :rolleyes:

    Cool down dude, I can understand OPs frustrations, I am in same boat and see similar cases around, not that ead or ap is anything great, just that someone who applied before feels rejected seeing TSC giving out eads like cookies:)

    When baby cries mom gives milk cup or some time slap. But they like each other. So nothing to cool down here. You need to face argument.

    Even receipt is also not some thing great but for you question should be what is more critical at this time getting receipt or getting ead.

    I guess every one can wait for EAD but every one need receipt first.

    Hello,

    I am sure others might have noticed that 485 processing dates at NSC (for example) have literally crawled from the beginning of the year to now. Here are the processing dates (per USCIS status).

    12/15/2007 Status - 04/24/2007
    01/15/2008 - 07/19/2007
    06/15/2008 - 07/28/2007

    Thats roughly 9/10 days worth of 485 processing from mid-Jan to mid-Jun 2008. I wonder what the processing date looks like for the mid-July status update (which should probably be out tomorrow).

    I am an EB3 India applicant with a PD of August 2001. Cant file I 485 due to retro so cant get AP or EAD for spouse. I am currently in 7th yr of H1 and will soon be applying for 3 yr extension for 8,9,10 th yr based on approved I 140.
    I am also a Canadian PR and one option is to move to Canada. However one option which I have been researching seriously lately is to live in Windsor, Ontario and work in Detroit , Michigan.
    Windsor and Detroit are both Urban areas and twin cities on each side of the border connected by bridge and a tunnel. From Windsor most of Detroit metro is only 1 hrs drive. Downtown Detroit is only half hr drive.

    Here are some advantages to this.

    1) You keep your H1 B visa, and US Salary.
    2) You earn time towards maintaining your Canadian residency and even Canadian Citizenship.
    3) You have best of both worlds. (US Salaries opportunities, Canadian healthcare/social benefits).
    4) Spouse can work in Canada and keep H4 also.
    5) Can continue GC process without loss of security.
    6) Visit other cities in US. ie even if spouse /fly is in other city you can easily commute once a month etc.
    7) Once you get GC you can always move back to US.

    Disadvantages

    1) Crossing border each day (normally not an issue but border gets busy on some days).
    2) Paying Canadian income tax.
    3) Only possible if you get transfer to Detroit or new job there.
    4) If you own home etc or your wife is studying etc you may have to live separately for some time.

    Has anyone done this or knows anyone who has done this ? In theory and on paper its a good idea. Apparently thousand of ppl (even non immigrants) do this both ways.
    Any insights anyone can share ? This may be good option in many cases.

    I did not understand the "time of filing I-485 (that means that visa is immediately available) minus time that I-140 was pending with USCIS" part.
    My situation is as follows - My I-140 is approved and judging by the current situation my child will be above 21years (currently on H4) when visa becomes available.
    My questions are - Will I be able to extend my child's H4 beyond his 21 years, assuming I continue on H1? And will I be able to adjust my child's status when visa becomes available?

    ThanksShort answer No. Long answer: it depends on when you will apply for 485. For example: you filed I-140 on Jan 1-st 2006, it was approved on Jan 1-st 2007, so it was pending for 365 days. You are applying for 485 when you child is 21 years and 364 days old - he is covered by CPA (Child protection act) and can file 485 as your dependent. One day later - he is not covered and could not file 485.

    But marriage certificate from Indian Consulates can not be used for this purpose.Same case with birth certificates.

    My sympathies to you.
    However I don't understand how your wife and kids got depedendant visa. I don' think one can get a H4 or L2 visas with out marriage certificate first place, unless your wife came here on F1 visa here.
    Anyway, You can apply marriage certificate with Indian Consulate. You may want to visit there with wedding pictures and passport there to get your certificate

    I just came back from india. Flew via Frankfrut (Lufthansa). Lufthansa was bad. Frankfrut was dirty, no customer service, service Reps are rude. Next time I will avoid Frankfrut. AND I will not pay a dime for transit visa. period.

    American airlines was trying to stop me boarding the plane as the CSR was not aware that if someone has AP they would not need transit visa in Frankfrut. I had to fight and make them call Frankfrut to confirm.

    Might not be pertinent but American Airlines food was horrible and tasteless. They were running out of food.

    i believe that whatever the above stories convey it does not apply to skilled workers......life in india/china has got better only in the last 5-7 years....otherwise i have seen above average people in india retire with barely enough to live a good life.

    if a skilled worker spends 6-7 years in usa with good financial planning he can easily retire, unless one has really started living the dream(big car....big house...all the latest gadgets....yearly india trip...etc..)

    i do agree that this story can be related to a non-skilled worker from any country....(even below average americans have nothing except for social security when they retire....)

    techy2468 I hope you are kidding & r not serious :) . If you are then u need to meet someone (ofcourse skilled professional) who came 6 /7 yrs ago & ask his opinion on retirement or check out where he stands.

    You did not mention any figures (would love to see them from you as well as others reading this thread ) so not sure what you consider to be good savings/financial planning for retirement ?

    According to you all those who came in 1999/2000 have enough savings & can start thinking of retirement now.
    Do you all guys agree to this or is it only me who is still poor :D ?

    Here are some approximate figures, which i hope go for most of the skilled professionals
    Assume billing rate: $90K - $100K per year
    Consulting Company cut $ 30K - 40K per year
    Let's say average salary is: $60K ( i know many professionals r working for even less but let's include some little rich guys too :) )
    Now 60K means $5K salary per month
    After Family Health Insurance (considering married) & taxes salary in hand is $3500 to $4000

    Let's take $4000 in hand
    Now expenses :-
    House rent : $850
    Car Insurance : $150
    Car Loan payment : $250 (assuming used Toyota/Honda for 8K - 12K, No big dreams :) or rich lifestyle )
    House Utilities bill : $150 (like water, electricity etc)
    Cable/Internet/phone : $75 ( No HBO or special channels - No big dreams :) )
    Grocery : $500
    Eating out once a week : $125
    Lunch out : $0 ( ask your wife to give u lunch :D - No big dreams)
    Misc $300
    Total monthly expenses $2400
    (living an average middlecalss lifestyle)

    Savings per month 4000 - 2400 = $1600

    Now in 6 - 7 yrs (assuming the person worked like a "Donkey" :D with not a single vacation , no trips to india)
    12months X 6/7yrs X 1600savings = $ 115,200/ $134,400 (Total Savings)


    Do you really think this is sufficient to buy a house & lead a retired life either here or in india ???? or maybe i hv started thinking big :D
    (By the way even after 6 yrs i don't hv anything close to above figure -maybe because i did't live/work like a donkey)
