What is your EB category?
When i checked my status online, i saw that there was a LUD on my pending case on 10/7 and 10/8. Wondering there is a LUD, I called the NSC and the person on the phone told me that the case is being reviewed by an officer.
My question is that if there are no numbers available, then why would there be a LUD on the case status. So has anyone else seen a LUD on their cases as recently as after Oct 1, 2008????
MY PD is March 2006
Filed 485 in July 2007.
RD is Aug 2007.

Apparently someone flagged me.. thats fine.. if people here cannot have a proper discussion without having to flag each other I dont see any point in calling ourselves "smart" "highly skilled".. looks like we need to grow up first. Personally, I dont care about these green/red blocks. I have the right to express my opinion whether someone likes it or not. If someone does not have "words" to argue back thats their problem..

How do you think the passage of the DREAM ACT could impact our situation ? If they pass this, they would allay a sizeable portion of illegal immigrants to get amnesty through their children (few millions). I am just wondering whether the illegal alien supporters would lose steam to support CIR after this ? Ironically, they would get a sizeable amnesty, overhelm USCIS with millions of applicants and probably make the passage of a CIR bill more distant. I can't think of something less advantageous to us than this. I hope I am totally wrong.
What do you guys think ?

Recent mid-term elections resulted in wins for the Democrats, who will take control of the U.S. House of Representatives and virtually the U.S. Senate as of January 2007. The ensuing two-year term, many believe, may be ripe for some sort of comprehensive immigration reform. President George W. Bush has been espousing all along the cause for comprehensive reform in this area. Most people recognize that there are immigration problems and governmental delays that exist. Most also believe that the system needs to be changed for the better. But just how this should be accomplished is not so easily agreed upon, and so it is a hot-button issue. Many of the hardliners, who took a strong anti-immigration position, lost the recent elections. But there are some who took this stance and won. It also is widely believed that many of the newly elected Democrats expressed anti-immigrant sentiments in their campaigns. Achieving any strong pro-immigration measures may prove to be more daunting than originally was anticipated; certainly more than many hoped it would be. Needless to say, we can expect 2007 to mark the beginning of a time for change and flux in the arena of U.S. immigration law. There is a possibility the DREAM Act could be passed, allowing the children of undocumented immigrants (who complete their high school educations in the United States) to obtain conditional "green card" status if they enroll in college or join the U.S. armed services. Both the Democratic and Republican parties seem inclined to help children. There are individuals, however, who are not willing to give any benefits to children of undocumented immigrants. thats the problem.... I cannot switch to another job as I am in the 7th year of H1B and I-140 approved but did not apply for I-485 yet. friends told me its risky to switch jobs now as I may be out of status.
Boss, I was exactly in same position as yours. You can call it a mirror image. I switched in 9th yr of h1 after being a white collar slave with same employer. I'll suggest before you loose self respect and confidence in your own eyes..... SWITCH.

Does anyone know whether hard copy of Labor approval is required for filing Form 1-140. My Labor status shows certified, but my lawyer is conveying that they have not received my hard copy of approval to process Form I-140 and 485. Can some one tell me if we can take a print out of Labor approval from online status and use it for filing 140.

I am following from the start of the original post. This was a post by a new member who appears to create rift among the EB2 or EB3. The reason I believe is he just want to incite in such a way that few other folks will respond and keep the thread floating. Later few other posts by himself were created with different ids. just observe the trend and you will notice it.
So folks dont respond any more and this rift creation will die down.
I hope the admins keep this thread open and not kill it. I am not sure what the intentions of the OP ( some of you claimed that he wants to create a rift ), but this is definitely a valid concern for all the EB3(I) guys. This is a natural reaction to the frustrations of EB3(I) guys just like the mass upheaval during the July 2007 VB fiasco. Since it was across the board, there were no differences. Now since this involves only EB3(I), there is not much support from IV or others. But in my opinion, this is as much unfair as the Julay VB fiasco.
Some of the EB2(I) guys are worried that their GC dreams would get delayed if there is any Admin fix for EB3(I). For all those individuals in EB2(I) who want to oppose any kind of admin fix for EB3(I), I just want you to think about it. Is it really fair? There are individuals in EB3(I) waiting since 2001 - a total of 8+ years. Don't get me wrong - but some of the EB2(I) guys who have applied as late as 2006 and 2007 are expecting/hoping to get their GC this year if there is a spillover. And I think these are the individuals ( not all of the EB2 guys though ) who are opposing any kind of admin fix ( please dont yell at me or curse me etc...if you are not one among those mentioned, then please dont worry..this is not about you::) Ofcourse i would like each one of us to get GC as soon as possible) to EB3(I).
And I dont see why there will be a rift between EB2 and EB3 if each of us follows net etiquette in positng responses. Let's do some constuctive brainstoming - without getting into perosnal attacks or getting too emotional. Let's do what is right and not what each one of us thinks is right. Then I guess there wont be any rifts. The only thing I am asking is to get EB3(I) to advnace a little bit. I am not asking for it be on par with EB2(I). I hope some of you see a point in my frustration::))

I think flowers comaign is a good idea. But I wanted to know why don't we send letters and emails to Mr.Aytes and USCIS Director and probably HEads of DOS to issue the 182,000 unused visas since 2000 now so USCIS can work on those visas from July to October.
NYTimes article mentioned that DOS officials did not want this years number wasted like the 182,000 visas got unused since 2000.
Can someone come up with a writing so we can all send emails and postals mails with this request.

One of my Friend's Wife had same issue and She got H4 stamping from her country with out any problem. Visa officer asked paystub/w2's of spouse (H1b holder) and not dependent's and least bother about her previous status. Do not attach her H1b document while applying Visa.

And most important thing is it's timing -- Can we believe that these orders to make visa bulletin come from none less than some big political clout to suppress / divide the cry of legal immigrants?
This confirms unless we get major reform for addressing backlog, all this idea of making 485 current is eyewash and nothing but trap for exorting money out of legal immigrants every year to pay for USCIS funding.

all though I have a permanent job and valid h1 till 2012, with i140 cleared. I am planning to move back to india. I am all supportive for this law suit.

Please remember to ask your other H1B friends to sign up and convince them to contribute. One person can only contribute so much but one can always ask co-workers and friends to sign up. Even those who are in their 2nd or 3rd year of H1 and have just started GC should be considered as people who will benefit from this effort. They may not realize it now, but sooner or later they would.
Download the flyer from "Resources" menu and spend an afternoon outside local indian temple or indian grocery store. Ask people to take a copy and politely say "this is for information...I am not selling you anything" -- so that they dont discard it away and at least read it. Many of people either dont know about retrogression or dont know about immigration voice that is acting to curb retrogression and labor backlogs. Out of 500,000, if we can reach 10%, its still 50,000. With 50,000 members, the possibilites of what we can achieve is sending 10,000 volts thru my spine.
