Thanks for sharing your experiences. Is LLC corp employer eligible to do H-1 transfer? I have an American citizen friend who has a LLC corp and work as an independent contractor. Can he file for my H-1 transfer and can I work for him?
His annual income is about 150 to 200K. I think he takes about 100K as salary and rest as company profit.
I have my 140 approved and 485 pending (>180 days).
Any potential risks with this approach?

I read in one of the posts in here that for case being sent to California, the EAD and AP are being cleared much faster than other service centers...

. After 180 days you may leave, but you will have to find a new employer who is willing to hire you on permanent basis upon getting you GC for same/similar job as in the LC. What you do until your GC is approved (contract job with this employer or something else) is a different matter. Those employments can be on EAD, H1, temp/permanent, etc.
What if the job i'm moving to after 180 days is hiring me permanently now itself? Do they still have to specify (in EVL for AC21) that they will hire me perm only upon getting GC?

Guysssssss N Gals , I got it (I-485 approval) 10 minutes ago!!!!!!!!!!! NO RFE. Recent Luds were on I-140 / I-129 / I-131 ( Luds occered on 10/29 & 11/4) . Been in USA (F1, H1) since Aug 1997.

The worldwide level for annual employment-based preference immigrants is 140,000. Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620. The dependent area limit is set at 2%, or 7,320.
Given this is legislation, I don't think rule changes can trump it. I don't believe per country limits will change. Besides, how is that a solution to anything? This is not an Indian or Chinese issue. It's a legal immigrant issue.

This is encouraging. chandu, I read somewhere (mostly on murhty) that CIS will be publishing new AC21 soon and it is expected to be more stricter. Is this just the speculation or any other indications are received?? any idea? I am afraid that what will happen to people who already have used AC21 by following what currently exists???????

The fact that the National Governors Association has also endorsed "Comprehensive" reform (besides the RNC last month) strengthens the case..
What is more important for us is that they also endorsed funding for the EB immigration system. See the highlighted portion below...

Huntsman, a Republican who is proposing the resolution with Arizona's Democratic Gov. Janet Napolitano at a meeting of the Western Governor's Association, is calling for legislation to "protect and preserve the safety and interests" of the United States while also recognizing the need for "Western industries to have a stable and legal supply of workers," according to a release provided in advance of the meeting.
"Our states are on the front lines of a tidal wave of illegal immigration," Huntsman says in the release. "The debate in Washington has been polarizing and unhealthy, and we are asking the administration and Congress to adopt this bipartisan framework and recommendations agreed to by the Western Governors' Association."
Immigration has been one of the top issues of the National Governors Association as state leaders huddle in Washington.
While Congress has passed one immigration bill, there have been calls for more stringent and more comprehensive legislation from several sides of the immigration debate.
And increasingly, states are leading the charge, with Arizona and New Mexico both declaring states of emergency because of the influx of illegal immigrants.
"Governors feel they have to get into this debate because of the lack of action on the federal level in the first place," says Kirk Jowers, director of the University of Utah's Hinckley Institute of Politics, "and this issue so impacts the governors at the state level that they've decided they need to be a catalyst for this reform."
The proposal by Huntsman and Napolitano also calls for the U.S. leaders to work with Mexican and Latin American governments to "generate economic growth, improve the standard of living and promote ownership" in those countries as a way to stem the tide of immigration to the United States. Immigration was among the topics President Bush touched on during a Monday morning meeting with governors - possibly in anticipation of today's policy proposal, Huntsman said.

Based on what I heard(my experience too), if your attorney submits your I485 along with EAD and AP, you don't get a FP on the EAD card. When you apply for EAD online, then you will do a FP based on the FP notice that you will get later.
To activate EAD, you need to go to SSN office and apply for new SSN and once you get your new SSN, you are all set.
This is only my experience. For expert advice, always check with a qualified attorney
My wife will be on H1(currently on H4) october onwards...we received our EAD's yesterday. Can I still go and apply for SSN? I mean will that mean she is on EAD and H1 no longer valid?

Okay. I was able to talk to my attorney just a few minutes ago. He said, to do interfiling , you do not need to have PD current based on new I-140 as this is just a case update with new 140 information. He said that in any case, your 485 will be picked based on PD. I found him very very confident when he was telling me all this info to me.
Question - the PD is never mentioned on the 485, it comes from the the underlying I140. So this leads me to understand that they'll interfile the I140 with the pending I485 even if our PD isn't current. Hmm...this conflicts with the info posted on www.immigration-law.com.
