07/08/07 2:45 PM EST : FOX News interviewed the attorney who filed the first suit on the Visa date fiasco on behalf of a Polish woman in the Chicago area. The anchor started off the interview by making a reference to "hi tech workers" and that some of these folks were in the British terror plot !! "Why are you filing the lawsuit when your client can apply for the GC in Oct?" !!Anyway, the attorney was quite articulate in explaining the issue. Guess who followed the attorney ... Rep Tom Tancredo who called this a "minor inconvenience" before stating he wants all immigration to be halted!!

Lost in the big hoopla of 1 yr jump and hopes of similar advancement for others in May VB are the following facts.
1. USCIS is about to raise fees for all immigration related procedures beginning from June 1st
2. Visa quota ends in September and it takes on an average of 4-6 months to process I-485.
Let me detail 2nd step. If they move dates forward by say 1 yr and thousands become eligible for 485. They will accept those cases, get fees from those lucky souls and make the dates unavailable after 1-2 months. Remember last year they were moving dates by 6 months till they made it UNAVILABLE for August and September.
In that case, at least you will have your EAD and AP and can change your blood sucking deshi consulting company after 180 days and can peruse better employment opportunities.

Get one thing done is better than spreading limited resources on multiple topics. To increase immigration quotas is not achievable before presidential election is done.
Why not just focus on getting name check delay solved. It is under congress scrutiny already, all need are to add more oil to the fire.

I am in May 2003 EB3I boat. My employer is now trying to file my case in EB2. I have a master degree and 5 yrs experience prior to my EB3 filing in May 2003. The questions is regarding what to file and cost.
Do we need to file 1. PERM 2. I140 3. I485 all over again ? If so here are the fee for each step 1. 2750 2. 475 (1250) 3. 1010 each(2000 for applicant and spouse. The ones in () are legal fees. Is this sound reasonable ?
Your employer will have to file a PERM and I-140 and once I-140 is approved in EB-2 with earlier EB-3 PD, request USCIS to adjudicate your pending I-1485 using the newly approved EB-2 I-140. No need to file another I-485 if you already have one pending.
Regarding the fee, there is no filing fee for PERM. All the costs are related to advertising and lawyer fee. I have no idea how much the fee for the whole process is or what attorney's charge as I have never paid anything for any of my immigration process so far (11 yrs in US). Technically, you are not supposed to pay anything, only employer should pick up the fee. You can pay the premium processing fee wherever applicable.

I guess my question stems from the comment above. Say if I do not get my GC and I wish to go back after 10 yrs is it possible to get my SS money back even if I am on H1 status?

I still don't get it. There are around 300k AOS applications now pending. Given that there are only 10k EB based green cards for India, and I am sure there are more applications than 10k for FY2008 and still Visa bulletin for Oct indicates a date of Apr 2004. Should it not be "U" for the entire FY2008?
how can it be U for whole of 2008? they have to atleast those 10K GCs to Indians and can only do so if the dates are not U.

I have the same question. Recapture bill can be added as an amendment. Is any of IV's provisions there in the bill?
No IV provision is in the bill.
For something to happen, each member needs to do their part by supporting this effort and taking part in action items. With so little support and initiative we cannot expect to match the kind of hard work DREAM act advocates have done.
If we need an amendment, we should be showing up for advocacy day or signing up for monthly contributions, volunteer our time, or doing any state chapter work by meeting local lawmaker offices regularly in groups. Dream Act folks have built a very strong network and advocacy effort that no politician can ignore. Go through the list of things they have been doing over the past few years and you can judge how much percentage we have as a community matched that effort. This is a reality and and ultimately it will be us that are responsible for no bill being passed in the last few years.
The community needs to do more than wasting time on the forums and trackers if they really want any bill to happen.

Online status does not change when they send FP notices.
There will be a change in LUD after you give FP.
Will they not update status when they send any FP notice? Even if one misses the letter, one will get an idea whether something happened or not. Or are you saying that they don't even change the status when they send FP notice and if it misses to reach us we never would be knowing at all??
Can anybody clarify whether they update at the online status system when they send FP notice. Otherwise there is some reason for a mild worry; still don't see any reason for the kind of anxiety people are having for not having FP.

In my earlier post, I dint mean to say that all Kinkos are bad, its just the particular one near me was not good enough. The photos were as if they were taken with a yellow filter on their lenses.
Sears did a very good job instead.
You can just tell them that you need photos for passport. They are the same requirements
Think it this way, your photo might be scanned by their machine to be printed on visa/notice. If the photo is not of good quality it might get pixelated after they scan.
So be your own judge, think if you were in USCIS shoes and had to scan a photo and produce it on visa/stamp. They might also use some image recognition softwares for which they require exact speicifications.
In my case the yellow tinge I got from kinkos exactly matches with the improper color on the website below. So i had to go for other option

As per the memo if the I-140 petition was approvable at the time of filing, one should be fine even if employer tries to withdraw unapproved I-140.
If there is an RFE, then sure things are messy if employer does not cooperate.
If you try to use AC21 without an approved I-140 your employer can withdraw the I-140 petition ( since it is not approved yet ) . So best wait a few months until it is approved and then merrily go the AC21 way

By the way, AILA reports the bill numbers for the Dream Act as follows (the bills were introduced in both house and senate)...S. 774 and H.R. 1275...it doesn't mention anything about being below 30, z visas, or being undocumented...!!!

The meeting with Rep. Pete Stark's district director Jo Cazenave went very well. She had a little idea about, but was not fully aware of EB process for obtaining GC, and was impressed with our presentation that explained the process in graphical manner. Jo confirmed that Congressman Stark was against illegal immigration and also clarified that he was all in for high tech legal immigration. She listened attentively and took notes. She showed more interest in knowing facts about provisions of S.2454 and Spector's mark up that would reverse provisions of AC21 and Sen. Fienstein's amendments to these proposed bills. She repeatedly reminded me to make sure to forward more details on these after the meeting. I've sent her these details in the 'Thank you' email after the meeting. As it has been the case with outcome of other lawmaker staff's meetings, she suggested that we agressively meet with as many lawmakers as possible - especially in DC, seek support of big companies who hire EB workers and encourage people to contact their congress reps in case of unacceptable administrative delays. Jo has extended her invitation to members of IV to attend Rep. Stark's town meetings. (The next one to be held on 1st Apr'06 in Newark - details on http://www.house.gov/stark/contact/townmeeting.htm ). She asked my personal experience with the GC Processing and how it has impacted me.
