I know that if you don't have H1 stamping you need AP to reenter. But if you have AP why do you need H1 stamping if you are working for the same H1 employer after reentery? Is H1 stamping a backup to AP?
Some people want to maintain H1B even after AP is approved, just so that they can bring their dependents. But its also nice to have AP in case your H1B visa is rejected.

Good question - based on what I am reading on this forum, it seems to me like the RFE is requested for people who travel a lot in and out of the country. My wife has traveled a lot of times - I even lost track in the last 5 years - and she did tell me that they did not take her I-94. It would be still attached to the passport and when she enters back - if the travel time was less than 20 days, the officer discarded her new I-94 and asked her to keep the old I-94 - in some cases, he/she would just take it during entry. This happens mostly when she travels to Mexico or South America. The evidence that was being requested is the dates of travel and type of visa used to enter the country with the required documented evidence on the passport (color copy).

I had sent an email to rags months before about this friend. He decided to become an expat and move to India while his GC still languishes in the labor stage. He is an engineering manager who works for one of the big oil service companies (Think of word association with the Vice President). He would have been invaluable to this country as the country tries to become more self-reliant in the energy sector. Instead, he now lives in India and services oil wells in Russia. How is that for loss of competitiveness (loss of his service as well as his tax money to other countries)!

One of ways in which you can make the lawmakers realize the seriousness of the issue of EB relief is by telling them about it in person. They meet tons of other people every day and hear about many issues that are just as important to the others who meet them. So to convince them of the urgency, IMHO, we all must go to their offices and talk to them. That requires you to take some time off from your schedule. Many of us have already met lawmakers. Join your local chapter.
Can we have
1) links and pointers to background material and other things we could study, so that we are on the same page, and can educate ourselves on what to ask lawmakers/public
2) a presentation/paper, so that we have the same, the best, and the most presentable message.
If this already exists, and I just haven't found it yet, I apologize....

if you are on EAD and they pay you...you will have to declare it on your taxes...so you will have to pay upwards of 33% tax on it...which is far far more than the 4% charge currently

There is no such thing as a cooperative employer in this economy. I will give you an example, recently in my wife's company they had advertised for a genuine job and on the first day they recieved 200 applications!!!!!!!!!!!!!!!!!!!!!!!!. The hr after one week has not been able to review just the first day responses. because of situation like this no company is willing to even file for eb3 labor leave alone eb2. Because they cannot justify a perm labor when they are recieving dozens if not hundreds of resumes. It is because of situations like this that labor department is becoming stricter and stricter by the day. The post below seems to suggest even if you get audited you will get approved in 1.5 to 2 years. In this environment where unemployment is rampant there is very little chance of success in getting perm approval even in eb3 so dont be under any illusion that no matter what perm would be approved. It will not be approved under current market conditions because of hundres of resumes to perm advertisemsnts. it is because of this reason that a vast majority of companies have decided not to sponsor green cards. there is no such thing as a "coperative employer" in this economic conditions. Companies are being forced to send employees away from US because there 6 years of h1 are comming to an end and they are not able to file green card in this economic conditions.
OP - If you have a cooperative employer, I would say go for it. Given the rate at which EB2-I is progressing, you will get GC much sooner although the PERM process for EB2 may take a long time. Assuming you get an audit on your PERM, even if the entire process takes 1.5 years, you can get your 140 in PP and once your PD is ported, you are current. Even if the entire process takes 2 years (worst case), it's worth the effort. EB3-I will move at a very slow pace. As others suggested, you wont see significant movement till EB2-I is current.
Financially, the porting would make a lot of sense too. Assuming a family of 2, you are spending close to $1000 (or even more) per year on the AP and EAD renewals, not to mention the employer's cost of renewing the H1. When you go to your HR for starting the EB2 process, you want to put it in terms of how it's financially viable for the company. When you do the math, it's a win win for both the employer and the employee in the long run if you get the GC earlier.

Why are you even working for such a company? You should be with a company that values your contribution and wants to keep you and cares for you, similarly you should accept GC processing from a company that you are comfortable working with.

The status of my Travel document on USCIS site has been following for a while -:
Application Type: I131, APPLICATION FOR USCIS TRAVEL DOCUMENT
Current Status: Document mailed to applicant.
On September 20, 2007 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.
How long does it take for it to actually arrive??? Any idea??

Also, received original 485 receipt notices from my Attoreny and it does say RD is July 2, 2007, which is good.
My case has successfully reached at NSC and have not seen any LUD after that. Still waiting for FP notices so that I can consider that everything is good with my case at NSC..

I found the EAD v/s H1B article quite informative, articulate and really eye-opening. I dont see any issues with posting links to other immigration sites, PROVIDED those links are not simply marketing links and DO actually provide good immigration-related info. Some of the stuff he has written makes a lot of sense and Ron is not taking the same stance everyone else takes where they advise people to stay on H1B status to keep milking them for attorney fees.

Check if your in-laws pass the substantial presence test - http://www.irs.gov/businesses/small/international/article/0,,id=96352,00.html
If they do, your chances of claiming them should be 100% for any year they pass that test for (if they do not have significant income abroad, and are not claimed by anyone else as dependents in the US. There are more details from IRS on this subject, if they have significant income abroad).
You can amend your taxes going back 3 years. So you can get a refund for earlier years as well.
When your in-laws are in the US, get them to apply for an ITIN

Wait 6 weeks to get their ITINs (which I am doing right now with my parents' application)
