Got the approval notice today :) "Welcome to the United States of America" - ironically i have been in this country for a decade now! finally the "welcome" :)
It has been a very long journey!!! and a very frustrating one for the last few years... but the feeling that I now get is really liberating... first thing I did was thanked God for ending the seemingly endless wait that me and my wife (she didn't care as much) were in.
I'm already thinking of the things I want to do after this new found liberation... it includes showing the middle finger to those who have taken undue advantage of my status :cool: :D and i'm not taking it anymore... I'll be a new person starting Monday!
Just so there is no confusion... my PD was Feb 2003 EB3 but my wife's PD was EB2 April 2004... we got our freedom through her application. If anyone needs more info on how/what/when - i can share that (it had its up's and downs - mainly downs, but all's well that ends well)!
Lastly as a token of my real support to the cause of IV I will be donating a small amount. I have donated in the past... I have participated in conversations in the past... I was not so active on other fronts but I truly believe in this organizations effort to help the community. And God willing each one of you will get this freedom soon! God Bless!

Given a choice (with comparable role and growth) I will be more inclined to spend few years (~5) in Europe, post MBA.
Was just trying to make sure if there was a easier way to maintain my GC, at the same time complete my studies in parallel.
Per all your suggestions, there are ways to walk that tightrope, but its not very straight forward...Also I am not looking into deferring my studies for a year..
Will go ahead with resignation...

In EB1, there is a category Aliens of Extraordinary Ability where you don't need employer sponsorship.

mhathi's listing of unknowns is right it makes the analysis not useful. More importantly there is a 6 month missing period in the FY2005 data from Oct 2004 to Mar 2005. I have been searching for this as my case was filed in this period. The FLC data is maintained by some guy in Utah whom I emailed. He got back and said that data is not available as Backlog reduction centers were being setup and they havent entered those 6 months into the dataset. I expect that there was a surge in applications in those 6 months before PERM came into existance. So without that data the analysis is pointless.

i believe that the unity among indians in UK is far greater than that of indians here in USA.
On my last trip to london I had a brief glimpse at the clout of Indian community there, they are very strong and united to make their voices heard, no doubt Tony Blair acknowledged.
I have almost decided to let my american dream rest in peace, now I am looking at immigrating to Canada, in my last 5 years of study about canadian society , i have noticed it to very liberal and many of my friends both indians and americans who settled there have settled for life, many of them work across border in USA either in detroit or in seattle but they are not interested in moving their homes here. So I think i can pursue my dream of free world and enterpreneurship from there.
H1b status and pre GC status is a big quagmire of blackholes, I am not interested in putting away 10 years of my life waiting for GC.

I am on H1B with I-485 Pending and i have layoff coming. I have Approved EAD but i haven't used it. How much time I have to find another job without loosing H1B Status?

You have not mentioned whether your I-140 is still pending.
If your I-140 was approved already, then you can use AC21 portability.
If both your I-140 & I-485 are pending and if you plan to use AC21, USCIS will process your GC as per the following guidelines contained in yates memo.

It's ridiculous how people start to bad mouth everything related to US once they get a PR from another country, especially Canada. It�s like kicking off the same ladder that you used for climbing.
1. You gained entry into US with the �toilet paper�.
2. The �toilet paper� allowed you stay legally in this country.
3. The legal stay enabled you to apply for Canadian PR from Canadian Consulate General in Buffalo where the processing time is less than 2 years.
4. The legal stay enabled you to earn sufficient funds which you showed as proof of funds in your application papers.
5. The legal stay enabled you to get police clearance certificates from FBI and also from your country�s consulate in US.
Now let�s say you didn�t have this �toilet paper� and applied for Canadian PR for India.
1) You would only be eligible to apply from Canadian Consulate General in NewDelhi where the processing time is more than 5 years.
2) If you are from a middle class background, then you would have a hard time in providing the proof of funds for a family of 4, with your earnings from India.
3) You would have to grease the palms of police to get police clearance certificates and they are gonna take their own sweet time to provide you these documents.
Now be thankful that you got away from all these with the �toilet paper�. And remember that you are leaving to Canada not because of your love for the country, but because you didn�t get your US GC on time. Sour grapes, huh?

IV shoudl push for this legislation.
This is interesting, and if the DV system is taken out, it will help many in the eb category. This is good, hopefully it will come to a vote.
The only way to make sure it comes up for vote, is if we talk about its benefits and benefits of such other bills to our congressmen/women.

What is the phone number you are calling USCIS on? Can they give you a receipt number without the checks being encashed if your I-140 was approved at the same service center?

In my case, my lawyer has issued the check and I don't have access to it. He handles thousands of cases and cannot check check cashing status for each one just for receipting. So, I decided to call since I have some travel planned and wanted to predict if I'm going to get the receipts before that.

(1)I agree that the non availability has to be from the place of jurisdiction of birth, but how about the letter from the registrar of muncipal office does this also need to be from the place of birth or it can be from the city the parents are presently residing.

We should file 485 but lets keep our eyes on this and start action as soon as we know what is going on. Filing 485 will not gain you much if they add some amendment which nullifies EAD extention or something like this.

You may belittle it by calling it a joke but to me it is critical because this issue may turn into a trade issue. Call for negotiating a comprehensive services agreement is not mundane. Together with rejection of billions of dollars worth Us defense deal, this is seriously moving towards becoming a significant issue. You may want to dot the is and cross the ts but that is not how the Law makers, Senators US or Indians think about these issues. They are at 30K feet level looking at the Forest while we waste time in just going around our own trees.
To me the intent is more important than the content in the early stages. We will get to details once there is broad agreement on the issue, that is basic negotiation 101.
