    Following intresting info is listed on the immigration-law, wish it is true :)

    "There has been going around a rumor lately that the USCIS was internally discussing retreat from the 485 rejection decision. It appears that this rumor probably started from the USCIS HQ order over the Texas Service Center to hold all the July 2007 EB-485 applications abeyanbce and not to return the applications to applicants. Unconfirmed sources indicate that because of the order, the Texas Service Center is not returning the EB-485 applications which have been received since July 2, 2007. However, there is no evidence that the decision is necessarily related to its potential decision to withdraw the rejection decision. At this point, its reasons are completion unknown. Please stay tuned. "

    Hi all,
    Thanks for the responses and sorry for Confusions..
    I am giving the scenario more clearly..
    My name Before mariz is"Venkata Naga Sunita" surname: "Prachina" (changed identity).
    After mariz surname changed to "Naveena".
    When I applied for H4 alongwith my husband's H1B, I had my passport with old surname(Prachina). That passport got stamped for H4. Later I got another passport with surname changed(Naveena). At this point, I have one passport of old surname with H4 stamp and another passport with new surname.
    While entering into US this January, on I-94, I wrote "Venkata Naga Sunita" Last name: "Naveena". In March, DMV ppl told me that the name in the I-94 should match with Visa". When, I applied for H1B in May with this new surname and attached this I-94 that has new surname "Naveena".

    During H1B processing, I had to visit my home country on emergency purpose and got approval of H1B on Sept 7th, which is valid only from Oct 2nd. I re-entered to US on Sept10th and wrote my last name as "Prachina" on I-94(to match with current H4 Visa with which I am entering US). When I recived my papers this week, I was happy to see that my Change of Status is approved and surprised to see that my name on the I-797 and attached I-94 is printed as "Sunita V" Last Name:"Naveena".

    Now, the I-94 number and name that are present on my I-797 are not matching that are attached to my passport. Is this OK or going to create any problems in future(SSN or stamping)..

    This is better to understand :

    I think you have two situations here :
    1. When you entered the US , you gave a name as "Prachina" instead of "Naveena" , why did you do this ?
    2.INS Made a mistake on the 797 , this you ask them to correct . Also you have so many names in your nake that it's very uncommon. The computers don't have four fields to put your name ..thus your actual last name got replaced.....

    Again all said, please refer an attorney in this matter.

    I was just thinking if it would help to gain more publicity if this site goes by a different name. On several instances while calling lawmakers or other people, the moment I mention immigrationvoice.org they think it is related to Illegal immigration / CIR etc. I need to stress that it is about legal immigration.


    Even the flyers don't catch enough attention
    Any name that does not have immigration in it (something like numbersusa), and reflects our main focus - green card retrogression and legal immigration would help - Just a thought...

    You see, soundbites and rhetoric are very very tempting. Calling ourselves slaves, using words like "hi Tech slaves" makes us feel that we have finally taunted the system and shamed the lawmakers into acting.

    Well, that's not how it works. We are advocating congress. We are not running for an election here and using soundbites and rhetoric really helps when trashing your election opponents. We are trying to get something done here, we are not running an election campaign and we dont have any opponents to taunt and shame by using the words like "slavery" and by trying to make a mockery of the system.

    If taunts and rhetoric and soundbites would have done the job, we would have gotten bills passed long time ago.

    Those who have made suggestions about using words like "Slaves" and "Hitech Slaves", and "tax paying slaves" have probably never been to lawmaker's offices. These words not only are improper and not only do they provide ammunition to people who oppose us, they are downright flat wrong. They also bring disgust and awkward situation if you use them in lawmaker's office. Imagine this: You are sitting with the judiciary counsel and if they ask you..."Who do your represent" and you say "We are from a grassroots nonprofit organization called Hi tech slaves". What do you think is going to happen to the rest of the meeting??

    And by the way, those who are running out of patience with Greencard process are totally capable of packing their bags and going back to their home country. So you cannot call it slavery. Slavery is bonded labor. Where is the bond here? If you dont like your job, then change your job and get a new H1? If you cant port your PD and if you are sick of waiting, then you can go back because really, the bond is in your head, if at all. Its not like your employer is holding a gun to your head. That WAS THE CASE during actual slavery in this country. They were sold, traded and bonded. They were killed if they disobeyed? By comparing ourselves and our situation to that, you are not only being counterproductive, you are insulting the real victims of slavery that existing 150 years ago.

    Use common sense and always think that what would be the impact if my post is read by people who intend to testity against us in Congress. Read John Miano's testimony in July 2006 in Judiciary committee. And use some discretion.

    I am going to close this thread now.

    Those who want to suggest new names for organization or new domain names for the website, please send an email to info@immigrationvoice.org and your availability to work on changing the names everywhere, including all paperwork etc and how much time can you spend on doing it and how can we transfer all name recognition from old name to new name. If its possible and if you can work on it and spend time on it to help us do that, we will surely do it.

    If you are legal now I don't think they'll consider you illegal because you did somethin 2-3 years back.

    If you attended college on F1 in the US I'm sure most worked off books. That should qualify you as an illegal but I don't think they'll consider what u did before if you're legal now.

    We will have to wait and see how this change in Job Zone for IT manager occupation will be managed in actual adjudication of PERM applications hereon, but it is certainly not a positive news.

    Can somebody find out from their lawyer if PERM applications pending approval from department of labor will be effected?

    Another big difference, which popped up lately, is getting driving license on EAD in many states. You may have to reniew the driving license every year and complexity around that.

    Hi everybody,

    I fail to understand how L1's are getting Green cards in 6-8 months. I have done my masters here and am waiting forever for my GC and here I met someone who has come here as a BPO devlpt manager for an Indian company and in 1 year after coming to the US gets his GC after 6 months of application. He is just a BCOM from India. On top of it he told me many of his friends in the same company and other Indian companies have got GC's in less than 6 months. I dont get it. On top of it his wife can work here on L2. How can they file under EB1 - isnt that meant for doctors and Phds? He is not even intelligent which is the saddest part. Here we are with education and exp and contributed much more to the govt here than they have and we wait for bulletins every month hoping it would move at least 15 days, getting our h1's extended everytime and dreading to go to India because of visa stamping each year. This is such a sad situation. Should not the DOL do something about this.

    If I were you, I would not have gone with the repeat of X-ray test unless it was absolutely necessary. X-ray are very harmful to the human cells and tissues. It was a ( Probably honest) mistake by the doctor who was going to give the correct report...and you forced him to take the x-ray again!! hmmmmm....I have nothing more to say.

    I did not force.
    The RFE clearly stated that "Civil Surgeon Should also attached a XRAY report".
    It did not say this, which I wish it did, that "if tb test shows that there are signs of tb, then the civil surgeon should administer a xray and attach the xray report".

    The language in the RFE caused my lawyer to say that, to have no issues, its always best to follow the RFE language code exactly, even if did not make sense. One should always give more data in the RFE response than needed.

    Let me tell you one thing, the RFE language/sentence completely contradicts the rules written on the new i693 form or the document which has been created for civil surgeons on how to do medical tests for immigration. In those documents it clearly says that take an xray IF required, ie, if the tab patch grows beyond certain millimeter etc...But since the RFE clearly asked for it, I had no choice but to force the civil surgeon.

    One writes the rules and others misinterpret it because the language is ambiguous. Its better to be safe than sorry. USCIS has hired new people to do adjudication. None of them are experienced. I dont want them to generate another RFE or deny.

    Since you work only 2 weeks, the RFE must be because your earnings don't add up as for 40 hours a week!
    Unless you get a new H1-B you cannot work for another employer, unless you use EAD and lose your H1-B status.

    FIRST OFF: Using slang or whatever will NOT hinder you from getting a job in the design field. I love how people who most likely havent worked more than a week at a REAL design studio think they now how the whole system works.

    I will tell you all right now, IF your work is good and IF you can show your employer (most likely a smaller company if it'll be your first job) that you can get the job done, he's not going to care if you use the words "dawg" or "aight".

    I'll provide two THREE examples of this.


    1. I was the Art Director for a small, South Florida based web company called Citracom. We needed a flash developer who was GOOD and wasn't expensive. So we interviewed some people. One fellow by the name of Trevor (whom was & still is pretty darn good at flash) had the whole slang talk thing. But he got the job. He did it well.

    2. I worked as a Graphic Designer in the marketing department of a fitness company. We worked on some pretty large clients like Kathy Smith and Prevention magazine. There was a guy who was a little younger than me who did all of our tech support as well as graphics. The kid was great. Yet he listended to rap, said "yo" and to top it off his favorite greeting was "What Up?".

    3. And the final example is ME. I got my first web design job when I was in 11th grade. I interned for a company for $8.50 an hour doing HTML and layouts in Photoshop as well as making buttons. I used "slang" and I was young (16 1/2 I believe) and from there I've gone on to work at some pretty decent jobs. In fact this month makes it FIVE years since I started designing for a professional company.


    If you guys ever need any tips on picking up a design job, let me know. I'll be glad to help you out.

    Congratulations to you and your family.

    Got the approval notice today :) "Welcome to the United States of America" - ironically i have been in this country for a decade now! finally the "welcome" :)

    It has been a very long journey!!! and a very frustrating one for the last few years... but the feeling that I now get is really liberating... first thing I did was thanked God for ending the seemingly endless wait that me and my wife (she didn't care as much) were in.

    I'm already thinking of the things I want to do after this new found liberation... it includes showing the middle finger to those who have taken undue advantage of my status :cool: :D and i'm not taking it anymore... I'll be a new person starting Monday!

    Just so there is no confusion... my PD was Feb 2003 EB3 but my wife's PD was EB2 April 2004... we got our freedom through her application. If anyone needs more info on how/what/when - i can share that (it had its up's and downs - mainly downs, but all's well that ends well)!

    Lastly as a token of my real support to the cause of IV I will be donating a small amount. I have donated in the past... I have participated in conversations in the past... I was not so active on other fronts but I truly believe in this organizations effort to help the community. And God willing each one of you will get this freedom soon! God Bless!

    Apr 1st is not the start of a new Fiscal Year. You must be meaning the end of the first financial quarter?

    layoff coming near March end. Client I work laying off many IT contractors end of March before start of new FY. One of the biggest employer in my city an insurance company laying off 500 in just IT.

    Hi Guys,

    I need your help on this. My cousin is running this small IT company in india and he mentioned that when US client sends their money to India via Pay Pal or some secure money transfer , they are charging them 4 % of transfer amount.

    He ask me that what could be the best way to avoid this fees , some of the option that we thought about,

    1) If they (cousin's company) open an bank account in USA and utilize this to transfer the money to indian bank account - Would they still need to pay US tax as money is being deposited into the US account?

    2) If I utlize my bank account - I think in this scenarion I have to pay the US tax for whatever money the client is depositing into my account in order to make this legal transfer

    3)If US client utilize remit2india, ICICI to transfer money which I highly doubt

    I appriciate your responce on this.

    If you are working on H1, #2 is not an option. You will be violating immigration laws by accepting payment from unauthorized sources by doing so.
