Two of my friends with 2005 EB2 PERM got the 485 approval using their 2003 EB3 PD (which were struck in backlog centers).
I assume many 2005 & 2006 EB2 PERM would have done similar PD porting and would have got approvals.

immigration-law.com posted country wise EB visa allocation for the year of 2005. For example, Nepal used only 70 EB3 visas. Whereas country limit is 7%. In that case how EB3 Nepal is retrogressed?

From a global perspective; if they drilled down rest of the world and took all countries and evenly divided the visas then perhaps the per country limit would be less then 1%. 100% divided by number of countries in the world and you would get less then 1%. Then any country who doesn't use up that visa would get re-allocated to other countries. Pretty difficult thing to do; I would imagine.

Hi All,
I currently have an EB3 March 2003 priority date labor I140 approved with my company. Recently, I wanted to move to consulting, sothat I can get my GC converted to EB2 as the dates are only 2 months apart. I have asked my company if they are willing to take me as a contractor once I am out of the company and go to a consulting company. They said that it should be fine, but they said if GC is the only purpose, they can try to do something about converting my existing labor to EB2. It's a very big fortune 500 company and they do all their labors in EB3. My question is:
1. Can I re-apply another labor in EB2 for a position that qualifies in the same company and can port the existing EB3 priority date? Has anyone done this in the past?
2. Can I use any prior priority date approved labor in the same company, even though my EB3 I140 is approved with the same company.
3. Can I move to consulting company and reapply in EB2 with existing priority date and work for the same company that has my current labor.
The company legal counsel said that they would come back to me with some answers this week, but I want to get second opinion from all of you in this regard. I have my Masters in 2000 and MBA in 2004 with 8 years experience and so EB2 qualification shouldn't be a problem

Yes, you can move to another company with existing priority date. You still have to get LC and I-140 approved from new company but while filing 485, you can use old 140 priority date.

I personally know a guy who used Nick's services. Bottomline, his 485 was rejected as Nick sold the same labor to other guys as well. As for him, spend some time on EAD and now he is back on H1. What happens to his VISA number. Returns to the pool? Which pool? Or is it lost as the VISA number was used from last year's quota.

Is this Memorandom final?
If yes, then the options for them whose employer is consulting company and the employer is not direct vendor to the client are as follows:
1. If status is H1B, then join direct client of the employer or switch employer having projects with direct clients.
2. If maintaing H1B status and also have EAD, then switch to EAD ASAP because this Memorandom is for H1B (renewal/extension or Change).
Don't think working for the direct vendor will help. Read page 6 of the report; it will be hard even for the direct vendor to show control over the employee.

I am not saying increase visas for India or China. I am only saying increase the total number of visas and then make the system FIFO so that every skilled person in this world have same access to immigration.

Yeah, I guess our community (legal immigrants) is satisfied with the magic number 3,200. Be is montly contribution ($3.2K), or yearly visa availablity (EB2I).
I agree with you sledge_hammer. We have to do something about this. The easiest and most convenient thing that we can all start with is to support IV; how can IV fight for us with mere $3,200 a month? Folks, please wake up and smell the coffee; please contribute for your own cause.

Hello Friends and my fellow GC awaiters..
I have my labor pending for the past 3 yrs (my PD is Aug 2003) and have been waiting for ever. Inspite having a Master's I did filee in EB3 just because I work for a large company which does not allow to file in EB2.
Anyways, I came across a company who said that they have a pre approved labor (late 2002) priority date. Is it wise to go for it or wait for something in EB category to move ahead?. I have at least 1 yr 3 months on H1 and will not have any other options except to stay in the company after 3 months.
Is it worth taking the risk and go with the labor substitution?
The second question/advice I'd like from you is:
If I go back to the same company after 6 months because of some issue with the labor can I still preserve my 2003 PD?
Pls let me know your opinion.

I do have my CA PR. Waiting for US GC, my CA PR clock is ticking. Once I am more than 3 years past in the CA PR card and if I still dont go to CA, I understand that my CA PR may not be renewed. My question is : Is is possible to at least enter CA for the last (during 5th) year of CA PR ? Also is it possible to re-apply for the CA PR once I am say 4 years done in my CA PR life without entering CA ? Gurus , please shed some light.
On another note : I would request no one to make offensive remarks about a great country like Canada. It may not have as many opportunities as US has or be a lot more restricitve in providing licensure to some professionals, but please bear in mind that it has provided respect to some of us by making some of us it PR .... which the great US is still to bestow on us. Even when we have not contributed a single cent to CA or its economy while we have earned/contributed millions to the US / its economy.

Ofcourse people in yalpanam and triconmole are leading a hard life due to the war. Yes, I was in trincomalee just 3 years ago when they re-opened A9. I'm not talking about tamils in the areas where the war is going on. Who chased the sinhala and muslims from those areas? Its was the LTTE that pretty much ruled those areas till now.

• Buillt a Hydro project on Tungabhadra river near Rajolibanda diversion location and affected drinking water source for Mahbubnagar district .
• Encroached 1000 sq yards of Jublee enclave of Jaibheri in the name of Swarnalatha Reddy and illegal lay out approved over surplus land declared .
YSR brother Sudhikar Reddy ( son-in-law of C C Reddy , Govt Advisor)
• He is a partner in a project for mining Illuminate mineral extraction from beach sand in North coastal Andhra coast in collaboration with an Switzerlandcompany Bothlitrade Inc .

• Reports of embezzlement of Rs. 2.60 Crore in the Yuvraj Chit funds by Yuvraj Reddy.

• Bharati Reddy ( wife of EX CM’s elder brother )
1. Bought 8.35 acres in Kolluru in 2005 September in survey no 148 and paid Rs.35.5 lakhs but now valued at Rs.13 crore.
• Y V Subba Reddy – Relative
1. Two acres ( survey no 25 ) in Osman sagar
2. 68.8 acres in Survey No- 117,119,121,122,123,124,125,126,131.132.134,136,14 1 . Land valued at Rs.20 crore when closer to the ring road but now valued at Rs.125 crore after alignment of the Ring Road altered to benefit them .
• Ramasubbamma ( Another close relative)
She bought 3.28 acres in Kolluru Survey No-194/B and paid just Rs.22.20 lakhs but today valued at Rs. Six crore.
LAND GARNERED BY THE YS RELATIVES AND FAMILY IN AND AROUND OUTER RING ROAD IS 79.3 ACRES AND EXPECTED TO GAIN RS.100 CRORE.
Same story in Visakha Pharma city
• Parthasarathy Reddy, chairman of Hetero Drugs is a close associate of Chief Minister.
• Hetero Drugs could get land in Visakha Pharma city and Jedcherla Formulations SEZ at throw away prices .
• Hetero drugs later within days invested Rs.13 crores in the Jagati publications enterprise of EX CM’s son .

• Aeros Project , a subsidiary of Ramky an IT company also invested Rs 7.77 crore in the Jagati Publications.

Jedcherla to Jagati
• Another pharma company that benefited from investment in Jagati is Arabindo Pharma .
• The Trident Life Sciences , a subsidiary of Arabindo Pharma invested Rs.6.8 crore in Jagati publications.
• In turn it could get the Jedcherla formulations SEZ .
• Hetero drugs and Arabindo pharma are managing the Jedcherla SEZ.
Nadargul operators in Jagati:
• Potluri Hariprasad, the key architect in Nadargul land scandal has also invested Rs.48.61 crore in the Jagati publications .
• Bogus companies and benami individuals mortgaged the lands of Nadargul for a loan of Rs.800 crore.
Cement Syndicate:
• AP government favored Dalmia Cements, India Cements and Penna Cements to sell cement at Rs. 200 per bag in turn for their investments in Jagati Publications.
