Agreed - everyone, lets put this to rest.
I did not mean any offense to people who couldn't attend attend for valid reasons, more those that didn't care at all to help.

If there was more press coverage on the DC Rally i mean on TV it would bring the matter to the attention of more people. Someone suggested sending pizzas or roses to the media which I second.
If we can bring about a change so that current and future GC seekers don't suffer what scores have suffered till now we are bringing a positive change.

I agree with you, i think he is in deep s.... and the whole trying to type broken English thing is also fishy (in my opinion its on purpose)!
This guy has been in the country for more then 3 years (at least - based on his h1 being valid till 2011 which means recently extended)) on a work visa and cannot communicate a simple fact that they were fooling around and he didnt intend any harm (if that is the fact).... HE must be really really good at what he does at work for his company to keep him!
But to give the benefit of the doubt and innocent until proven guilty - I wish him luck!
I really hope i m wrong in judging you... and seriously I wish you all the best if you are being honest about the whole thing.
Thats what I noticed when i read his post first time....this broken English seems to be on purpose.....by the way r u from India terriblething?

[QUOTE=girishvar]I know Robinder Personally for a long time. He is Championing the cause of Ind0-US affairs with his headquarters in India. He is also the very senior columnist and well respected media person in Delhi. Being a Bachelor and previous personal assistant of Rajiv Gandhi, when he was a PM, he has never entered politics and very honest altruistic man. Calling him a fraud should be incorrect.
I smell that you are a paid poster of USINPAC. I am asking the adminstrator of the IV site to track your I.P address to see if this post is coming from some one at USINPAC.
I think IV would like to work with USINPAC provided that they truely believe in the cause of immigration reform. Seeing the P.R that comes out of them and the content of their site, they seem to be good at issuing PR's like USINPAC applauds xz, USINPAC supports xyz,USINPAC Photo gallery etc.. I mean grand standing from the side lines and then taking credit for (as some one mentioned here,) for the sun rising tomorrow morning. Don't take it personally but the content on their site is cheesy and points to cheap publicity. I am told that much of the lawmaker community and the media has come to realize this image of USINPAC in DC.
I do sincerely hope that they find direction regarding what issues they want to work for and where they want to take their organization. All the best.

Looks like the guy we engage for our cause gets a shot to speak about immigration on WSJ and guess what he forgets us all together. Great job for picking QGA core team.
I am just reposting my post from yesterday just so that the people on core can read my thoughts
Guys,
I dont mean to insult your intelligence, but who ever came up with ideas to ask, celebrities, a noble laurite and other accomplished folks from the immigration community to send faxes does not have the slightest plan on how to make this succeed.
If this is the kind of ideas the lobbyists QGA is giving us, may we need some fresh blood in helping us out. I completely agree eb3retro in working with AILA.org in helping us get our message across. PLEASE STOP THIS INSANE IDEA OF SENDING FAXES all the time either from members of IV or asking other people to do it on our behalf. We are hurting ourselves and dont even know it. As I have said in my earlier posts We need the Erin Brockovich of immigration to help us on this, and I am the AILA or similar organization can do this for us.
Good Luck.

Here is what people forget in this debate. They point out disadvantages of Canada over US. Fewer jobs, High taxes, extreme cold etc.
No doubt US is better than Canada for most people. That is why US is our first choice and Canada is backup - not the other way around.
We arent talking about people who have a choice here. If you had choice between US GC and Canadian PR we would always choose US blind folded.
But we are people without much choice. Yes we have choice to go back to India, and it may be a good choice for thoise who have come recently and have work exp in India. But some of us have spent 10 plus yrs in the US, have US degrees, never worked in India etc. For us it is extremely difficult to move back to India when we dont have a days work exp there. Ofcourse if you are SC/ST or OBC o reserved category your kids have great future there but not for other "normal" people.
So what other choice do we have. Well English speaking countries you can migrate to and who are taking people as PR's are:
1) CANADA
2) AUSTRALIA
3) NEW ZEALAND
4) SINGAPORE
5) UK.
UK is very difficult to go to as PR. The points required are extremely high. Unless you have MBA from top 10 school or make over 100 K it is difficult.
Singapore is a good option also, but cost of living is high and you can only apply for PR after working in Singapore for 3 plus yrs. Also Singapore is not a democracy.
New Zealand economy is 10 times worse than Canada
That leaves Australia and Canada. Well Canada is closer to US, but Australia has better weather. Canada is less racist but Australia has cricket :).
So bottom line is conduct this discussion as if US is not the option. If we could stay here with PR for sure we wouldnt even be having this discussion.

Thanks SGP. Did I read this correctly ? you switched in 9th yr of h1 ? was ur I-485 pending or did u have EAD to change ? I just have I-140 approved. so if I change to a new job now, can the new employer use this old I-140 for extensions ? can new employer ask USCIS to port old priority date ?

There were many I-485 applictions from EB2 ROW from 2005/2006/2007/2008 pending (some stuck in namecheck, some just filled in rack and some waiting an IO). All these applications where getting approved in 2009. Recent trend 2008/2009 I-485 EB2 ROW apps are getting approved (meaning not many old apps left).
Going forward EB2 India/China should see forward movement (and if i can esitimate right big numbers for year 2010 if recession continues).
It could be true that those ROW app will be around 22k so no cut off dates adn there will be very less spill this year. So really slowdown in economy helped them a lot. Next year if economy continue to be slow then it may help india lot. but not 100% it will clear backlog.
We need recapture to clear all backlog.

I think IV should work on filing a CLASS ACTION LAWSUIT for several reasons. Are we going to be coward legals waiting, for lazy folks at USCIS to undo the wrong they've done for so many years.
1. Blatant errors in the processing which has, destroyed , causing huge stress, trauma and what not to ppl waiting in limbo.
2. Inability to provide any insight on the basic timeline for any application. Look at the EB backlogs, they change there bulletin as if its a stock market, it can go forward or backward depending on the mood of the ppl working on any day.
3. Immigration is a burden on the legal immigrants, we pay for those ppl jobs. How can they offer such a sub-standard service, considering the hefty fees they charge from us.
4. The US constitution says " We the people", does not say "Legal Aliens" don't have any say or can't ask for justice.
5. We are legals, did not cross any border like those illegals, which this administration is so concerned about. We pay for services, not screw ups!
6. Lost EB visas for USCIS / DOS mis-handling.
7. Even if we loose the lawsuit, still we made our point. USCIS sucks! period
Ok now, i'm ready for all the red dots, who think that keeping quite will some how magically solve these problems. They need to be held accountable for what they've done.

This was class-action lawsuit by Rajeev Khanna. Anybody know what happened with it?

Dude, where's my green card?
By Salil Pradhan
While a fierce battle is raging over immigration reform for unskilled and undocumented workers, we the high-skilled, legal immigrants are struggling for employment-based permanent residency. The wait, intended by Congress to be one year or less, can now be up to 10 years in certain categories.
I am a high-skilled, educated, legal, tax-paying resident of Stillwater, having dual master's degrees from Oklahoma State University. My wife obtained a Ph.D. from OSU and works there as a post-doctoral research scientist. After filing a plethora of immigration forms, paying exorbitant fees and waiting almost 5 years, our permanent residency application process is still in a state of limbo with no end in sight. In the absence of permanent residency and the associated uncertainty, we have missed several opportunities of economic investment and scientific research.
People presume that since we are highly qualified and legal residents, it would be a matter of one to two years to obtain permanent residency. On the contrary, I, my wife and thousands of highly skilled, highly educated legal immigrant members of Immigration Voice ( www.immigrationvoice.org) are stuck in a bureaucratic mess that has shattered our American dreams, stagnated our careers and prevented us from realizing our true potential.
The U.S. employment-based green card process is in need of a major overhaul. Hundreds of thousands of applicants have been stuck in the three-stage green card process some since 1999. These highly skilled workers take up jobs for which qualified American citizens cannot be found. Though it's hard to imagine that a qualified American worker cannot be found for some high skilled jobs, there are several explanations for this disconnect.
More than 50 percent of American graduate degrees in science and engineering go to foreign students, a majority of whom continue to stay in the United States and work on H1-B visas. A shortage of American graduate students translates to a shortage of American workers in skilled positions such as chip design, materials science, microbiology or nursing. Also, qualified Americans may be unwilling to relocate to a particular location. This is especially true for physicians working in under-served areas.
Many misconceptions about H1-B visa holders have been propagated by largely anti-immigrant lobbies the most prominent being that they take away American jobs and are low-wage workers. The truth is that an H1-B visa holder can only be hired if a similarly qualified American citizen cannot be found. Also, the minimum H1-B wage, determined by the Department of Labor, cannot be less than that offered to an American worker in a similar job.
Another myth is that H1-B workers don't pay taxes. Be assured that all H1-B workers pay taxes equal to what American citizens pay, including Social Security and Medicare taxes.
If Congress passes S. 2691 and H.R. 5744, which Sen. John Cornyn, R-Texas, and Rep. John Shadegg, R-Ariz., have respectively introduced, America would undoubtedly become more competitive by ensuring availability of adequate high-skilled immigrants and by eliminating some of the red tape that plagues our legal immigration system.

my priority date is jan 2003.first ours was at TSC and then it was transferred to VSc and now it was transferred to TSC.
Take all the options available to you ( congressman, ombudsman, senator, calling USCIS and infopass appointment)
You may also ask your attorney to send a letter USCIS through AILA - liason office.
Best wishes, I hope you get your GC this time.

Applied for AP on June 1 at NSC. NO LUD changes till about last week.
I contacted USCIS and had an expedite request put in. Worked with USCIS ombudsman to figure out what was happening. Worked with my State Senator's office to put some heat on USCIS. After all the above efforts, finally got mine & My spouse's AP approved yesterday.(Oct 13). Total of 134 long days since i applied for my AP.
NSC is notorious for being late and lackadaiscal. I advice ppl to step in and take your cases to Ombudsman & Senators. They tend to be lot more helpful than USCIS. Good luck
How do I work with the Ombudsman? And all could you share how you went about getting the help from the Senators office.

So, what are the options for EB3-I? It appears that porting to EB2 will be more difficult moving forward due to difficulties in getting PERM approved especially for IT professions.
If the recapture of unused visas does happen, what is the estimate on how much EB3I would move?

Pappu no need to ask People to do something. We all, includiing me want others to do the work and we just want to make annonymous remarks blaming IV. We must admit that we really like doing this. :) The original poster Endlesswait came to the site and blamed IV for not doing anything and went away without doing anything. This dude AlbertPinto is just saying many times that IV is not doing anything but is not doing anything himself. You have asked him to do somehing, let us see if he really does something.
Like others, I will also not do anything and will be here to give my 2 cents. This is the easiest task we can all do. Isn't it?
