I see a lot of opposition for the bill from the news above and from others an optimism that bill might pass in Judiciary committe.
In Budget reconcilliation bill , it was thought , it was not a right place those amendments that would have relieved some of Retrogression be discussed.
I am wondering how will our issues (amendments that will relieve retrogression) be treated or happen what to them , when the passed bill will be discussed.
What do you guys think on Forum :)

It appears that this rumor probably started from the USCIS HQ order over the Texas Service Center to hold all the July 2007 EB-485 applications abeyanbce and not to return the applications to applicants. Unconfirmed sources indicate that because of the order, the Texas Service Center is not returning the EB-485 applications which have been received since July 2, 2007. If you did not file the AC21 paperwork, what triggered the RFE? Was it a new H-1B petition with the new company?
I was amazed when my HR called me today to let me know that they had no problem in signing the letter and immidiately after the call, faxed me the signed letter.

SO if USCIS wants to make a new rule of filing I485 for the one whose I 140 is cleared and priority date is not current, It CAN DO That RULE Right?
We do not need any Congress approval for that Right?
If so can we explore this option??
I agree with you. Why we don`t explore this option ???? USCIS make so many rule by itself then why they don`t make this rule to file 485 while PD is not current without going in Senate. Like they start premium processing of I-140. They make this rule without any bill in US Senate. correct me if I am wrong

Is there a conspiracy, first there was delays in the processing of the EADs, now there is delay in the production of the EAD cards...
Are there more RFEs happening too?
My EAD renewal took almost 90 days to get approved, and my employer was ready to let me go if I did not get the approval before my EAD expired. Just made it with 2 days to spare.

The admin would get an error report if there is a problem. the webfax is sent by a third party vendor who provides service to us. Last time, when we sent this webfax, we did get staff of senate office saying that "Those webfaxes kept on coming". That means that EVERYTHING we send, goes there. Numbers are important.
If 1000 members send it, each office will get 1000 faxes(although not all of them will make it in one day), but a few hundred faxes will make it in next few hours.
Please send this webfax and voice support for Sen. Brownback's Amendment.

I am also in same situation. Two 140s (eb2 and 3) both have same PD. Have beed trying for interfile from last one year. I do not know if my case is eb2 or still in eb3. I enquired from Congressman and she told me that my case is assigned to a IO on 6th Aug so its in eb2. She is not listening to anything else after telling me this information. I have infopass on 2nd Sep. lets see ...

My plan is making the following
Movie - A full length feature with characters that represent our life (includes H1 to GC process) in US with humor
Documentary - A professional documentary on our issues like H1 problems, GC backlog processing etc.
Any other thoughts from your side would help.
I am an ex NYFA student in digital film making. I would like to make the above two things by end of this year. Any of you are interested can participate. Again I don't need any money contributions. Just need your participation as actors, script writers and as other team members.

Since I140 petition is for future employment, it shouldn't matter that you were on F1 when it was filed. However, you may have a problem with adjustment of status. You may have to do consular processing if you are still on F1. But since you've changed to H1, I don't think it matters again. Could you consult an attorney or pose this question at the next attorney conference call?

I, personally, do not know anyone who lives in Canada and is complaning about jobs. Every beginning is difficult but for us who come to Canada from the US, I do not think the beginning would be difficult at all. Even with their famous Canadian exp only requirements....
Also, when you guys weigh in job prospects in Canada in comparison to being on H1 in the US, do you consider that your spouses would have a fair chance to at least re-start their careers or start their new careers, or do you think / know that your spouses will actually continue to stay at home?
In that case there is no difference between staying here or going there, right?

I can not convince my self about one would not get job forever. Few of my friends struggled for jobs for about six to ten months but then they actually got good jobs and that is even in industrail engineering area with indian experience.

I have called him for issues a number of times not related to AC21 and he answers all phone calls. In fact, I called him atleast 4 times before I actually handed him my case. RK on the other hand charges per second. I paid him 600$ for a 20 minute phone call and he did not tell me anything i did not already know....Rip off!!

My wife worked as a consultant for first half of 2008 with a desi employer as an employee (on W-2). After many calls and emails we received W-2 Thursday that has income and taxes of only first two months. Now he says that he showed remaining 4 months as his profit so he can only send 1099. Please advise if I can take any legal action against this employer.

There is an option in turbo tax, if you didnot receive the w-2 from employer you need to submit another form. So explore that one and will give you more information.
I guess if you are submitting that form, IRS will take care of your employer issue. Otherwise just call the Trubo Tax people if you are using them.

The reason why i anticipate much larger movements in the final months is due to the fact that India gets about 3 times more visas through fall-across/fall-down than what is alloted for just India.
