EB2 India will move very fast till 01 JAN 06 as because based on June 2007 bulletin, just before the july fiasco,( http://travel.state.gov/visa/frvi/bulletin/bulletin_3236.html ) the PD for China is 01 JAN 06. That means in EB2 Category except India and China every other country is current. So till India reaches 01 JAN 06 PD in EB2, all the spill overs will be moved to EB2 India. By the time India EB2 reaches 01 JAN 06, China PD in EB2 will move further from 01 JAN 06 by using its 7% quota. So Inidia PD for EB2 again moves fast till that changed China PD using the spill overs. After that India and China will share the spill overs based on the PD priority. All this happens if and only if the USCIS works effectively and uses all the available visa numbers for the present fiscal year. My prediction for EB2 India PD is it touch 2005 /even cross few months in 2005 by the end of this year if USCIS works effectively.

Loved them all but I was torn between eilsoe and kax. kax's shadows are what impressed me most, and if the castle was populated or had a little more color, I might have voted there, but I instead took to eilsoe's because of the people and captions ;) It also embodies more what I think of as 'pixel art', which is very straight or isometric, not to say those that werent wer bad because of that; in fact that gives a more impressive look and feel, but I needed some fun and eilsoe delivered. What shocked me most is that there were more people waiting in line at the mens bathrooms... hmm, guess its mostly guys there. :) The duck reflections were also a nice touch.

Call the regular USCIS customer support number and double check the details of the visit. If it is a genuine appointment, it could have been recorded in their system.
Also, you should talk to your Attorney to make sure such visits are legal.
Never heard of it before, strange things are happening nowadays.
BTW, is your employer a consulting firm? Do you think he could be in the visa fraud hit list?
I have one week from now for his visit. He gave me his desk number too. So I guess he is still an ICE employee. I did not call him at that number though.

It will also help if you could provide details on your labor certification category such as
section (203) (3) (i) or (ii) etc.. for skilled worker or professional. I believe You could also find this on your I-140 receipt notice..

I request everybody to add one line in the letter for Consular processing filers as they should be allowed to get AC21 and EAD facilities now. This law came earlier only for 485 filers because CP process was fast but now due to retrogession all CP filers are waiting for Years and in the worst sitauation as 485 filers are enjoying their freedom with AC21 and EAD

I know after we file the i-485 for 180 days, we can change our jobs. But rule is that the new job should be in the same field as the old one.

Anybody Travelled with only Advance Payrole through Frankfurt recently please post ?
where they will check for transit visa in usa while boarding or in frankfurt or in india while return ?
My nationality is Indian. Presently i am residing in USA . I have " Advance Payrole Document " . I am planning to travel in this February 2011 from " Atlanta -> Frankfurt -> India(Hyderabad) " and return is in May 2011 from " India(Hyderabad) -> Frankfurt -> Atlanta " in lufthansa airways.
So shall i go for this round trip with a valid " Advance Payrole Document " only ? or i need to have " Air Transit Visa ? If i need Air transit Visa could you please let me know how to apply and what documents i need to submit .

Urgency of getting a receipt is that once you get the receipt, it means that USCIS has 'accepted' your application and it will not be rejected for lack of initial evidence.

When you go for Fedex/USPS Express they takes your Name, Current Address in a page which has Pointer to the TRACKING NO. 1 copy comes to you , 1 copy goes out with Package and 1 Copy gets saved with FEDEX/USPS.
The 3rd copy above is sufficient to straightout any "Potential Liars" :mad:
If a lawyer is mailing the application and he probably is mailing hundreds of applications, he won't give the applicant's address in the USPS senders address. So there is no way to match a receipt to an applicant. Besides USCIS won't know what the contents of the package are.

Yes she can go alone. She will need her H4 approval notice as well as your H1B approval notice. Additionally since you have applied for AOS take them for good measure. My husband recently went for H4 stamping in London and they did not actually require the adjustment receipt notice but did take anyway with his documents.
I don't think she will have a H1 approval notice if she is coming to US first time.

Arent you concerned that if its approved on Oct 1, and you didnt get it, then where is it? Did you ask them as to why you havent gotten it in mail even though it has been approved a month ago? Also, did you check with your lawyer if he got anything?
It was approved on 10/1*/2007 not exactly on 10/1/2007. I was concerned and I asked her. What she told me is that once case is approved it generally takes around one week to get that mail out from mailroom and once it is out of mail room then generally it takes 2 weeks to get the mail for you. So calculating that I thought I should get that within a day or two. ANd another thing she told me is that once mail is out from USCIS mailroom then USCIS does not have any control or tracking mechanism so I do not have any choice other than waiting for mail...And yes I have just shooted an email to my lawyer. What do you advise?

everyone here on the call has historical record, honest to god. i have a good news, we r standing up for ourself, to tell this story of bypassing the american talent, and that’s what brighfuture jobs is about. that’s what durbin bill will do for us. there are couple of people who will focus on foreign citizens. two things (1.) they will hear from us, and (2.) whether we need guest workers at all, will be taken by afl-cio will pick up. but what we will do, we have absolute unique role to play, we will explain how the culture the bypass impacts us, and the culture of exploitation impacts us. we r the only once in the country who can tell this. there is going to be a discussion in beltway about “whether”, but american worker and american it professionals
no one said that - no foreign worker can come here – that’s not the message – it’s the bypass and exploitation.

don’t ever say – h1b is when a qualified american worker can not be found. we have to say that h1b law is about the bypass the american worker – the “discussion” will be about commission – anybody heard about that. the unions are setting commission whether or not we need guest workers – theoretically, and we will come up with the stories, boots on the gound, to show them the data the fuel, makes sense? they can have their tea and whatever stuff, and we will bring the bonfire.

we have to say that – there will not be an american and naturalized citizen, who say -that its ok to exploitation. there is deep deep discussion about who is an american. alf_cio has broken the opposition, but they r talking theoretically, and we r giving boots on the ground –
employers r not giving us the opportunity to compete – it’s the responsibility of federal govt that we are able to compete.
buddy – most of these jobs are it. someone in background in it can pick up even if there is new technology, but we r shut out by people with lower skills

donna - no, u can argue the cheap, that’s ok, but u cannot argue about losing the right to compete. americans love cheap labor, but we have to focus on americans not being able to compete, its not about low wages.

so if u want to argue about wages, that’s cool, u r telling people u’r competing for the job. but the focus has to be on the right to compete.

find an american who don’t think its ok to find the people to right to compete. we have not said this to the lawmakers. the moment we tell this to the lawmakers, they will be 100% on our side

i had a GC of a priority date 01-13-2003. Then my employer was kind enough to do one more simultaneous application with a date of 11-15-2004.
The attorney we were working with at that time exchanged the I140 between apps and he screwed up big time on my 2003. So we had to withdraw both my I140 approved 2003 application and the 11-15-2004.
Then we had to go back and apply for Perm and start the process again. I spent 5K and my employer about another 5K on 3 apps so far.
if it is fate on one side it was USCIS on the other, but god was on my side, and hence i am still in this country!!!!

Your logic is beyond me. On one hand you seem to disagree with the practice of labor substitution but on the other hand you are more than happy to provide the recipe for it. Are you for it or against it. Or may be you are just trying to help an IV member.
It may be legal but should be discouraged to say the least.
Other than that, you will find a lot of hatred from this forum as what you are doing is very much inflaming since you are cutting in line -- legally so -- but still, its cutting in line. So dont be surprised by that.

Condi Rice burshed the question about the DOS and USCIS fiasco. Bill CLinton has rightly said recently ..Law is minor obscacle for this administration.
