    Unless it was a felony that requires certain jail-time or something it's not always counted against you.. remember .. purpose is not to exclude shop-lifters.. they got plenty of those in Canada but rather identify and filter out security hazards.. you might need in person interview.. but it should be alright.. I know even US immigration allows folks like that.. so can't imagine Canada being more stringent..
    I guess, we will wait for any response on this front, fron the buffalo office..

    OP - If you have a cooperative employer, I would say go for it. Given the rate at which EB2-I is progressing, you will get GC much sooner although the PERM process for EB2 may take a long time. Assuming you get an audit on your PERM, even if the entire process takes 1.5 years, you can get your 140 in PP and once your PD is ported, you are current. Even if the entire process takes 2 years (worst case), it's worth the effort. EB3-I will move at a very slow pace. As others suggested, you wont see significant movement till EB2-I is current.

    Financially, the porting would make a lot of sense too. Assuming a family of 2, you are spending close to $1000 (or even more) per year on the AP and EAD renewals, not to mention the employer's cost of renewing the H1. When you go to your HR for starting the EB2 process, you want to put it in terms of how it's financially viable for the company. When you do the math, it's a win win for both the employer and the employee in the long run if you get the GC earlier.

    Same thing happened to mine. USCIS will pick up the packages from the USPS the next day so don't panic. Check for another status update tonight or Monday night, I'm 100% sure it'll say "delivered" then.

    I added this process:

    1. Senate Judiciary mark up and pass bill proposal
    2. Senate majority leader schedule floor discussion. If bill do not have support of more than 60% Senators, Motion of Cloture can not pass and bill may have indefinite discussion and amendments. It is important to have more than 60% member's support otherwise bill have no future. Senate Kennedy is trying to negotiate with both parties to have more than 60 senators in favor of bill.
    3. Senate Pass bill
    4. Step 1 to 3 are separately done at House
    5. If the language of bill passed by House and Senate is not same, it will go to House/Senate conference committee. It is in power jurisdiction of House and Senate leadership to appoint committee members and their schedule. Last year, House leadership didn't appoint committee for CIR.
    6. Conference committee will remove all inconsistency of the bill and approve bill with common language.
    7. Senate and House separately pass/fail conference approved bill with limited discussion and no amendments.
    8. If it pass by both House and Senate, President will sign it or use veto to the bill.

    Long way to go. it really need political will, blessing, and commitment to pass any bill.

    For a bill to become law...

    1. House has to pass it..
    2. Senate has to pass it..
    They might pass different versions..
    3. They have to resolve their differences through conference process.
    4. The conference report is approved by both houses..
    5. President signs it...

    Hi Experts,
    The question i've is:
    I heard from my Immigration Lawyer that,from November 01, 2008, any person who works in Information Technology (IT) and who has Advanced Degree from USA like Master's is eligible for EB3 Category only and not EB2 category. Please confirm if the above statement is true or not.

    Do not even think about going to Canada.

    No jobs....No jobs...

    You will be dissapointed after becomming one. They say that medical is free..
    "Yes" but a young man will not have many illnesses. Prescription is not free.
    You pay prescription.

    40% tax. Gas prices are high, very few jobs.
    I have many friends who have Canada PR and myself want to stay in the US.

    We have come to US to make money and get a good carrier.
    Canada does not do any of that.

    I second to CC123. I had G-28 on everything. I got the EAD and AP directly. However, I did not get any original receipt notices from USCIS. My lawyer got the all original receipt notices.

    In our case got EAD directly, but AP went to Lawyer.

    To all:
    I got my H1B stamping done for 8th year in Nov 2006. When I went to the officer, just before giving my application I told that I am a returning worker. He asked for the paystubs and I gave the original ones. He approved immediately.
    I took all the documents as listed in the website as well as the vfs site.

    Hope this info helps.

    I'm sorry if this question sounds trivial, what is LUD? My FP was done on Sep 19 and I checked the uscis website today using my i-485 receipt #. I don't see any update. Please let me know.

    You have to create an online account to get updates on you application. You will see LUD and there is the date everybody is looking for. You can also receive email if take the option.
    You will not see LUD if you just put in your recipt number to check status of the case.

    Folks,

    We have a Consulting Firm Run Professionally. Little about me, Have been in the country for past 12 Years. Came up the Ranks via Consulting Firm like many of you.

    Some Facts & Disclosure..

    I am not Here to Hire Folks, just to voice my Opinion. Something that People on H1b should hear from Employers View as well. There is lots of Information to go around, from Consultants, who been here for few years to new folks who come to USA. Mostly its just Bad news for the new comers... Welcome to Bload Sucking Desi Consulting Firm.. Welcome to New Jersey.. or where ever you may land.. You get the point.

    I am not here as Voice of Rest of Employers.. Just Pointing things out as I See it..


    OK.. here we go..

    Most of the employers, HATE doing Percentage bases. Give any employer a choice, between doing working on 70/30 or 80/20 or with a Stright Salary... 99% would be willing to work on Straight Salary Basis. Because that's what is Required by the Law. Simple as that.

    I do Agree that there are lot of employers, who don't pay on Bench. WE DO. Here is what has happened very recently with our employees.. Few of our Employees have QUIT because we refused to do % Basis & these are the guys who came 6 months ago on new H1b. I would understand the Senior Employees Who have been with us for say 2-3 years ask for % basis Pay.
    Now We are in a situation where we have Agree on % Basis Pay as a Company Wide Policy & then offer is to all our employees.. But that puts us on odd with Department of Labor. Which Madates every H1B employee to be on staight Salary basis.

    You tell us what are our Options.. Either we Fire/lose employees who want % Basis pay.. just because their peers are getting it (EVEN If it is ILLEGAL )

    We Don't Charge a Penny for a H1b, We foot the Bill.. Just as an Example we LOST 32,000 This year, just in Lawyer fees for H1b's not selected in the lottery.. I Know & Fully Understand that its a Cost of doing Business..
    Now, if we go on % Basis, our whole model changes... Because, There is Cost of Doing business, Managing Employees, Marketing, H1b, Greencard, Full Pay on Bench, & Last but not least Profit.

    So if i have put employees on % Basis, that means We as company are making Hardly anything. Which means, we have to charge new h1bs, for at-least Lawyer fees.. What if it does not get selected, what do we do. Refund the money, Then whats a point of taking the money in the first place.

    We WANT to pay on bench, because most people normally do find a project in 30-45 days, Provided they are Technically sound.
    With Percentage Basis, We can't do that.. Since the Employee has chosen to work on Hourly.. No Work No Pay.

    What should we do for Holidays .. Again No Work- No Pay..

    We have done the Calculations.. Believe me.. There is Hardly any Difference Between % Pay & Straight Salary if you account the following at the end of year...

    -- Medical & Dental Insurance.
    -- Expense of Relocation, Moving your Apt, Car & Staying in Hotel for a week before you find a place to crash
    -- No Bench Pay, No US Holiday Pay, No Sick Leave
    -- No Pay for Vacation, Unless you don't Believe in Vacation.
    -- No Green Card
    -- No H1b Extension.. You would have to foot the bill at the end of your 3 year term on H1b.

    When you account for the above.. you tell me..

    We don't want our employees to take the Above risk.. believe me I have try to make these guys understand & have reasoned with them.. Provided with Financial Calculations..

    What do (Some) of our employees see.... Just a Few Bucks more... Nothing else..


    So I am going to let you guys Answer this Question...

    Who is making us Going on the EVIL-DESI-Consulting-Path ?

    Maintaning F1 status while I-485 pending is not a clearly defined area by USCIS. There are some resources I provided in the following link. There is no definite answer for this.

    Why don't you contact some senator! You have been current for so long ..

    because USCIS is not even willing to talk if the Service center does not have processing dates current. And if my case is in California (which website says), then the processing dates are not current and have never been current and probably will not be current for a very long time. CSC does not process 485 applications at all.
