This is not 100% relevant to this thread but since we are discussing APs here, I thought I will ask the question.
Do we need AP to go to / come back from US Virgin Islands? I know that these islands are U.S. territories and should be nothing more than going from one U.S. state to another. The reason for my question is that the DOS website states that for travelling to USVI, the U.S. citizens should carry a Photo Id AND Birth Certificate to establish the U.S. citizenship. Many websites state the same thing and some sites mention that this is because of nearby British Virgin Islands. As you can just take a ferry and come from British islands to U.S. Islands, the Immigration authorities on Mainland need to check your immigration status. This is not the case for travel to Hawaii or Puerto Rico.

I think we should start a Employer Hall of shame and nominate employers who are either cheating the employees or the Immigration system.
This will help future employees and the immigration community as whole.

What a jerk your desi employer is. It makes me so angry that these scumbags are getting away doing these things.
First things first - deliver the baby. Take some of the suggestions given here by other members regarding insurance.
Once all this is done sue the hell out of your desi employer. There really isn't anything (I guess) you can do about your client. But you can definitely take your desi employer to court for terminating your employment. These guys deserve to pay a hefty fine and lose their business license!

Dude, I am telling you again. Expungement will not help him w.r.t immigration matters (which includes entering USA).
Even when he gets his criminal record expunged, for all immigration matters, he needs to provide information about his conviction and an explanation.
He need not to declrae at the POE unless he is asked for..

140 approved, 485 pending for more than 180 days, EAD/AP approved, and in hand.
Candidate leaves sponsoring employer and joins another employer (similar position/salary, etc.) New employer's attorneys send the AC21 letter and G-28 forms to the USCIS. The attorneys are very familiar with this, have handled lots of AC21 cases (Fragomen).
Is there any way the candidate can call USCIS customer service and ask for the attorney/representative's name on file, just to make sure that the G28 did get processed and the attorney name on file got changed from the old law firm to the new one? Would customer service share that information with the candidate?

Yes and no. It depends on the customer service representative or if you take infopass, it depends on the VO. You generally know when your Attorney files for G 28 because you actually sign the G 28. G 28 is like any other form like 485 or EAD or AP etc... so if your 485 and 140 and h1b everything gets filed properly why do you think g 28 does not get filed properly?
Try to be very pleasing and polite to a CS rep or a VO and try to get the info, they may let you know your Attorney on file.

I hope you get in time before your EAD expires. My EAD was expiring on 09/24 and my employer submitted on June 24 (no efiling) & RD dt June 24; Got my EAD approval email on 07/28 and card received on 08/01/2008; but renewed EAD runs from 7/30 - 7/29/2010; I did not mind the disappearance of 2 months. I am surprised...why IV is not raising this.. The fundamental issues of EB immigration wont' be solved until CIR happens and that could take forever. No one cares about immigration right now.. The only thing that can provide immediate relief for EB immigrants is if we express our desire to buy houses(unable to do so becoz of lack of GC).

Currently AILA is reporting that there are two bills pending for Employment-Visa Recapture.
1.Reuniting Families Act (S. 1085) Introduced in the Senate(*)
2. Senate Judiciary Committee to Hold a Hearing on the Uniting American Families Act(**)
Reference-(*)(**) www.aila.org/
The S.1085 in the US Senate caters to specifically recapturing visa numbers for employment based category; i.e. ALL lost visas from 1997-2007 in the employment based category.
Also to remember is that re-captured employment based visas can only be used in the employment category. They CANNOT be used; repeat CANNOT be used in the Family category; however the vice-versa is true; i.e. unused Family Visas can be used in the employment category as happened last year 2008.
The second bill Uniting American Families Act is in the US House. Though the intent of this bill is not the same as the senate bill S.1085 noted above; an amendment can be made to make it the same. Currently, they are scheduling a House hearing on 3rd. June, 2009 for that bill.
We need HIGH level of action on the above two bills from IV Core and the Community; because of two reasons-
1. Adminstration has CHANGED; so one cannot assume that things which happened in past years will be the same. i.e. No action will be taken by lawmakers on the Immigration front. Remember it is the Democrats and we are back in the good Clinton year politics (which passed AC-21).
2. We need our Green Cards soon. India is the ONLY nation where 80% of EB folks are waiting for two years or more after I-485 submission, given security checkas and pre-processing has already been made for applications pending for two years.

& please do keep us informed along the way. We may be able to be of assistance to you in some way or the other. Local IV chapters have access to local Congressmen etc.
If nothing works go kick the ass of the person who is responsible for your predicament. Interpret kick ass to more severe alternatives. Some companies are anyway taking advantage of people stuck in GC queue. On top of that if they harm us they need to pay a heavy price.

if microsoft wants job done.. hire locally.. or bring people on direct H1 so they net the taxes. or do the job overseas.
If Infosys brings people - do not let them work in CIsco, microsoft or, HP... that way they put overseas company OUT OF Business

Until this point of time, no one knows how USCIS or state is calculating the figures. So, lets wait and see the lottery results. Thats the only way to get the green card faster :)
