I got my I-140 Approved in 2007 and I-485 applied in July Fiasco. working for same employer who filed labor in PERM. Recently got letter from DHS stating that I485 denied as it was filed when dates are not current.
In july 2007, USCISreleased memo stating that they will accept all applications till August 17' 2007. Mine was reached on Aug 14'2007 well before deadline. Got I485 reciept in october 2007.
There are 2 dates on receipt. 1. Received Date (Aug 14) 2. Receipt Date (Oct 12 ' 2007).

I never saw him talking +ve about legal immgration, he is an anti-immigrant.
Attacking Lou Dobbs will help those who purposefully blur the distinction between legal and illegal immigrants. While Dobbs sometimes talks about H1Bs, his main focus is on illegal immigration and he's mostly sympathetic to legal immigration, in my opinion.

Thanks for the great analysis. One suggestion for USCIS. They need to make EB GC process a linear one, meaning that you file for labor, then I-140, and I-485 as soon as your first two stages are cleared. Concurrent filing process is a hit or miss. It doesn't make sense anymore when you've so much retrogression.

1. They will get constant flow of applications rather than all at once. Plus they can control it by regulating the flow of I-140 approvals.
2. They will be able to better predict the visa movement based on their inventory.
For people like me, it will be good for two reasons:
1. I'll enjoy similar EAD/AP benefits that most of the people enjoy who filed during July 07.
2. No more H1B stamping.

He sent me an email to pay $3500, do you think he will go legal for this, I did not sign any contract with him.
If he goes to court will i loose(he may create documents) or will i be in trouble if he wins the case.
Please suggest.

Yes. misrepresentation is risky and dangerous and no one is asking you to do it. All I am saying is don't submit information that weren't asked and expose yourself. For example if you only need to w2s for 2006 and 2007, don't submit 2004 w2s when you were paid less etc. IOs make the decision with the information provided to them and issue RFE only if the info is not sufficient or require clarification. In fact this is what even UnitedNations wrote in other forms.. i.e. don't pro-actively submit extra documentation.
Coming to my wifes case, apparently, according to company records she was their employee since the start of H1B approval, but they were reluctant to put her on project and payroll with out SSN. When we mentioned this, the company owner was very cooperative and in fact ready to give us any letter we ask in case of an RFE or any time we request.
Btw, do you honestly think I (or my attorney/assistent who filled the entire application for us based on the documents 'he asked us to provide' - We just signed it) don't know what you were saying about mis-representation?? Since our attorney asked for copy of every document 'specifically' as a bulleted list separately for both of us, we assumed that he would point out issues if there were any. :).

Lost in the big hoopla of 1 yr jump and hopes of similar advancement for others in May VB are the following facts.
1. USCIS is about to raise fees for all immigration related procedures beginning from June 1st
2. Visa quota ends in September and it takes on an average of 4-6 months to process I-485.

They will accept those cases, get fees from those lucky souls and make the dates unavailable after 1-2 months. For a consulting company ( unless it is some outsourcing company like Infosys), a company cannot produce the following info for a first time H1B candidate
A letter from the client company sponsoring the project and a copy of the contract between the U.S.-based petitioner and the client company, stating the timing, terms and agreement for your project.
Consulting companies exists for the reason that clients won't make an offer to the candidate unless he is already in US.
Before starting to blame consulting companies, ask yourself a question.
How many of you got a job offer from a US company ( non-consulting) when you were in India ?
Either you came to US through a consulting company or you were a student in US.
Per your logic if someone tries to stop/end bribing in India, you will question them saying-

How many of you bribed an entity to get your work done, or asked for bribe to do the work for someone?
What you are saying..about consulting companies not having a "job" at hand to offer is the mis-use of the Visa. This is the loop-hole that cause small time shops to jsut bring a lot of people onsite and then start sending resume arranging interviews etc....and then when this size increases they resort to means like not paying enough or providing them company guesthouse and kitchen + some money to buy grocery and few more buck but not the entire salary..... This is all how it started (the mis-use started)....and that is why consulates have imposed stricter checks.
It same with the foreclosure crisis...uptil now Bank gave loans (equivalent to visa) w/o complete and proper documentation..which cause ppl getting loands/home when they cannot afford it... now when this whole mess is identified..they want to implement strict enforcement of not giving No-Document, 0-Zero payment loans etc... and you are suggesting to ask people the same question - Have you received such loans in the past ..if yes then why object now... ?

It is that time again, the eager wait for the next month's Visa bulletin. It is almost like a monthly ritual for many.
Although there is no clear logic to the movements, there are folks in the line that hold some hope that this might be the one that will get them closer to the GC counter. (happens every month ! :p)
Since predicting VB dates is as close to pulling stuff out of thin air. My gaze in the crystal ball tells EB2-I and EB2-C to be the same: Feb 05 (hoping for a quarterly spill over in Jan 2010 :) )
As for Eb3 even the crystal ball turns foggy. I very much wish EB3-I sees some forward movement in the upcoming bulletin; may be at par with or at least close to ROW/China/Mex/Phil.

I think most of the money comes from businesses that employ these people to cut costs. We don't have any such resource. So I don't think IV not getting enough donations can be blamed on IV users.
I have donated as much as I can without getting my budget in jeopardy with all the mortgage , taxes, "health insurance " .medicare, car payments etc etc that we have to deal with.
Another point I think is that even if IV had a couple of million dollars I don't think it will be able to pursuade the Congress to pass any legislation to bring relief to legal immigrants considering the mood of the people in the Congress . No one would like to hurt their political career with voting for us in the Congress. The politicians do only lip service whether for illegal or legal immigrant bills. They have zero interest in seeing them passed in the Congress.

Quite honestly, if that is how you feel - perhaps you'd need to reconsider relocating to your home nation. I'm Indian, who grew up in the Middle East. I've lived in the United States for 6 years. I've always felt quite welcome and accepted in every way possible. I believe I've been treated fairly and have had the opportunity to live with Americans and contribute in positive ways. I continue to live here, primarily based on these sentiments. I'd never live here if I felt the way you do now. Nicely put ryan. This country has given me a lot that I could think of. I may get GC lately. But that does not stops me what I want to do right now.
