Is it out of status if one gets paid from 2 companies with
2 H1bs , like, If one is on bench but getting paid by that company, starts working with 2nd company on transferred H1b, so it is like double pay for about 2-3 weeks .
If you're getting paid while you're on bench with Company A, and Company B has transfered your H1, and is paying you as well, that's not a problem. The problem arises if you're on bench and are not getting paid. On H1, one has to be paid even if he/she is on bench.

What has this rally given us?
Well, I can tell you that whoever flew in/ drove in/ walked 4 miles between noon and 2:30pm is convinced of the need for an organized and peaceful battle against the unfair and broken green card process. The 1000 souls that showed up on that day, besides those who pitched in any way to help them, will find sending webfaxes and meeting their lawmakers (locally) to be a piece of cake. Once that happens, things can only get better for us as a community!

My PD is 02/01/2005, my labour cert got approved in 03/01/2006,
I applied EB3 I40 on 05/18/2007 and got approved on 05/23/2007
Considering the scenario is my I140 invalid?

very well said goel.. I said the same thing to IV and I got God knows how many reds. The only time I saw a huge impact was after July fiasco but again it was not IV's alone effort, many other organizations were included.
Honestly IV is a great platform to help members with their questions and exchange knowledge about immigration topics but nothing more.. I don't expect the founders to leave their full time jobs to address immigration issues as without a job they won't have any immigration issues.
To people who say that illegals have huge support and resources that is because they have lobby money from businesses who need cheap labor, lawyers who need new clients and politicians who need (future) votes..
In our case business know that first we are not any cheap and second they can move the jobs overseas.. Lawyers already know that they have us by the b***s and politicians flip - flop depending on who they talk to (citizens or us).
I think I have joined IV in last 3 years or so...
Donated money once & have called congressmen & senators many times ...

What has been achieved by IV till date? I know we all meet elected reps, officials in washington dc ..... but I am interested in end result like not wasting visa numbers , implementing spillover & along these lines.
I have asked few friends to join IV but then if they ask me for IV accomplishments - i can't count any....

Please remember that even if BEC clears the application with 2001 priority dates. These people still need to:
1) Apply for I140
2) Have I-140 Approved
3) Apply for I-485 only if their priority date is current
4) Complete various I-485 tasks like fingerprinting, BACKGROUND CHECKS (this is a huge one and unless you are lucky you can get stranded for anywhere between 6 months to 3 years)
5) Now after completing 1 - 4 above you can expect that they will apply a visa number to the application

I understand that Immigration bill is not an easy one to pass. If it is being introduced again, hopefully they are not going to have the exact same wordings. I am sure they would have learnt something from the previous failures and come to some agreeable compromise.
So i think it is good to have some hope and work towards making it happen. Lets not worry about failure. We have nothing much to lose.
In the 2006 CIR was passed by Senate and it failed in Congress.
The strategy was adding poison pill. They deliberately added so many poison pill that
even EB folks were opposing the bill.

Your employer will have to file a PERM and I-140 and once I-140 is approved in EB-2 with earlier EB-3 PD, request USCIS to adjudicate your pending I-1485 using the newly approved EB-2 I-140. No need to file another I-485 if you already have one pending.
Regarding the fee, there is no filing fee for PERM. All the costs are related to advertising and lawyer fee. I have no idea how much the fee for the whole process is or what attorney's charge as I have never paid anything for any of my immigration process so far (11 yrs in US). Technically, you are not supposed to pay anything, only employer should pick up the fee. You can pay the premium processing fee wherever applicable.

My employer is picking up the cost for PERM and I140, as you said I may pay for premium processing for 140 if I opt it that way. You never know! All the gray areas of payment, unenforceable contracts are a game of poker, he bluffed and you blinked. See if the reverse can happen now. Send him a mail or call him up and see his reaction. Say that you spoke to a lawyer and the recommended path is to begin with small-claims court and if that does not work out you will be filing a lawsuit. if he offers you anything back to avoid these hassles (say 3.5k) then go for it (& take your family out to hawaii this summer)
p.s: just as mbartosik said, you need documents to prove everything, hope you have all those, without that nothing will stand up in court (though you might scare him enough to actually pay you)

I would be delighted since I am from EB3-I. That is what is unfair about this country cap. You probably filed your GC in 2009 and is already impatient. Think about people who came to this country in 2000 or before still waiting for their GCs.
Some of them has aging out kids who will lose their eligibility because of this long wait.

If Ron were to look at the state dept. allocation for S. Korea in 2008, they got most of 7% in EB. The number was close to 25K.

this is a valid point.
but advantages of CP vs AOS are completely besides the point as that decision is based on individual circumstances.
If you/IV want to lobby, lobby for EAD/AP for the guys whose 140 was approved and staying in US legally on a non-immigrant visa. This may be possible thro, USCIS regulation w/o law change.

Meeting with Congresswoman Zoe Lofgren�s staff, San Jose

A group of us met with the with Chief of Staff and Congressional Aide at Zoe Lofgren�s office in San Jose, yesterday. The meeting went very well and lasted an hour. The Chief of Staff was very knowledgeable about the issues. She ofcourse knew that the IV team had already met with the Congresswoman and the staff at her DC office. One of her first comments was about that meeting and she remarked that it was very good to have � an organized group� like IV. She was very appreciative of what IV was doing as an �organized group� � doing their homework and research and putting out presentations and materials that brought out the core issues very clearly and hiring a very competent lobbying firm to help execute our agenda. She wanted to know who made those presentations (thanks to Berkeley Bee!!!!!) J.. In fact, she repeated her appreciation quite a few times about IV. She also mentioned that she had read about IV in the Roll Call and was looking forward to meet the group.
We went through the presentation, explaining the issues � most of which the Chief of Staff was already were aware of. The Congressional Aide was not aware of a few and we used the opportunity to explain the issues. Needless to say, personal examples helped to get the point across very well. While we went through the issues at the BECs and the USCIS, we quoted quite liberally from the Ombudsman report and the Presidents Economic report and from logiclife�s post on the backlog centers. At one point we were asked/ told that since these were infrastructure problems that are very deep, it is probably going to take time to completely address the fixes in the system. We again took that opportunity and told them about IV goals such as the 3yr H1B extensions instead of 1yr and the recapture of the visas lost between 2001 and 2004 - which would provide interim relief to the people affected by the backlog. We explained how the 3yr extensions instead of 1yr would relieve the USCIS of additional work and allow them to focus their efforts on actual processing / clearing of backlog. When they commented that the Dept of Homeland Security may want this to be a 1yr process, we pointed out that currently 3yr extensions are being offered to people who have filed for I485, so we are merely asking that the same be extended to people with their Labour and I-140 pending.
They offered us a couple of suggestions:
1. To talk to the Congress people �on the other side� especially in the Judiciary committee. They wanted us to consult with our lobbying firm first. They strongly felt that we should be talking to lawmakers who are not pro-immigration. They said that we may need to study their district and the industries there and try to point out how those industries are benefited by immigrants directly or indirectly.
2. To collaborate with the giants in the Private sector who employ highly skilled legal immigrants because some of them have very loud voices on the hill.
We do have an action to get back to them with a list of states that we know that don�t issue drivers license renewals for 1yr. Can someone please provide us with this information so that we can relay it back to them?
They also wanted a softcopy of our presentation and the supporting materials. We are working on that.
Overall, they had a very good opinion about ImmigrationVoice. To quote them again,
�Very Organized Group� � and they felt that organized groups make a great difference,
�Done their homework very well in terms of research, pinpointing the exact issues, presenting and communicating them in a way lawmakers / people understand�, �Have a very good lobbying firm�. They wanted IV to continue what we are doing and meet with lawmakers on either side (pro and anti immigration), so that when a �window of opportunity� presents itself, we can use it to our advantage.
