I am also trying to stay afloat through the very debatable AC21 process. Currently, my case is being handled by Ron Gotcher and I have been very happy with all the help and support so far. Not to mention, they are really reasonable.
Thanks for sharing. I don't think AC21 is very debatable as I have seen ppl used AC21 and currently holding GC without any unwanted issues.

Country caps, recapture, STEM exemption kind of provisions are the only hope.
Just for my understanding, why are we not talking about excluding dependents from EB count? If each primary applicant consumes nearly 2.5 visa, then excluding dependents will definitely be useful.
We don't talk about this because it is not feasible to achieve? Or does it slips out of our mind?

I doubt that there is any "transfer tax". As long as you have filed your income tax return that showed the source of that "saving" (good job there), you have already paid taxes on it. Also, your parent don't have to pay any tax on it since there can be no double taxation of the said money.

No matter how many years you are on H1B, 2 or 10..., you are out of status as soon as your employment ends. Unlike what many H1Bs think, there is no grace period. You have 10 days to pack your bags and leave. However to verify your employment USCIS uses paystubs, so if you immediately find another job and file for a new H1B before your current employer reports to the USCIS that you are no longer working you should be OK.
So first thing you need to keep in mind is do not fight with your current employer. He can screw you in more than one way.
Second, get a three year extension if you can.
Third, find a stable employer... I know many people here hate consultancy companies, but that is the safest option for you.
If you read the transcripts of the Q&A with lawyers, posted on the front page of this site, you will find answers to question about changing jobs when you have I-140 approved etc.

I would not wait until April to be told by HR, Sorry we cannot do it or we will do it at our own pace. I mean, what is so difficult for HR or attorney to decide in filing your Perm? Do they need to do meetings about you everyday for 2 months to decide if they need to file for you?
Is that how corporates work? Imagine if you are given a project and you tell them to come back and talk after 2 months. Dude your end of H1B countdown has already started and you need to act even if you have a buffer time. I have also heard that if a company has layoffs, the company cannot do PERM for 6 months. So what if some layoffs happen until April? You maybe in a soup.
I suggest you take a hard look and do what is in your best interest. Put your own interest over all interest.

Folks, the idea of this thread was to appreciate what Pankaj did and i am sure everyone agrees with me that he did a wonderful job.
To do it or not to do it, is a totally different thing.
This is a learning process and this rally was done for the first time. So, there were a lot of lessons learned.
We will do a better job in the next rally.
Instead of worrying about the rights and the wrongs, lets spread the words, lets get some more local lawmakers meetings, lets educate ppl about the issue.
Come on folks lets use this wonderful oppurtunity to advance our cause, lets use this positive energy to educate ppl more about LEGAL IMMIGRATION.
IV is a platform where we can unite and get things done together. IV does its best, but IV wants individuals to try at their personal level.
Come on guuys so lets start working on positive things and lets keep on moving forward.

I want to express my solidarity & support with you guys. You have been great in bringing so much focus on our issues in just the last 3 months. Kudos to you guys !!!
The core team has spent so much of their personal time, money & energy into this, I fully support the suggestion someone else had put in this thread. If any money is left at the end of our ordeal, let the core team be rewarded by the remaining amount being split between them. I too know that this suggestion may be turned down by the Core Team members themselves, but here's my vote for it.
Just remember that for every 1 person complaining here, there are at least 10 people supporting you. Thanks for all that you are doing to help our cause !!!

Please stop behaving like a bunch of spoiled kids. You seem to demonstrate this attitude by behaving like a kid going up to someone, handing over a 5 dollar bill & asking for the "Tower of Paris". If you want your Tower of Paris, come & help us build it.

They will reject your application without medical exam. Before USCIS officers had instruction to favor RFE, meaning denying as last resort. Now they are instructed to deny any incomplete application and accept only if everything is OK.
Get the list of the doctors from USCIS web site and find one, drive/fly to them.
More likely you are not a from large city if the doctor is problem. In LA there are hundreds and I had an appointment the very next day.

I was just thinking if it would help to gain more publicity if this site goes by a different name. On several instances while calling lawmakers or other people, the moment I mention immigrationvoice.org they think it is related to Illegal immigration / CIR etc. I need to stress that it is about legal immigration.
Even the flyers don't catch enough attention
Any name that does not have immigration in it (something like numbersusa), and reflects our main focus - green card retrogression and legal immigration would help - Just a thought...

1. We have to change names everywhere, including the name in the registration of the organization in New Jersey where its registered as non-profit, name change in other places like IRS where we got approved as a non-profit organization for tax purposes, in next year's tax return, etc.
2. Changing names in other reports we file at Federal Govt.
3. Letting all offices and other org we are working with know about this.
You would be surprised how much awareness and knowledge is there about Immigration Voice in the staff of various Senators and senior house members. Most of the Judiciary counsel staffers know about immigration voice. Since so much work has gone into building the name-recognition .... A VERY IMPORTANT ASSET... it would be tough to transfer all the name recognition to a new name.

Hello,
In all the stories of INS, USCIS, DHS that I've read here, the lack of visibility, customer service and accountability seem to be the common theme.
However, I was pleasantly surprized by a call from IO a few weeks back in local office asking me for extra documents (Current employment letter as the original one was from 2007, 2007 tax returns and 2007/08 W-2).
He told me that though he had sent a letter, the letter would take a few days to reach and hence he wanted to call me up. He also told me that as my original fingerprints are expiring on 26th Feb, I should send the response as soon as possible to enable him to process the application.
Though I still don't have any extra hope that the application will be processed soon, it was nice to see a change in USCIS approach.
Hope this was not an exception to rule and we see more such behavior from USCIS that helps in clearing us from this awkward limbo situation.

That happened to a person I know, she was an undoccumented immigrant or illegal and when facing deportation the judge said he does not think having a US born child was reason enough to grant residence in the US. The child can always come back when becomes 18

Or you can seek an appointment with that person and see what they have to say about this. Writing a letter will get you a generic form-letter response from a junior staffer whose job is to pick one of the 25 form-letter responses based on issue (Iraq, healthcare, immigration, veteran's affairs, crime, gun-control, abortion, judicial appointments, taxes, etc. etc. etc.) and slap your name/address and stick a postage stamp and mail it.
So, if you want to talk about immigration with them, call their office. Talk on phone or seek and appointment and meet them to elicit their position and educate them on retrogression.

The only important thing is that you must either be working in a same/similar job for any employer (using AC21) or have a valid job offer in the same/similar job classification as on the labor certification at the time of 485 adjucation. It is easy to get rfe if you are no longer working for the sponsoring employer.
At that time, you should not be actively searching for a job - You should have a job offer which shows the employer's intent to hire you on a future date.
