The potential drawback of filing EB-485 during July is the currently unanswered question of "what happens if the rejected applications are not returned for months and if visa number becomes current for him or her in October 2007?" At this time, no one knows how many EB-485 applications have been received by the Service Centers since July 2, 2007. Additionally, there is no way to find out how many more applications they will receive during the next 20 days. Obviously, the number of filings must have slowed down lately as affected by the AILF that they will seek certification from the court to include certain non-filers as members of the class action. Still, the number may turn out to be quite substantial by the end of July. No one knows when the "hold order" will be lifted and how long it will take to process rejection notices and mailings in the future.
Under the USCIS policy, the applicants are not required to submit any "original" evidence for filing of applications and petitions. It will thus be prudent that people may not want to submit original documents "other than medical report" as part of the supporting documentation to the EB-485 applications. Please keep original documents safe against the future need for refiling of the EB-485 applications in the future.

Hi All,
Could someone provide some guidance regarding my situation:
1. Currently on 6th year H1-B valid till Mar, 2008, with visa stamped in Mumbai Feb 2005.
2. Have applied for I-485, AP, EAD on June 25, 2007 as dependent on spouse's employment based GC (India, EB3, , priority date Jan 2003). Got EAD, have FP done.
3. The last time I came back from India in Feb 05 after visa stamping, I-94 was stamped with expiry date of 12/26/06 since passport was expiring then. Officer said I could go to local USCIS office and get new I-94 when I get passport renewed.
4. Went to local office with new passport, and officer says they cannot issue new I-94, and that I-94 at bottom of H1 is the valid one, no issues.
Finally coming to the main issue -> Recently got a new job and company wants to transfer H1, but says cannot apply for H1 transfer until I get a corrected I-94 from the airport I entered from.
Anyone with similar experiences, or knowledge of how to get a corrected I-94 ?
Also, any implications of my situation on the I-485 process ?

After you have filed this application, USCIS will notify you in writing of the time and location where you must go to be fingerprinted. If necessary, may also take your photograph and signature. Had some colleagues who worked in Detroit and lived in or around Windsor. Took them around 45 minutes to an hour each way to work. One of them had his wife's entire family living in Ontario (they were Vietnamese immigrants). He had a US citizenship so there was no immigration issues. His wife did not want to live in the US and there were no jobs in Windsor so he had to commute. I think one of these colleagues was on a H1 but not sure. The big problem is that there aren't enough jobs in Windsor so chances are that your wife won't get a decent paying job. Then you have to pay high taxes I think as much as 10-15% more. Due to exchange rate fluctuations you can see your living expenses shoot up and down. Just a few more things to keep in mind. Overall yes I think this is plausible and depending on what you want *Canadian citizenship/GC" this could be a choice for you. I would suggest contacting your branch in Detroit and talk to people who live in Canada.

what bothers me is that I am not cited in the literature yet and I do not have awards.

Your situation is slightly different than many I have come across. If your qualifications, research work, project etc have unique qualities, then you may still have a fighting chance. But you may have to do a lot of homework: find out NIW holders in your / related engg field, ask a few lawyers: do not believe right away if somebody promises they could, try to enroll in as many professional associations as possible, enlarge your skill portfolio etc.
BTW, is any degree of you from US?

I have been constantly trying to get the message out here that it is imperative that we do not condone illegal or unlawful activities including covering up out-of-status cases. I have received so many REDs for doing it. Go look at the other two posts I have replied to. Some people who don't like the fact that I advise people to leave the country. They are the ones that give me reds!
I saw this on an anti immigrant site by a M*****r.
Hope some of you will learn a lesson from it and stop posting threads about Telgus, Eb3 vs Eb2.
I have also seen posts by ignorant educated illiterates on IV where they advice people to do illegal things. Some of you own consulting firms or businesses and try to promote it by posting and sending Private messages. If we see such message, let us give reds and report to IV. We also need to discourage people from answering wrong info to posts where someone is illegal/out of status. All this used against us.

Yes, I guess I went through that scrutiny when I submitted the employment letter and payslips and W-2 last month...the IO had told me that he had employment letter from 2007 so he would like a current one and he wanted my tax details compared to W-2 to see if there was any other income apart from my job income.

Lets figure out the next course of Action for IV in the best interests of its members. Let's itemize each one of them and propose possible solutions. This thread is not for question / answers about individual situations but broad GC issues to be resolved by Govt/Congress/USCIS/DHS/DOL by way of proposing bills/acts/resolutions/amendments. IV must have done this but I didn't see an easy way of getting it.
First we could categorize them into different buckets such as that IV did for the forums. Just made up some to give an example. Some gurus on IV can suggest a better categorizing
Ex:
1) Labor
a) Allow one to get promoted instead fixing to of a fixed job position in the labor advt.
2) I-140
a) Allow One to file for two I-140's
b) Have freedom to change employer when I-140 is pending
3) I-485
a) Allow one to get married while I-485 is pending or after approval or provide some status to the spouse for whose I-485 is approved
b) Have the flexibility of filing multiple 485's so that one can choose the best one at end of the approval stage
4) Finger Printing
a) ...
b) ...
5) Backlog
a) Resolve backlogs from 1999.. so and so..
OR in the following format

I just cooked up some above but the actual one's may be different
I am sure the IV Core must have these itemized already. Some one in the core team may take a lead on this and formalize the process. This is what probably the way we try resolving problems rather than balabbering issues among ourselves in the postings amongst us.
There are lot many individual stories on different threads, and there is some thing common out of all these postings and that common issue should be the action item to be taken up by IV.
Guys put in your thoughts and come up with better approach or improve up one of the above approaches. But do something before every looses the tempo.
If this can be made as a sticky and the first post can be updated with each new issue that itself takes us what we need to do and how we are trying to tackle and what are the time lines.

I am sure the IV Core must have these itemized already. Some one in the core team may take a lead on this and formalize the process. This is what probably the way we try resolving problems rather than balabbering issues among ourselves in the postings amongst us.
There are lot many individual stories on different threads, and there is some thing common out of all these postings and that common issue should be the action item to be taken up by IV.
Guys put in your thoughts and come up with better approach or improve up one of the above approaches. But do something before every looses the tempo.
If this can be made as a sticky and the first post can be updated with each new issue that itself takes us what we need to do and how we are trying to tackle and what are the time lines.
