Unfortunately the Timing of IV Advocacy day, and also May 2011 VB schedule at a wrong date. If the Govt Shutdown due to the budget deadlock, I'm not sure how both of these days will play out. Any Idea guys.

Politicians are politicians every where. India or USA their intensions are the same. Always cause a trouble to the ruling party, no mercy for the general public who suffer directly with their actions.

Shutdown means no work for 800k fedaral employees. Hence no wages. But bills won't stop.

    Hope for the best.

Siva tells me that hundreds of flowers have been delivered already. DHL made a big delivery this morning. Another delivery was made by UPS.

They have Voice of America and CNN-IBN there recording video and taking pictures. Reuters TV might show up soon.

Kudos to everyone who kept the faith.

I am planning to go to the USCIS office tomorrow for media coverage. Any one in the DC area willing to join? This would be between 10 am and 1 pm. send me a pm with your name, number for more info. I really want to hear from the people who were ready for the protest in DC. This is a good opportunity to explain what has happened and the root cause of the issue.

    Hello axp817

I had soft LUD's yesterday (9/19) on all I-485 applications in my family and on the (July 2007) EAD's for my spouse and me. My PD is May-30 2006, so I'm wondering if they are looking at low-hanging fruit for the next month (or to hang the fruit!)

Me too! my SLUD were on 09/04 - again on the 485 and 765 applications.

This is awesome even before getting the flowers we have achieved what was intended.

I request members to refrain from making personal comments.
Everyone has got their opinion but if that is against our idea and thoughts we should tackle it fairly.

Anyways KUDOS to Everyone participated in this cause.

The message was reched to whoever it needs to ( Media) and USCIS make it easy by posting the same in www.uscis.gov website. This is a big victory for IV and the next step is to have a big rally to carry the message forward. Please vote to join rally in DC for the week end

    Applying 485 through Spouse

    --------------------------------------------------------------------------

My Priority date is Jan 2006, EB2-India category having approved I-140. My husband is in EB3-India having pd Jan'2004, already applied I-485 (140 is approved) and got his EAD and AP. He is already using his EAD. I am a dependent in his I-485 but did not use my EAD and still continuing on H1-B.

Since my case is EB2-India which is going to be current in August'2008. Am I eligible to apply for I-485 me being the primary and my husband being my dependent? If so would there be any problem when USCIS adjudicates my case?

Your valuable response is highly appreciated.

WASHINGTON (Reuters) - Disgruntled green card applicants from India sent hundreds of flowers to the U.S. immigration agency on Tuesday to protest a recent policy flip-flop that hurt their quest for permanent residency.

The campaign that directed around a thousand flower deliveries to U.S. Citizenship and Immigration Services (USCIS) Director Emilio Gonzalez was modeled on a popular Indian film promoting the peaceful protest methods of Mahatma Gandhi.

The protest was inspired by the abrupt reversal last week of an announcement issued in June offering expedited processing of green card petitions for thousands of skilled foreign professionals working under H1-B visas.

Thousands of holders of H1-B visas -- reserved for skilled workers in computing, engineering and other special professions -- scrambled and spent money on lawyers and medical exams to prepare green card applications for a July 1 deadline.

The abrupt closure of this path to a green card -- proof of lawful permanent resident status -- sent the applicants back to the queue for 2008, when they will have to spend more time and money, organizers of the protest said.

"The gist of the campaign was to peacefully convey disappointment and concern at how things have evolved in the last month," said Sivakanth Mundru, a Virginia-based computer systems analyst who was affected by the policy.

    FLOWERS SENT TO SOLDIERS

Gonzales said in a statement on the USCIS Web site that the agency would forward the flowers to Walter Reed Army Medical Center and Bethesda Naval Hospital in Washington, D.C., the main facilities treating U.S. soldiers wounded in Iraq and Afghanistan.

"We welcome the fact that the director at least acknowledged this campaign and we are happy that our flowers will be bringing some color to our soldiers in those two medical hospitals," said Vikas Bajaj, a software developer in Wisconsin who helped organize the flower protest.

Although Indians staged the flower protest, the green card application setback affected skilled workers from China, Poland and many other countries.

Mundru and other activists said hundreds of thousands of people shared his state of limbo. Many were unwilling or unable to buy houses or start companies until their residency was secure, they said.

The situation of foreign professionals working in the United States while awaiting green cards was sidelined in this year's contentious immigration debate, which focused on illegal immigrants, Bajaj said by telephone from Wisconsin.

"We have never been in this country illegally, we are hard-working, we are skilled immigrants -- and yet very little space is devoted to our issues," he said.

"The irony is, in this whole migration debate, our issues are probably easiest to solve," said Bajaj.

My colleagues and friends are sending e-mails to Judiciary committee members. I am preparing draft for this mail. I am going to divide this mail into sections. One section describing what H.R. 5882 is (recapture, justice against discriminatory treatment based on country of birth, USCIS efficiency) and another sections would describe what it is not (not amnesty, not an increase in numbers). I want a link to the testimony given by USCIS director in congress confirming the wastage of green cards. Can someone quickly direct me to that link?

Maybe FOIA request by IV was one of the main causes for this data to be posted on the USCIS website. USCIS thought that since the cat is out of the bag anyways, why not make the data public as part of the redesign effort of the USCIS website.

If the data provided to IV on the Donor forum matches with that of the USCIS site, there might be some other details in the IV report that can give us a better picture.

Finally got the CPO emails/texts today morning for both me and my wife.
    ...
If there is one thing I learned wrt immigration, it is do things ASAP. Never postpone anything at all. As much as possible get first in the queue.

A general piece of advice: Never reject an option you don't have. [this is more to do with folks who say, "I am only in year 1 in h1..I don't know if I need gc..let me see after 2-3 years.." - guess what einstein, it is easy to give up your gc after you get it, then to get it when you desperately need it.]
    ...

    Congrats!
It is a great piece of advice. I remember being that Einstein long time ago & regretted several times.

    Michael,

I know you are trying to promote vonage, but not addressing the issues in terms of cancellation.

One more thing is that the taxes on the service, which is really killing part, for new yorkers, have to pay almsot 9 dollars in taxes, which is 35% of the monthly bill (24.99), it's too much when we compare with other VOIP services....

    State/Local Taxes and Fees $3.44
    FUSF (VoIP) $2.41
    Regulatory and Compliance Fee $1.49
    Emergency 911 Service Fee $1.49

Hope vonage will come up with some thing better than this, aslo there is 5000 minutes restriction on outgoing, it doesnt matter whether you called local or international, every minute counts.....guys beware of that limit, I know 5K is lot many minutes, but still you have to monitor, if it exceeds, the account will be changed to Business and have to pay more monthly.....

Also it would be great if you guys can come up with a feature that calling from cell phone by using vonage account.....with this option, more customers can sign up, offcourse customer service has to imrpove lot....

I called Vonage Customer service , If you signup Vonage World there is no 5k Min. limit. Its unlimited. Guys please don't post the wrong info.

Posting it in this thread, as this is related to HR5882.

Make Immigration Work for Working Immigrants

    http://townhall.com/Columnists/CesarConda/2008/09/09/make_immigration_work_for_working_immigrants

Employment-based immigrants contribute greatly to America, although you would not know it from the way current U.S. policy treats them. Due to low quotas, a typical skilled immigrant sponsored by an American company now waits 6 to 10 years for a green card (permanent residence). The House Judiciary Committee marks up legislation this week to change that, representing likely the only measure Congress may take in the remaining weeks to aid innovation, the economy and the competitiveness of U.S. companies.

H.R. 5882, authored by Rep. Zoe Lofgren (D-CA) and Rep. Jim Sensenbrenner (R-WI), would reduce wait times for green cards and help retain talented people in the United States. It would do this by providing green cards that had been allotted in previous years but went unused, primarily due to bureaucratic obstacles.

A developed countrys competitiveness now comes primarily from its capacity to innovate the ability to create the new products and services that people want, according to Curtis Carlson of the Silicon Valley research firm SRI International. Skilled immigrants are a vital source of Americas capacity to innovate.

The National Venture Capital Association reports that 1 in 4 publicly-trade companies that began with venture capital since 1990 had at least one immigrant founder. While the vast majority of employees at U.S. firms are Americans, when U.S. employers recruit on college campuses they find foreign nationals represent a high proportion of the graduates in key fields. In 2006, 73% of new electrical engineering Ph.D.s in the U.S. were granted to international students, according to the National Science Foundation, while in 2005, foreign nationals received 55 percent of electrical engineering masters degrees and 42 percent of computer science masters degrees.

H-1B temporary visas, which have been exhausted each of the past 5 fiscal years, only allow individuals to stay on a temporary basis, so an employment-based green card is necessary to stay here permanently. The separate quota for green cards for skilled immigrants is set at 140,000 a year (including dependents of the skilled immigrant). That quota has also been insufficient to meet demand, creating waits of 6 to 10 years for a green card.

The great uncertainty these waits create lead some to give up and leave the United States and others to not even begin the process. The current long waits cause a reverse brain drain affecting American competitiveness and innovation, according to Aman Kapoor, executive director of the group Immigration Voice. At the same time, these green card backlogs create severe quality of life issues for the applicants and their families.

Those who understand markets realize that there is no such thing as a fixed number of jobs, as critics of high skill immigration maintain. A 2008 National Foundation for American Policy (NFAP) study found that for every skilled foreign national requested (for H-1B visas) with the Department of Labor, U.S. technology companies increase their employment by 5 workers. Many U.S. executives confirm this experience at their firms. Looking to Americas next generation of scientists and engineers, a 2004 NFAP study found more than half of the finalists for the Intel Science Talent Search, the leading contest for top U.S. high school science students, were the children of skilled immigrants.

In addition to the reduced waiting times for green cards from H.R. 5882, Congress can take other steps. It can fix the labor certification process for skilled immigrants under which the U.S. Department of Labor (DOL) requires companies to engage in expensive and time-consuming advertisements to show no qualified Americans are available for certain jobs. Neither the law nor the original DOL regulations required such advertisements. Yet DOL is using its questionable authority to, among other things, audit thousands of green card cases from the nations largest immigration law firm, Fragomen, Del Rey, Bernsen & Loewy. The Fragomen firm has filed a lawsuit in U.S. District Court alleging DOL has exceeded its authority. Congressional oversight is warranted.
Congress can also eliminate the per country limit for skilled immigrants, which pushes back wait times for Indian and Chinese professionals, exempt from green card quotas those who earn a masters degree or higher, and increase the quotas for H-1B temporary visas.

While H.R. 5882 will not solve all our immigration problems, it represents an important effort to retain talented individuals in America so they can help create jobs and innovation in the United States.

Stuart Anderson is a former Staff Director of the Senate Immigration Subcommittee and now Executive Director of the National Foundation for American Policy, a nonpartisan policy research group based in Arlington, Va.

    congrats prashantc..

    Hello All,

In delhi consulate i know they keep the passport and are not giving away any slips (221(g)) or any color slips.
all they say "pending processing". Is this same as Administrative processing ? how do we differentiate if this delay due is due to PIMS or some other reason like security/name check/ or any etc problem. This is such a doubtful situation specially for people who have been waiting for more than 2 weeks ?
If you have knowledge ..do shed some light.

    thanks

I am surprised that Capitolone did not accept EAD. I do not see any issues for them with employing somebody on EAD. Personally I think a lot of banks and other financial institutions have been neck deep in losses from the Mortgage melt down and they are laying off staff and put a halt on the hiring. I suspect this might be the case with Capitolone too and may be they do not want to admit it. Once you have an EAD do not stick with one company, apply for multiple opportunities and go with the best offer. I would advise every body with EAD to try and secure a job if they are not working currently, because with the weakening economy this will be a period where the job market will suffer.
