    I think we should not mention the bellow point in the letter which we are going send to the president.
    Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.

    According to Mr. Aytes, USCIS is already working on it. Why to mention it in the letter?
    That will rather give anti-skill-immigration crying babies one more thing to cry about.


    Now what? Under the new filing fee schedule which took effect after July 29, 2007, issuance of EAD and Advance Parole for the post August 27, 2007 is "free, free, free" for the I-485 filers. Allegedly, the cost is incorporated in the I-485 filing fee of $1,020. The new regulation uses the term of "fee waiver" for EAD and Advance Parole for these I-485 filers. Now, you guessed it! Lo and Behold, the business calculation on EAD and Advance Parole has reversed. The DHS will lose a huge money by issuing single-year EAD and a separate Advance Prole document on a yearly basis over and over since they are free and they will have to keep producing it at no charge every year, which creates a huge workloads consuming its huge human resources and other production costs. This is particularly unacceptable to the agency under the predicted State Department Visa Bulletin for FY 2008 and in the future. Now, from the business standpoint, the DHS may make a huge money by issuing a multi-year EAD which will also function as a travel document. Ahah! No wonder why they are finally coming forward revealing their hidden agenda behind the new fee rule-making and EAD/Advance Parole reform business. Reportedly, Mr. Aytes of USCIS disclosed in a New York AILA conference that the USCIS was currently working on a single multi-year EAD card that will also replace the Advance Parole document.     I am a big supporter of Obama and a big fan and am eagerly looking forward to see him as our next President of United States. As a legal highly skilled immigrant what can I expect? Well, not sure if I would see myself living here anymore. I have been in the green card queue for more than 8 years now and still waiting. Will Obama's administration do anything for people like me to help reduce backlog? I doubt such a thing will ever happen. I would see myself and people like me discouraged and start packing our bags and move on with life.

    Why do I feel discouraged? If anything is going to happen for the immigrant community when Sen. Obama becomes the President, it is going to be in the lines of CIR 2007. There would be provisions to make illegal immigrants as legal and remove backlogs to family based quota whereas posing harsh restrictions on H1b visas and reducing Green Card quotas and scrap AC21 portability and try to experiment with some new kind of skilled immigration system.

    The above is very evident based on the fact that Senator Durbin has been very hostile to EB immigrants. I am afraid that Senator Durbin will make the calls when Senator Obama becomes the president.

    Please post your opinions. This is a very important discussion. It is very important that the community see what is in store for us when the new Administration takes charge.

    A lot of folks in the EB community are looking forward to 2009 thinking something will definitely happen. Yes, something will definitely happen - and that may not help us

    If her lawyer is quick to respond then you can keep everything ready including medicals and anytime date is retrogressed should apply immediately or the second option is apply for EAD and AP and I-485 case and go tense free and use EAD if you want to change jobs and don't worry about EB2 and EB3.

    Why don't you use direct flights to India. There is Continental from NY & American from Chicago to Delhi everyday. If you directly book from their websites, the prices are quite reasonable. At least American I know also serves Asian Vegetarian (meant for Indian veggies) food.

    You basically get an I131 which has all your immi information on it. It also includes your photo and validity period. There is also an area for stamping it when you re-enter the country. I hope this helps.

    Height of selfishness....

    It is amazing that how these people are ready to spend tons of money and time for such selfish causes.

    If this kind of enthusiasm is displayed on IV action items and contributions then there would be better chances of achieving the goals of this community.

    People who created this forum, which is helping this community so much, have been working for years.. selflessly.. spending time and money and effort many times spending their own money for the causes of this community.. people like Aman, Pappu, Pascal, logiclife et al... There are lots of people in this community who thought about the community first.

    If they were like you.. then things would have been worse.

    But, if you are so hell bent on putting your GC first, irrespective of the damage to the cause of the community, if you are so mad about yourself.. why do you care about polling.. Go alone.. just focus on "you and your GC" .. achieve something alone.. You can then keep all the benefits to yourself.. all yours..Go ahead!

    Just like your campaign, the fundamentals on which you run it, cannot be trusted.. because if it suits you, you'll sell you supporter's interests for your own GC.

    That's why you get support from very few....


    This forum was created on better fundamentals.. Here community comes first.
    That is why IV and those who created this forum have support of thousands!

While in many respects I live the American dream of participating in a thriving economy, the dream is still incomplete because I cannot buy a home because the lenders do not consider me as a viable risk considering my Employment Authorization Document is valid for 1 year. If we include things that are simply not true, it will only make our letter(s) less credible.

    I am not sure how to navigate from LINGO.COM, but the link gives the info...share if any body has exp. with this company....

    I hate to play "who winks first" game with teleblend. They told that they would come up with similar india plan but not providing any details.

    May be now I should switch to vonage or Lingo. One factor in favor of vonage is: I get two months free with referral and one year contract rather than 2 years with Lingo.

    As per one my close friend, lingo CS is not very good. Vonage is still better than Lingo.

    However here is my question.

    The acutal cost of Vonage with unlimited india calling is $31 - $32 per month due to taxes, misc charges etc.

    WHAT would be ACTUAL COST OF LINGO per month? any approximation?

    Any one who uses lingo? Please advice... How much money do Lingo charges over & above regular monthly charges?

    I used to be a vonage user and Vonage was horrible as they were trying as much hard to charge the MAX to the customer in extra MISC charges.

    This is good news indeed !

    12,000 extra visas available to EB2 at the end of second Fisc qtr would be excellent !!

    Worst case I think they'll have to match EB2 India with the EB2 China date before they take it even further in the coming months for the both the countries.

    VB for May will be a precursor to the movement that can be expected in the spill over quarter.

    I hope May VB advances by 4-6months, that may give good chances for spillover season to hit end of 07

    This is plain stupidity. These employers should first take a good look at an EAD and a GC. As for as work authorization is concerned, both these cards provide us with the same rights. The EAD says �The person identified is authorized to work in the US for the validity of this card� where as the GC says �The person identified by the card is authorized to work and remain in the US�.

    So why does the legal department come into picture here? Is it because of the expiry date associated with EAD�s? If that�s the case even a GC has got an expiration date (a later date maybe). Does that mean that an additional budget is required to hire GC holders?

    I was thinking exactly like you until she educated me on this yesterday.

    The problem with the EAD is you are invoking AC21. There are several possible problems here including

    1. Complying with AC21 requirements of job code, 180 days after 485 RD, etc.

    2. Invoking AC21 without 140 approval. This is not against the law, but is risky in case of a 140 RFE.

    There are more reasons, but these ought to provide enough clarity on the problem. It is in the employer's interest to ensure that the candidate does not have any such issues; issues which will lead to termination of employment. The Recruiter cannot check DOL job codes and USCIS documents. That is the job of Legal which means $$$.

    So if the hiring manager does not have a budget for these extra costs or if he has an equally good candidate who is a GC holder or a citizen, it is easier to go with him or her.

    Sorry to hear this, but what is the violation you are referring to. I thot, L1s can be employed in the US on client projects by consulting companies, big or small. Sorry if i dont understand the visa rules here

    Hi Guys,

    I am pretty new to the forum (as a member), I have been browsing the same for quite some time and found it a good source of information regarding immigration related activities. Right now I am getting removed from my project as one of the top 3 Indian outsourcing firm is dumping their L1 resources at my client site and replacing all the citizens, GCs, EADs, H1 etc. These resources are used in projects managed and controlled by my client (most of them are consulting assignments) and these resources are used on java/.net/oracle projects, these two are violations of L1 visa restrictions set by USCIS, I want to know how and where to complain against this violation and we have all evidence to prove the same (project documents, time sheets, work assignments etc). Please let me know exactly and to which agencies we should complain.

    but, no mention of able to file 485 without priority dates though.
