So Guys...
This is something really cheap of you people to think.....
I read a lot of posts where they mentioned that chuck should proceed with the bill.... so that small desi companies dont perish and that will stop abusing the H1B program...
I really dont understand that no one condemed that remark.. Guys who work in big companies are safe by this rule... So what happens to the one sustaining the so called abuses and remaining intact to get their GC's
No wonder we are not able to make progress as much as those illegal immi's do...
Way to go guys... This kind of spirit will take us to great highs

4. Get some credit cards.
5. Let your home go to foreclosure.
It is a financial decision. Every once in a while, most of us go to different stores and ask them to match the price for the item that we had purchased earlier. If they do not match the price then we return that item. Don't we? Do not get sentimental. Just walk off! Your credit history would get screwed but if you plan it the way I said above, you will be fine. Good luck.
And it won't affect your GC.

Senator's office had a very nice system of faxing in your request, just for USCIS issues, so I did that, and got a letter in three days stating that Senator has contacted USCIS for me. Someone else asked me for the POJ method for TSC. I just followed the POJ instructions listed on this forum.

I'm wondering if these figures actually provide ammo for people who claim that H1b is driving down salary. A $50k median starting and a $60k median is not that great.

I am a silent visitor of this website.
Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??
Please try to understand their problem.
Also India is the great. Why don't you guys just think that India is your home country where you are born and brought up. Why you people can't just wait and watch?? If nothing happens to the so called GC, then why don't you think to pack up and go back to India???????
My sincere request, please don't do rally, you might be arrested......you never know what they can do..... Don't you think that, it is better to go back to India rather than being embarrassed here in US???

Anyone have any ideas on what EB3 Rest of World will be in the October Visa Bulletin. My Priority date is OCT 2005 EB3 Rest of World. Do you think I have a long wait?
I believe you wait will be predicated only by processing delays.
Like others have pointed out, it looks like that the numbers are being allocated in a different way from before. Does any one know of any article or discussion by a real attorney or some expert on what is going on?
USCIS may be using divide and silence tactics. One can already see the impact of EB2 being as good as current. They probably liked what they saw and are setting up to move back EB3 much more. At this rate EB3 will crawl to death. People will try to jump into EB2 and realignments/adjustments automatically will take place.All good for USCIS.
But, going back to my original question, what are the legal experts saying? Can any legal entity or any type of action force USCIS to explain what the heck is going on?
Yes, at least one immigration attorney disagrees with the current interpretation, however he feels that the laws, as written, gives USCIS/DOS the wiggle room to deflect any lawsuits. Since the law does not deny EB3 the numbers, I think we should start a letter campaign to bear upon USCIS/DOS to take a second look at the law and fine tune their interpretation.
We should also ask other immigration lawyers their thoughts (some who have online chat/discussion).

Did AILA screwed up the party of many july filers by sending this memo http://www.shusterman.com/pdf/aila-cis-vb.pdf to uscis which scared them and prompting them to come up with the legal proof revised bulletin causing this whole mess. Should AILA had waited until july , then we would probably have a strong legal ground to fight against the uscis ??

08/03/2010: Opened SR for primary (self)
08/05/2010: Sent email to NSCfollowup. Got reply that this account address is for following up on open SRs.
08/09/2010: Infopass appointment, did not get any useful info other than that case is being processed
08/09/2010: Opened SR for Secondary (spouse)
08/12/2010: Got response for 1st SR. Main gist of reply was that due to pending caseload in Nebraska, the processing time for my case has been extended :(. But the statement that got my attention was "Your application remains awaiting review by an Officer and you will be notified as soon as a decision is made. The Service is waiting for VISA availability." So called helpline again and was able to get to 2nd Level IO. She said that this statement is a mistake and that Visas are still available. Also confirmed that my case is with IO. However she said that I might be required to do FP again. The FP might be causing the delay.
08/13/2010: Contacted local congressman and asked help for following up.

Latest status: Still waiting, not sure what other action I can take.

"The idea of having a leadership bill ... has been abandoned," he said last week. His panel will begin marking up immigration legislation March 2. A chairman's mark expected to be introduced this week will resemble the mark Specter circulated last year, which borrows components from various immigration proposals. It included the border security provisions in the plan introduced by Sens. John Cornyn, R-Texas, and Jon Kyl, R-Ariz., as well as the guestworker plan introduced by Sens. John McCain, R-Ariz., and Edward Kennedy, D-Mass.
Specter has characterized the mark as a "starting point" for debate.
Frist has told colleagues he wants to begin floor debate in late March, likely March 27. Senate aides said whether the bill will be written by the committee or leadership depends on how the Judiciary Committee markup goes. The House passed legislation last year toughening border security and requiring companies to verify the legal status of their employees. Unlike the House bill, the Senate bill is widely expected to include some version of a guestworker program. The program included in the Kennedy-McCain bill would allow illegal workers to join a temporary guestworker program, after which they could be eligible for permanent citizenship if they meet criteria and pay a fine. I am saying there are problems with USCIS not just the one you are pointing out.
My point is if more and more people like you file lawsuits against USCIS for the different kinds of injustice they think USCIS, DOL and DOS had brought on them, we ( all EB categories)will be in better shape to fight together for the bigger cause which is more predictable process and processing and closing as many loopholes as possible in the employment GC journey.

I know that is ACT. But USCIS can interpret the provisions and make adjustments like what we are requesting. Similarly it can , IF THEY WANT TO, include a provision saying the job not only need to be in similar field, but it shall be in the same labor market because that is where you got your labor. I am not saying this is going to happen just because IVs effort.
If the intent of the similar job requirement is not to hurt the local talent because that is that job that is advertised for, the restriction of the same labor market will serve the same purpose.
That is a legitimate doubt and concern for some.
Chandu, I have great respect for your enthusiasm , but why do you have to be so hostile to a person that does not seem to think the way you are thinking. Different people react differently for the same news. I am not sure your rant has any back ground with any other post by the people you are pissed off about ;)
And the above answers concerns some may have and shuts them up. Shouting at them definitely will not help any body's cause. What has getting a GC to do with how you raise your children ?
Since when this immigration is a BIG issue in USA...... remember the BIG Rally ?? Some of the efforts with positive intentions may have a negative consequences in the short term or a long term.
The reason I post those strong words is because negative posters seem to influence people's decisions a lot. An example is , right during the rally time, I had negative people calling my wife and frightening her about the rally. She was always confused, and did not understand if she wants to support me for my efforts on mobilization or listen to them. It took a while for us to overcome her confusion. Negative posts and negative influence impact and hinder our efforts a lot. We do not need anti immigrants to cause damage, these negative posters do more damage than anti immigrants. One negaitve post can influence many people, as such it is very difficult to draw people for a good cause these days, people just do not want to cooperate or just are not motivated, negative posters demotivate the fence sitters.
If people are positive and cooperative they influence positively, they set an example for others to follow and that is what all the positive folks do, no matter what the negative influencers say or do, positive people always remain positive and try to guide people through examples.
"needhelp" is a good example of positive motivation - she does everything she can to set an example - if people learn from her - that is what we want

finally got FP notices and the appt. date was october 21st. I did a walk-in to ASC and got it done on sept. 29th. So, the cases will have the way cleared up for oct. 1st. There was an LUD on 30th, may be a result of biometrics uploading. No movement after that.
both cases are with same IO as per infopass. senators enquiry came back saying wait for 45 to 90 days. Processing in the order we received them.
