Hello All,
I have a valid H1 (I-797, I-94) till 2009, but my H1 Visa on my passport has expired in 2005. My wife has a valid H4 till 2009; similarly her H4 visa on her passport got expired, we havent traveled outside of US from then. Now she is planning to go to India next month because of some family urgency and she is planning to take an appointment for H4 visa stamping in Chennai consulate (India). My question is, is there going to be any problem for her stamping as my Visa on my passport has been expired even though I have a valid H1 I-797 till 2009?. Is there any rule which states primary applicant has to have valid visa on his/her passport for H4 stamping.
If any one of you had a similar situation please share your experiece, it will be very helpful.
Thank you for your help
The issue exista only if the H4 attempts to enter us when the primary applicant is not already in the us.

One benefit in staying with Nikon, at least for the time being, is that I don't have to compete with DavidP & Co. for those abundant "9, 9+, 10, R, D etc" rated used Nikon lenses on the market (B&H, Adorama ...). LOL.

Democrats want to win Presidential election and increase their numbers in congress based on Iraq and Immigration. They are thinking that if CIR is passed they can project that it is Democratic congress which passed CIR. If they fail they will blame that Republicans voted against and they will make this as election issue. They are thinking in that way. But it will not work. People are against big immigration numbers but they will not oppose moderate immigration increase. But American people are divided when it comes to illegal immigration. If any other issue is burning then immigration will become non issue and democrats will not get any extra votes because of CIR. But liberal immigration is not good for Labor unions(we know democrats are pro-labor also) so that may work against Democrats. Right now it is not sure whether parties are really dedicated to pass CIR or Just for making immigration alive to get political mileage.
We all come to this site and give our interpretation of the situation, but the whole situation is so funny isnt it.
A writes something then b responds, c comes in an says something but the finally nothing is achieved.
The congressmen do what they want, our effort of conversation is useless.
We should come together and raise our voice somewhere were it can be heard.
I dont think by sending emails to these congressmen about our situation will be that effective, most of them dont know or dont care. We should come out onto the constitution ave in DC and let our voice be heard by the masses, then the media will know, the common man will know, the companies will know, the congressmen will know, this will also help the lobbyists to fight for our reforms who benefit more than us.
I joined recently but I am sorry to say that by donations from people, a few people IV core cannot lobby our issues. There are lot of us who are suffering, even 200 people on washington ave will effect. Slowly more will join,
I hope

Friends I think a great injustice is being done to NSC filers , their applications are taking months for ead and ap, while TSC filers are getting ead adn AP as soon as they get receipt, do you think this will improve for NSC in future, at this time looks like august NSC filers will haveto wait till the end of the year for EAD,ap, which is sad.

IV has been endorsed by Dr Vijay N Koli, President of American Association of Physicians of Indian Origin! http://www.aapiusa.org/index.aspx
American Association of Physicians of Indian Origin (AAPI) is a national organization. Founded in 1981 by a handful physicians, from its humble beginning now AAPI has emerged as premiere ethnic medical organization in the US. Today it represents more than 41,000 + physicians of Indian Origin in the US and 10,000 medical students, residents and fellows in training. Its mission is to provide forum to facilitate and enable Indian American Physicians, to excel in patient care, teaching and research and to pursue their aspirations in professional and community affairs. Its motto is Unity of Purpose, Collegiality in Action, Commitment to Excellence and compassion towards Fellow-beings. To bring to American medicine the distinctive contributions from India. Headquartered in Chicago it serves as an umbrella organization to 130 component associations.
Its legislative office in Washington D.C. coordinates advocacy efforts and has been a strong voice in the healthcare policies and legislation. Through AAPI Charitable Foundation, AAPI members support and promote philanthropic activities in India and in the US. The distinguished faculty offers medical education programs throughout year.
AAPI, under the able leadership of Dr Koli and its Legislative Director, Anurag Varma, have been helping us behind the scenes. With acceptance of this Advisory Role Dr Koli has chosen to formalize this relationship.
Dr Koli is an Internal Medicine physician who has been in practice for over 27 years in San Antonio, TX and who has ably led AAPI on some fresh initiatives. One of these involves AAPI formally providing expertise to the Indian Government in healthcare this was formally acknowledged by the Prime Minister of India as one of the great initiatives at the latest Pravasi Bharatia Divas.
Our cause is strengthened by Dr Koli and AAPI & their blessings!

Last year there were not unused visas.
Worldwide Employment-Based preference limit: 147,148
Actual number of EB visas issued: 154,458
Check Immigrant visas FY 2007 (http://www.travel.state.gov/pdf/FY07AnnualReportTableV.pdf)
That is true. but it only happened because of the aggressive Visa Date setting of DOS and hence the Visa Fiasco..
I dont think you can expect something similar this year

I agree. This is a good idea.
In these tough times we will allow people to create threads in this section to post their qualifications and also to post if they have any leads.
Let us try to help each other.
We have also started a social networking groups called 'IV Job networking' http://immigrationvoice.org/forum/group.php?groupid=1
You can also use that area to make friends.
Send me a PM if you have any ideas how we can improve our site to accommodate this need of our members.

But even with primitive PD's if visa nos are not available, things will still be the same. What say abt 6 yr old pd's in EB2...namecheck removal doesn't help!!!
But atleast with PD of March 2001, I have some hope, esp mine is in NC presently.

Hi
I am in 7th year of H1b now..last time my h1b was renewed dates were until April 2008. I went to india in Dec 2006 and came back in Jan 2007. My passport was expiring on Sept 29th 2007 so Immigration officer dated my I-94 until sept 29th 2007 and told me same thing that you can go to any port of entery or international airport and meet USCIS officer and extend your I-94 with your new passport. I waited until last moment and around sept 24th I went to USCIS officer on airport as well as on Port of Entry (called Deffered Inspection site). Both places got answer you need to file extention online because we only correct mistakes and this is not a mistake but it was case of passport expiration. I called my lawyer, my hr, my company lawyer. Everyone told me I cant work after 29th sept as my i-94 is expiring. Thats same as your H1 expiring. SO either leave country and comeback with new stamping or file new h1b. I ended up filing new H1b as i had only couple of days left before my I-94 would have expired. I have filed I-485 and ead and my I-140 is pending. My pd is Dec 2003. As per my lawyer I want be out of status as mY I-485 is pending but I will loose eligibility to work as I wont have any work authorization once my I-94 expires and dont have EAD approved on my hand. I hope this helps you.

My wife changed her job after getting H1B transfer receipt. Her previous H1B is not expired or revoked. After one month with new employer, her H1B is denied. We didn't appeal, but immediately filed new H1B with another employer and give paystub of the denied employer with all details. She got her H1B approved with the latest employer. This happened 4 years back.
So, if H1B denied, you can file appeal or find a new job and file new petition ASAP.
Thank you for your information.I hope you know the situation right now in USA.In jan 2010 H1 people came to Newark Airport were asked to form in a separate queue as soon as they get down from the flight for two levels of interview. Some of them are sent back. Now you can't find employer to transfer your H1 immediately. Before two years it was possible to transfer H1 with out having recent pay stubs and they never asked client letter. Now if you don't have a job you can't transfer your H1 to anybody.
Before Sep 2009 it was two minutes time to take LCA. Now it takes 1 week time to approve LCA. We never heard about Employer-Employee relationship before 2010.

Uma001,
My previous to previous employment is 3.5 yrs for which they said nothing. RFE clearly mentions name of my last employer and says to submit proof with dates worked from-to, responsibilities and job details.

I totally agree, you should first have an RFE in hand and the decide if it is urgent or a simple one which one can handle.......... if URGENT then do search threads to see what solutions are stated, if none match your criteria then you are welcome to post on a new thread.
Without RFE in hand, you will only get unrelated answers, instead of giving you solace it will worry you more. Like people might suggest, your old employer may have revoked your petition or you might have done something wrong in filing for AC21 (IF you have done that)............... so let it just come and then decide.
Since this was your first RFE , do not worry. I believe all of us pass through this stage of RFE , now it may be at any stage. I too got mine on 140, but gotaway with it.
Relax you will be fine.

EndRetro,
If anyone from this group is visiting India in the near future, it might be helpful if you can arrange an audience with Ravi.....and make him aware of the concerns/issues..
What does the IV admin group have to say about this!?

Your BE degree will be considered equivalent to guys who have 12 + 4 from India. After all you have a fulltime 16 years education with same degree that 12+ 4 guys have. I think AMIE is getting the flak because its considered part time degree ( I know how difficult it is to manage job & AMIE studies) but that is how USCIS is interpreting it at the moment.
I have applied for I -140 (EB2) but I am with 10+Diploma(3 years) +Bachelors of Electronics from Mumbai Univerisity(3 years).
Is it considered 4 year degree and good for EB2 along with prior 5 years of experience?
Thanks

There are many possible explanations of why they are willing to make changes to accomodate the illegal immigrants.
off course its the vote bank politics but I think psycologically nobody is intimidated by ppl who come to US and are happy to do low-skilled work. They don't work in high-skilled or unionized jobs. They are largely employed by restaurant, cab-companies etc. These are jobs citizens really don't care for.
Whereas the job that H1 workers have... most ppl (in theory) would like to have them. It remains debatable how many native-born americans actually want to take hardcore technical jobs.

I am not saying we shud do anything forcefully. I am saying, that if we have to show IV's face as being multicultural and since we Have members from all over the world sharing ideas on here anyways, might as well show the media that aspect.
In my opinion, if general public/law makers see faces from all over the world complaining about the GC system, it would have more impact.
If a core member/moderator can comment on this, that would be greatly appreciated.

I guess you need to give them a little bit more time. Watch out for visa bulletins till the end of this year, maybe that will give us some pointers.
