I e-filed my AP recently.
I then sent my supporting documents to the address they gave. The interesting thing is that they actually give in the address - e-filed 1-131. This presumably passed the intial mailroom stuff.
I also got my receipt number instantly and the notice is mailed to me. It can also be tracked online.
Now I wait to see whether e-filing is quicker or not. Maybe not, the only thing I can say is that I got my receipt !

Well said, No one here is going to let go an opporturnity here, if one gets one. In my case, I did NOT go in search of one, and I did not get one. So waiting in line for years. that said, If I had got an option, I would have taken advantage of it. This guy does deserves his GC. Anyway, he/she has been here since 1997 and it is a long time too.
Lot of people have been around for a long time. Each of us have a story why our PD is not earlier. One thing is guaranteed - bulletin dates will not progress or progress very slowly as more and more labor substituters take away visa numbers.
Another thing - People from 2003/2004 are taking visa numbers. Almost 40% of EB-2 numbers were taken as of first week of Nov (as per latest bulletin). By end of Nov that number might well be 50%, 60%, or 70% - who knows.
It's going to be a loooong wait.

My I-140 was never approved..
there was a first RFE for my exp letters,
and then there was an enquiry against Employer
and then RFE for A2P
and after answering A@P it is denied.
while it was pending, during July07 fiasco we applied for I-485.

The following is an exactly parallel strategy for us. I just copied the lines.

There are 2 things that you need to do and take time..
1. Apply for FBI fingerprint clearance .. You can take fingerprints in your local sheriff's office on a standard FBI form and then send it to FBI.. takes about 2 months.
2. Apply and get IELTS english score.. I think this has become standard now..
I had attached all the literatures that had been published on Finance and technical journals. In addition, I had US education with Masters. Still, they asked me to appear for IELTS.
If you native language is not English, IELTS is must.

Please don't mistake BerkeleyBee's post. From the point of view of the core team, many posters have ideas that seem correct to them and they post 'This is my idea, why can't we do this?'. In plain language, that translates to 'Why can't the core team do this?'.
So from my point of view - simply as someone who has been posting for a long time in Usenet, newsgroups etc - if you have a good idea, implement it yourself. E.g., if you want a webfax that thanks Senators, write the webfax and post it. Sample webfaxes are available on the website, customize it and post it. The "core team" is human. We are balancing full time jobs with the web site and it would help if people making suggestions also implemented it.
In this idea that has been posted re: educating people in other countries, that is NOT part of IV's mission. IV's mission is clear: it is social service to people that want to get a green card. It is also social service to educate prospective immigrants about the delays in the GC process. However, that is not part of IV's mission. It can be part of Bkam's and Learning01's personal missions, however.

Got the status update email from USCIS stating a card has been issued for my 485 application.
I am not married yet. What are the implications if I get married to a citizen of india residing in India.
Kindly refer me to appropriate material if you know of any.

Surprised to see that you were unware of this. Getting GC is painful process as we all know. There are three situations
1) Don't file I-485 till you get married. Risk, you might have already used 6 years on H1.
2) File your I-485 and get quickly married , then you can add your spouse. Do a court marriage in US and later you can do a marriage ceremony in India.
3) File your I-485 and get green card with out having chance to add your spouse
Since you fall in category 3, your situation may be worst.
Couple of options
1) If the girl(or guy :)) is in US, absolutely no problem. Only thing is if girl is already in US, you will get lot of family pressure from girl side.Have to compromise on lots of things. May be will become a house husband.
2) Girl from India, now you have to find a really smart girl who can get admission to universities or pass TOFEL GRE etc with flying colors. Then long distance affair starts. Girl in city X studying guy in city Y. Meeting once in a month. Lossing lot of money on commute and mental peace.The girl will have now her own friend circle and over period of time she might start liking someone else. Based on real situations.
3) Move to Canada and apply for Canadian citizenship. That's easier to get and easier to bring spouse there. But again you won't be able to bring her to US
4) Wait for 5 years. Who will want to wait for you 5 years.
Best Option
Return to your home country and enjoy life there. Believe me you won't have never any regret in life. It's just not worth for all the pains and miseries it bring in one's life. GC : Grievance Card.

It is good idea. I discussed this my lawyer and according to him, nowadays USCIS is very strict about it and trying to match the requirements of EB2 against the candidate's credentials. If it perfectly matches only they will approve. It will be an option for those guys with EB3 with PD past 2005 and with enough EB2 credentials, primarily a masters degree and if it from US, then great.
Please do not go into this option just by stating that I have 100 years experience with such and such company. I will say, if your are a masters degree holder (from US the best) and is employed with a major employer for more than 3-5 years, then only attempt this. Do not try it if you are employed with some Desi company. This is harm both the candidate and the employer.

Actually CIR was started by President Bush to regain hs popularity. Other than that it is complicated and tough to pass thru. Really lawmakers have to work hard f they want to pass because it is tough to satisfy all. So most of them must be cautious unless it comes up for discusson. Moderate people may try to maintain status quo. If CIR is pendng then all the immigration related items including EB relief will be attached to it(People will try to attach so that it can be delayed as much possible). If Congress starts discussion on Jan 2007 possiblity of becoming law is on May if they introduce CIR. But immigration may not be that much national importance issue for US congress. It does not matter whether an illegal immigrant will become citzen on now or 2009. Economy will not have an impact. Similarly a H1 person gets gc now or 2009 or 2011 the impact will be mnimal for US but impact will be heavy for that immigrant. Also Economy may slow down n 2007 and job demand may go down then it is tough to justify increase of H1 when joblessness starts increase.
I think EB2 will improve much better in coming months and EB3 also PD will move at least a few weeks to few months. Atleast people could extend H1 after 6 years. In 1999 and 2000 people did not have that option and some people left USA and came back after year. So to get gc was challenging atleast for 50% of people for past 10 years. Some people got this easily some time in past.

I would say:

2. Because of 1 above, if you switch to the new employer USCIS would know you left the previous employer. (since you will file H1B transfer).
3. I see that you have everything worked out nicely from your current employer to have 180 days for your AC-21 portability. You have to really evaluate if it is really worth going to new employer in Dec 07. (if there is enormous financial gain like pre-IPO etc)
4. There is nothing wrong in switching jobs before 180 days either on EAD or H1B but in order to play safe the best bet is to, switch on H1B after 180 days. Enjoy your paid holidays and join the new employer in 2008 with peace of mind.

So far, so good.
I also have a job offer, and my new employer wants me to join them in Dec '07, on EAD. My question is: Can I be on officially on the payroll of two companies simultaneously on H-1B and/or EAD? If yes, do I need to inform the USCIS of my status (new employer; AC21)? My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. Please advise whether I'm fine with using the first option!!

My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. Please advise whether I'm fine with using the first option!!

I have recently moved out of state and started on a different job. I updated my address with USCIS online last week. I just got a email from CRIS for RFE. I have I-140 has been approved since 2004 and applied for I-485 in July 07. My lawyer is from Frogman firm. This was the firm used by my GC sponsor employer. My new position is slight different from Software Developer to Lead System Analyst. I think this should be covered with same or similar clause.

I have to agree with Tito.. I too thought the DREAM Act would benefit my son who is soon to be in College.. the more I look at it, I am forced to get an impression that the Act is intended to ONLY help the children whose parents are illegal immigrants....

(i) In general.-Any alien who, by fraud or willfully misrepresenting a material fact, seeks to procure (or has sought to procure or has procured) a visa, other documentation, or admission into the United States or other benefit provided under this Act is inadmissible.
You can petition for waiver:
Quoting INA Sec. 212(6)(i)
(i) Admission of immigrant inadmissible for fraud or willful misrepresentation of material fact
(1) The Attorney General may, in the discretion of the Attorney General, waive the application of clause (i) of subsection (a)(6)(C) of this section in the case of an immigrant who is the spouse, son, or daughter of a United States citizen or of an alien lawfully admitted for permanent residence if it is established to the satisfaction of the Attorney General that the refusal of admission to the United States of such immigrant alien would result in extreme hardship to the citizen or lawfully resident spouse or parent of such an alien or, in the case of an alien granted classification under clause (iii) or (iv) of section 1154 (a)(1)(A) of this title or clause (ii) or (iii) of section 1154 (a)(1)(B) of this title, the alien demonstrates extreme hardship to the alien or the alien�s United States citizen, lawful permanent resident, or qualified alien parent or child.
(2) No court shall have jurisdiction to review a decision or action of the Attorney General regarding a waiver under paragraph (1).
