IMHO "legally" exploiting the system is illegal. I don't blame the system because any system will have some flaws in them. I would rather blame people who take advantage of situations esp in scenarios like this. We all know how much time some people has waited here. We heard a story on Monday right? Have we already forgot that? IV's goals and objectives are clear on its home page. Here comes the OP, registers himself and comes up with his first post of Labor substitution and how to better himself. I don't see any thing wrong in pete getting fired up. This exact attitude is the result of 6500 members and not 25,000 or what ever.

If I was judging you I would have concluded that you support what the OP is doing and wouldn't asked you what your stand is. It depends on how you understand what I said. Those NASDAQ listed companies you were referring to might have substituted labors but I am sure they wouldn't charge X dollars for giving a better PD or deduct from payroll under some other miscellaneous stuff. I am aware of what you are talking and what OP is talking and they are not the same. I don't need to explicitly tell how desi shops work with
pre-approved labor, esp in the current situation.

But, Mpadapa has some reality. That's what we are seeing in last 3 - 4 bulletins. A slow but steady movement.
Atleast with current movement we can plan in what period we can expect our case will clear.

Your case is a bit different, I am not sure if you could avoid paying back as GC process is for your benefit so a company could request a pay-back, even though amount is a bit high and you did not get anything in return. I would compare it to a situation where company gives an employee a laptop and expect person to return it when s/he leaves a company.
helloh1's clause is different - company receives benefits by training its employees so it's just plain wrong to request a pay back in that case.
So just forget about it and move on, we all make mistakes and here in the US those mistakes usually cost money.

I am not sure if this is the trend everywhere only in TX. The DPS - Department of public Safety which is issuing Driving License started asking for the Employment Verification or latest Pay Slip. I asked the officer if its the new requirement and she replied Yes, its started recently. If you are in H1 or H4 visa, you need to prove that you are still in job and getting paid. One more nail in the coffin.

This thread seems to express my thoughts.
I used to wait till my dates got current. With my dates being current since November, I still wait with no sign of improvement.
I tried calling the 1-800 number. But, did not get any useful information.
Took an Infopass appointment couple of weeks back. But, it was of no use.
The officer at the local office read the same status that I see online.
She said that my case was transfered to Texas center. (I knew this since October 2007). Only additional information she gave me was that my namecheck got clreared. (Though this is important, I dont think this really matters to get my case processed).
I told her that I have been waiting since years and some of friends who filed later than me already got their GCs, she felt sorry for me but she said there is nothing she can do for me. Not even a Service Request since my dates are within the processing times.
Its getting difficult for me......Also, in this economy its getting tough everyday to hold on to the job. Who knows may be this year quota might be over too. It will definitely be a big relief if we get the GC.

Hi everyone,
I reviewed the text of the bill...and, to the best of my understanding, the Dream Act applies to both legal and illegal children. This bill is crucial for me. I am 27 years old and have been in the United States since age 1 (Yes, 26 years)...LEGALLY!!! My husband (i married another visa holder and changed my status about 5 years ago) and I have been pending for a greencard for about 2.5 years now (I'm not counting the other failed attempts)...and still no luck. I completed my bachelors degree in Psychology years ago and cannot work (my field of study is fairly common in the US...nobody I've come across was willing to sponsor for an h-1). Unfortunately, going back to my "home" county isn't an option for me because this is the only home I've ever known. Anyhow, I would really appreciate everyone's support...hopefully this piece of legislation can benefit people like myself and we can contribute to society as well. Thanks!! :)

to address the comments above: sure we are all for the kids of illegal workers, but we would like to see the same benefits at least be provided to those who play by the rules....the above story is an excellent example of this.

Its useless... How many senators, their voters or other decision makers watch those kannada, telugu or even rediff???
Try to contact FOX, CNN, ABC etc.. that will be helpfull.
It is for all those people (the indian diaspora) who do log on to the online versions of their hometown newspapers to check local Indian news, it might be a pleasant surprise to see the news abt the rally out there!!!

The Bush administration will propose nearly doubling the fee charged applicants for U.S. citizenship and significantly increasing fees for other immigration benefits, congressional and administration officials said Tuesday.
Fees for a wide variety of immigration services would rise an average of 66 percent, said two government officials who did not want to be named in advance of the administration's formal announcement of the proposal Wednesday.
The current fee of $330 to apply for citizenship would rise to slightly less than $600, an administration official said. Other fee increases are possible for green cards conveying legal residency, which now cost $325.
Applicants also now pay a $70 fingerprinting fee in each case. Fees also are paid for things such as work permits, replacing lost green cards and petitions to adopt orphans from other countries.
The proposed fee increases would not be final until after a public comment period.
Congressional Democrats last week warned in a letter to Emilio Gonzalez, director of the Homeland Security Department's Citizenship and Immigration Services, that they planned to review the agency's analyses behind any proposed immigration fee increases.
The letter was signed by Senate Judiciary Committee Chairman Patrick Leahy, D-Vt., immigration subcommittee chairman Sen. Edward Kennedy, D-Mass., House Judiciary Committee Chairman John Conyers, D-Mich., and immigration subcommittee chairwoman Rep. Zoe Lofgren, D-Calif.
Immigration advocates have been bracing for the expected jump in fees. William Ramos, Washington director for the National Association of Latino Elected and Appointed Officials, said the increases are "just going to be devastating to our communities."
"It will basically create another obstacle for those who want to realize their dream of becoming American citizens," Ramos said.
Citizenship and Immigration Services covers its costs with application fees. The agency is required to do a fee analysis every two years to determine whether money raised from fees is covering costs. The agency last raised its fees in 2004, citing the cost of more intense background checks in the wake of the Sept. 11, 2001, terrorist attacks.
Immigrant advocates long have argued that the agency's costs cannot be absorbed by application fees. They want Congress to appropriate money to help pay costs.
Large fee increases would be heavily felt in the Asian community, where two-thirds of the population in the U.S. is foreign-born, said Traci Hong, director of the immigration program for the Asian American Justice Center.
About 70 percent of foreign-born Asians in the country become American citizens, a high rate for immigrants. Hong worried that higher naturalization fees would slow that rate.
Also I heard a rumor that they are going to allow filing of i-485 for review first and then let you wait for the visa number. Hope it is true!

I believe Mbhai did a dis-service by negating good advice. What is the guarantee that the 2nd women that this guy marries will not ask for divorce? The best thing he can do is find a way to reconcile, unless there is marital infidility.

No way CIR or any form of amnesty for illegal will happen in the next few year.
Immigration is one thing where majority of Americans are united in controlling illegal population.
It can pass Senate but House it will never pass.
Moment CIR comes up, the right wing will arouse the masses. House members focus on more
local issues and in many districts people don't want illegal amnesty or CIR. They want a crackdown.
Democratic members in the House will never pass CIR against a Republican opposition otherwise they will pay a heavy price in the election.
In fact democratic party was able to get the house by selecting conservation candidates in the
conservative districts. That is was the Howard dean/Rahm Emanuel strategy. Select candidates who can win rather than candidates who are steadfast with core democratic party principles.
Thus you have democratic party members like Jim Webb who are ardent supporters of the NRA
(pro guns) in a state like Virginia.

I did post about this. We have seen professor's expert opinion letters showing the equivalency to the MA being approved. However, the evidence does point to an equivalency to a BA.

Meet your Legislators:
Immigration Voice plans to organize a nationwide meet-the-lawmaker drives in every state and every district. Two of our volunteers � Varsha and Sanjay � would be helping us to organize this. If you would like to meet with your lawmakers during this recess, then please email Varsha and Sanjay at varsha@immigrationvoice.org and sanjay@immigrationvoice.org respectively and simply put �Need Meeting Info� in the subject line of Email. They will send you all the information that you need on seeking the appointment, taking the right material with you, making a good case for reform and doing the follow-ups if necessary.
Feel free to ask Varsha and Sanjay for any other questions that you have. They have met with their Congressmen and Senators a few times and they would be glad to help you do the same thing in your state and district.
A Perfect Opportunity:
This is the perfect time to meet the lawmakers, as they would be in their constituencies just before they go back to work on Immigration this spring and summer. In order to capitalize on this opportunity, it is very important that everyone meet with his or her legislators locally during this Easter recess of Congress. The members of the House will be in their districts between 2nd April and 13th April. The members of the Senate will be in their states between 2nd April and 9th April.
Please use the time between now and the Easter recess to seek appointments to meet with your Congressmen and Senators in order to draw their attention on the need for reform in high-skills immigration.

My manager surprised me today saying that I was promoted yesterday from a programmer analyst to a systems analyst. I have an approved i-140 and have filed my 485. My priority date for EB3 is current. I also have a 3 year extension of H1B.
There is no change in the job responsibilities.
Question:
1. How soon should I file my AC21 request?
2. What is the impact of this promotion on my H1B?
3. I have waited for 7 years and I may be close to getting my Green Card. How does the AC 21 impact my pending 485?
I declined my promotion. My manager said that it would take a lot of effort to unwind this promotion. He was not pleased with my request.
Any ideas?

I am July 2 filer...
I mailed second set yesterday...
Then I thaught I mailed to Nebraska address then I mailed my third set to Texas center, dont want to take any chance whichever will be accecpted first.
I am smart...;)
It is not late now.
You may send one to California Service center, one to Vermont Service center and the final one to National Support center.
I am sure you will get at least one Receipt number. :D :D
