    Here is my dilemma--

    MY INFO---
    Occupation -- Physician
    EB2, INDIA, PD APR 2006, EAD renewed till sept 2010, H1 valid till feb 2010 (non-profit company), I-140 approved, I-485 filed July 2007

    I have a very good job offer and I really want to get out of my present job. They expexct me to start work next year in about apr 2008-- The new job is not in my present state but I am freaked out about using AC 21 for following reasons:

    -New company has no clue about H1 and they cannot file H1 any way because they are "for profit" and my h1 is presently from non profit and the QUOTA is now over. My occupation still remains same -(I am a physician ---no way to change occupation -- still have to do same job !)

    -New company can only give me a generic letter for employment (EVL) ---
    "To whomsoever ---etc..it may concern..and only briefly describing my title and job description"

    --- My questions to respected IV members

    1) should I invoke Ac 21 ??-- I am worried that the EVL may not meet USCIS needs as it may not be fully detailed

    2) The other option I have is to take a leave of absence from my present company for one year and start working for the new company? IN this case what happens if I get RFE for EVL ? Which company should I say I am working for present or the future ? Also If I do take a leave of absence should I send in AC 21 paperwork or no?

    PLEASE HELP I am very confused--- I strongly feel that the leave of absence might be an insurance policy but I don't know how to approach it !!

    Salient features of Bill: S.1085

    After analyzing this bill, I found the following:

    1. This bill will recapture all those unused employment based visas (gcs) from 1997 till 2008 and it will add those recaptured visas to this year's employment based quota.

    2. After the passage of this bill, any unused visas will rollover to the next year. So, no more wastage of visas as we go forward.

    3. Per country limit will be increased from 7% to 10%, so more folks from over subscribed countries would be able to come under the normal yearly quota.

    4. We will be able to avail the benefits of the recapture after 60 days of the passage of the bill. That means, if they are able to recapture 220,000 (approx) employment based visas, the employment based category will be able to use all those after 60 days of the passage of this bill. USCIS is pre-adjudicating all I485s pending and if this bill gets passed in say for eg by October 30, almost all (80%) in this community (who filed 485) would be able get their GCs in Jan and Feb of 2010.


    What makes this bill much more interesting is:

    1. This is not a bill targetting the issues of Employment based category - So there won't be a huge backlash against this in the name of the economy and recession. The provisions for the employment category are just one item in this bill.

    2. Family based immigration reform has a wider range of support from all kinds of groups unlike Employment based immigration reform. Just search for this bill "Reuniting Families Act" in google news and you can identify all those organizations supporting this bill (they all have a news release).

    This hits the nail on the head. We need to do a reality check on our side as well. I have been extremely embarassed by my fellow desis stinking to the core and digging their noses in meetings.

    I've also had the extreme embarassment of being asked by a fellow non-Indian colleague as to why most 'male' desis didn't believe in taking a shower and washing their clothes.

    Another point raised was why some ladies wore anklets in the office. The sound of anklets does bother me too since it truly distracts one's attention. I understand there is a cultural tradition involved here but we need to assimilate as much as possible especially in the work environment.

    Sometimes, unfortunately such things take away the attention from our real skills which are our brains and smart work.
    We need to maintain proper hygiene and courtesy everywhere, even at home.

    Employment Third Preference Other Workers Category: Section 203(e) of the NACARA, as amended by Section 1(e) of Pub. L. 105-139, provides that once the Employment Third Preference Other Worker (EW) cut-off date has reached the priority date of the latest EW petition approved prior to November 19, 1997, the 10,000 EW numbers available for a fiscal year are to be reduced by up to 5,000 annually beginning in the following fiscal year. This reduction is to be made for as long as necessary to offset adjustments under the NACARA program. Since the EW cut-off date reached November 19, 1997 during Fiscal Year 2001, the reduction in the EW annual limit to 5,000 began in Fiscal Year 2002.

    B. DIVERSITY IMMIGRANT (DV) CATEGORY

    Section 203(c) of the Immigration and Nationality Act provides a maximum of up to 55,000 immigrant visas each fiscal year to permit immigration opportunities for persons from countries other than the principal sources of current immigration to the United States. The Nicaraguan and Central American Relief Act (NACARA) passed by Congress in November 1997 stipulates that beginning with DV-99, and for as long as necessary, up to 5,000 of the 55,000 annually-allocated diversity visas will be made available for use under the NACARA program. This reduction has resulted in the DV-2011 annual limit being reduced to 50,000. DV visas are divided among six geographic regions. No one country can receive more than seven percent of the available diversity visas in any one year.

    For April, immigrant numbers in the DV category are available to qualified DV-2011 applicants chargeable to all regions/eligible countries as follows. When an allocation cut-off number is shown, visas are available only for applicants with DV regional lottery rank numbers BELOW the specified allocation cut-off number:

    I think we should call and tell them that highly skilled legal immigrants are working for long time and the jobs are granted because there is a shortage of highly skilled immigrants in US. We are waiting just because of the inefficiency of USCIS.

    This legislation is similar to the measure that Sen. Robert Menendez (D-N.J.) used before Summer recess to hijack debate on E-Verify reauthorization. The bill�s sponsor, Immigration Subcommittee Chairman Zoe Lofgren (D-Calif), claims it would �recapture unused employer-sponsored visas� from as far back as 1991 and then add them to the current numerical cap of 140,000 employer-sponsored visas that are available each year. Current law, however, clearly states that any employer-sponsored visas not used in one year are allocated to the family-preference categories in the following year. That means that there are no �unused� visas from past years to �recapture.�

    Moreover, these extra green cards would be for foreign workers to take engineering jobs, health care jobs, construction jobs, manufacturing jobs and just about every other job that Americans have been losing in this economy. In order to qualify, a foreign worker doesn't need more than 2 years of on-the-job training � and they aren't even required to have a high school diploma. Our country doesn't need these workers - our workers need these jobs!

    * No. 1: Go around Sen.Menendez who has a "hold" on H.R. 6633, the "clean" E-Verify re-authorization bill passed by the House. Sen. Reid can bring this back-room filibuster to the Senate floor for a vote. If he does this, there easily will be the 60 votes necessary to stop Menendez and allow an overwhelming majority vote to pass H.R. 6633. (Reid reportedly doesn't want to do this because he doesn't want to force some of his Democrats to have to go on record just before the election.)
    * No. 2: Avoid a vote altogether by talking to Menendez privately, persuading him that what he is doing is threatening the reputation of the Democratic Party just before elections and get him to withdraw his "hold" on H.R. 6633. (This way, Reid could then bring H.R. 6633 to the floor in the "hot-wire" fashion which will pass by voice vote.)

    Either way, the American worker and public wins. It is all about Reid doing one of those two things.

    SEN. MENENDEZ' E-VERIFY BLACKMAIL DEAL

    After we told you that some Republican Senate staffers were working with Sen. Menendez (D-N.J.) for massive increases in foreign workers, you hammered Republican offices for not holding the line for a "clean" E-Verify bill.

    Your efforts really worked. By the end of this last week, Republican Senate staffs were going into negotiations with Democrats and making it clear they were united in oppositiion to a foreign-worker surge at this time of 5-year-high unemployment and financial industry collapse.

    Sen. Menendez apparently is not bothered by the 5-year-high official unemployment rate -- or even by the 292,000 additional American workers who went on unemployment in August alone.     I got an e mail from customer service this morning stating they had forwarded my letter to upper management.


    It(this issue) definitely got to their attention loud and clear, and hopefully it will have an impact of both sensitizing them to this separation in the future as well as prompting them to give our issue more coverage going forward.     Democrat majority in House; and evenly split Senate (2 seats are still at stake which will decide who is in control; democrats seems to have majority in both of them). Wow this is good and hopefully great for us.

    More than winning control, the list of people who lost (or almost lost) in senate/house shows that majority of Americans are not as against on immigration issues as some media people project very often. Of course the main issues of this election are different; but some of the lost candidates made a big issue out of immigration and hoped that would get them elected. Well�they are wrong.

    I was just listening to NPR about a discussion on Bush and how he/his administration would deal with these election reversals. One of the analysts was pointing out that this is in some way good for him and that he can push some of his measures more comfortably, the first one he mentioned is guest worker / CIR. The logic is, since majority of democrats are in favor of that measure and even the new senate will be comfortably in favor; he can push for the guest worker program. In fact this measure might be used to make friends with both houses and to divert some extended attention to war. I liked his analysis and hope that it will come true :) .

    As logiclife pointed above, CIR may be too controversial even with democrat leading house. They have a different set of agenda and might push the immigration issues to the back burner. Lets hope that some less controversial bill like SKIL will be taken up soon.

    One question for the experts: CIR was passed in the old senate but was not reconciled with house. Can this bill be taken up again or is it already considered dead. My understanding is the bill has to be discussed / voted again in both senate and house (assuming majority leader set this on agenda). Is that true? Instead can the house majority leader now decide to reconcile with CIR already passed in senate.

    Best way is some of the provisions in Durbin bill to restrict some abuse. Only bad thing in Durbin bill is it is banning consulting with H1bs. Other than this provision everything is good. Instead of opposing the entire bill it is better to oppose only that section.

    You have no clue about the implication of Durin bill but you seem to think that your tunnel vision is the wisdom of the gospel, the entirety of all solutions to all the problems.

    Do you take your child to graveyard when your child is sick? Or do you take your child to a doctor? Durbin Grassley bill is taking H-1B program to the graveyard. But that's ok, let's all subscribe to your tunnel vision and support Durin bill..... If that passes, within one year you will come back to some forum and say that this is the worst thing to happen for this community. But again, that's ok, lets all use this.... The Tunnel Vision.
