It is nothing to do against EB3 or EB2. The visa spillover suggests that the overflowing visas be issued to the most critically retrogressed queue (upon satisfaction of per country limits). Does it help Eb3 or EB2? Both, whenever there is a longer queue, that line is able to move forward.

    Right now it is EB3 which is reeling under the incorrect implementation, and EB3s want to see it rectified, while the EB2ers demand Unity (knowing well that they stand to lose -- what was never theirs), I would not be surprised that EB2 raise the loudest voice of action (and no talks about unity) had the tables been turned.

    As per the current guidelines adjudicating officer makes the determination based on Department of Labor SOC/O*net code in the Labror Certification Application (ETA 9098) form.     This is the website IOs are supposed to be using (as per guidelines). Becoming a Sr. Software Engineer from Software Engineer shouldn't be an issue. Salary hike beyond 50% could (or could not) be a problem based on the IOs sole discretion. 50% is just a ball-park assumed by most immigration attorneys. In reality, there is no such preset limit. It's entirely upto the IOs decision.

    Promotion as manager is a tricky situation, as Job description changes. IO may consider it 'same or similar', or consider it altogether different. In such cases it may be possible to prove the jobs are similar by obtaining an 'Expert Opinion Letter' from an expert in the field ( such as a Professor of Computer Science from a University).


    How do Promotions impact one's existing GC application?

    for example: one filed for the GC as a Software Engineer, 5 years down the road one switches to a different company in the same area/location using EAD (avoiding AC21 for now) and the salary is 30 % higher than that was mentioned on one's LC filing and the job title is sr software engineer (same or similar responsibilities, senior title). How would something like this impact one's GC application?

    I also wonder what would happen to the GC application if one was to get another promotion and become a manager with even a higher salary (some job responsibilities stay the same and some new managerial responsibilites get added).

    I am sure many of us would have faced this since clearly many of us have been waiting for many many years - I would really appreciate your input on this. Thanks!

    No offense taken. I would be bemused too, if I didn't understand the process.

    I don't think many people understand that visa allocations for documentarily-qualified applications are actually made at the time a bulletin is released.
    And even otherwise, if they worked on July 1st, my PD WAS CURRENT on July 1st, and a visa may have been allotted on July 1st.

    No, there is old Child Protection Act and it protects from aging out while I-140 is in process. So child age is determined as age on time of filing I-485 (that means that visa is immediately available) minus time that I-140 was pending with USCIS.

    My situation is as follows - My I-140 is approved and judging by the current situation my child will be above 21years (currently on H4) when visa becomes available.

    Hi in case of emergency also one can go to nearest USCIS center and request for AP. I consider this as an emergency also. Request for an urgent AP and they can generate one in less than a week. I think then all of you can go and get wedding cert from India.

    I still think...that by being here you can do the following:

    1. See if your marriage was registered. If yes then you can get cert from ADM there. If not then tell the ADM office to write on official letter head that both of you got married but marriage was not registered.
    2. Also in that case get affidavits from your parents and her parents mentioning the date, day, place of marriage. These will be 4 affidavits. They also should mention that they did not register the marriage at that time.
    3. See if you have photos. Get them scanned and take a colored print and get it notarized from magistrate there in India or here.

    send all of these to USCIS and you should be done man. I dont think you need to go to India. But again check with lawyer also.

    We cannot predict the future but we can predict with some given statistics!
    If people who got their AP from NSC could just menion how long it took for them to receive ap document it would be statistical and we can there upon make some judgements !!
    Noone is asking for exact dates from USCIS. We are all still very much in a limbo and this is just for getting some heads up!!

    TSC is taking about three months. Mine took three months and I applied on July 2nd to TSC. So, my guess is statistically, at least 3+ months for NSC, since they will be concentrating on sending out EAD's.
    But, I leave it to others to give specific numbers.

    I totlaly agree with this. I am single too with PD DEC 2006. I have been in present job for almost 4 years. I ended up working for a non-profit oragnization on a non-cap H1b, which prevents me from transfering to private companies which need caped h1b( i din't knew about this when I took up the non-profit organization job). The only way for me to get into private company is to get a new H1b under cap which starts from Oct 2008. This time I planned properly and got an H1b approved. But to my shock and surprise EB2 dates moved to June 2006. I am now carefully watching the September EB2 dates. If it gets closer to Dec..I need to pull back the 485 as I don't think I can get marreid within 6 months due to family responsibality back home. If I withdraw my 485 application, I will lose the queue, money and since I plan to change job, the only benift I will be taking with me , is the PD date which I can later transfer if my next empyer does my GC. With a 2.5 year h1b left, I am hoping under worst situation, my next emplyer will sponcer my GC. This whole GC process is a pain in ***...!!!!

    P.S. I am not connected with the company, but I know people who worked in that company for years.

    I know of a company which will keep $2 + 10% for payroll taxes. A lot better than the one above.
    There is so much competetion in this space that people have reduced their margins to next to nothing.

    I e-filed my AP recently.

    I then sent my supporting documents to the address they gave. The interesting thing is that they actually give in the address - e-filed 1-131. This presumably passed the intial mailroom stuff.
    I also got my receipt number instantly and the notice is mailed to me. It can also be tracked online.
    Now I wait to see whether e-filing is quicker or not. Maybe not, the only thing I can say is that I got my receipt !

    Update:
    The Doctor admitted his mistake.
    He completely forgot to mark the TB test earlier.
    He was ready to back date to avoid more inconveniance to me.
    But I told him to be sincere in all aspects.
    I basically forced him to give my wife a TB test again and also the x-ray.
    Now the plan is to submit all this information with a nice letter which states that the doctor had forgotten things last time etc etc.
    Hopefully they will mark the case as - resume processing.

    If I were you, I would not have gone with the repeat of X-ray test unless it was absolutely necessary. X-ray are very harmful to the human cells and tissues. It was a ( Probably honest) mistake by the doctor who was going to give the correct report...and you forced him to take the x-ray again!! hmmmmm....I have nothing more to say.
