I just wanted update this thread with my experience. Could be helpful to people like me who searched many forums frantically. I have 10th year h1b extension valid upto 2010. Instead of going for stamping at US consulate in India, I decided to use advance parole. Most troubling thing about my history was that I had one dwi (Driving While Intoxicated with Alcohol) offense. It is not a deportable offense. However, I was concerned that it would show up at port of entry and they could ask me to go back for consulate processing. I kept all my case related court documents handy. This is very important for anyone travelling with dwi or other serious charges against them.
Officer directed me to the secondary inspection. Another officer there entered my information into the computer and after making gazillion keystrokes, he stamped my advance parole document/I-94 with 1 year validity. I got up from the chair when he called my name, walked upto his counter and took my documents from him. NO QUESTIONS ASKED. NO BIOMETRICS.

Not entirely true, I switched job a couple of months ago - filed for AC21. I got an acknowledgment from USCIS for the same - stating that it will be added to my file, to be reviewed when my application is processed.
Then you are a special case to USCIS. In my whole "GC career", you are the first case I am hearing about having AC21 related notification from USCIS.
Chandu's comments are entirely truthful and your case is the special one as USCIS really does not have any sysem to account or to notify related with AC21 usage.

Applied for EAD extension on July 18-2008 (expiring on Sep, 2008), less than 90 days. Today (Aug 15, 2008) received an email saying "Current Status: Card production ordered." for self and wife. No idea whether it is 1 year or 2 year extension. APs are still spending.

My company lawyer addressed this part. The way it works is that they will work on your file only when your PD is current. So even if you apply now, they most likely wont work on it after July as your PD wont be current. Then when next time (say in Jan 2008) when your PD becomes current, they will pick up all the files for that month and start working on it. It might be that they will work on your file on Jan1st or Jan 31st. You can send your wife AOS the moment your PD becomes current. So you want to make sure that it reaches there before they approve your AOS. In case you are extremely unlucky, then they would start working on your file on 1st day of the month and finish it before end of that day, making it impossible for your wife's application to go through. Thats rare though. So if you can make sure that her app reaches on 1st day of the month in which PD is current, then they should most likely add her to your AOS and work on those together and make your life go forward....its a chance which you will be taking...But again life is a chance

It will only make it worse when one had already applied for I-485 coz you could only get 1 year extensions as opposed to 3 years when you have an approved I-140 and have not filed for 485. I mean, if I don't apply for AOS now, I am assured that me and my spouse can file together when PD becomes current and they will approve ONLY if my PD is current. Isn't that right? That could be five years away, but, my spouse will be able to piggyback on my GC processing.

If point sysem is introduced the big losers are immigration lawyers as they cannot make money in multiple stages. So no wonder if they oppose. Of course there is some limitations but its sucess depends on rules and regulations. Also there is going to be a Cap and there is going to be a provision to prevent displacement of US workers as the worldwide demand is always here. But main advantage is it will bring down the work load of various agencies like DOL and INS also employers.

Please do not misinterpret IV.
If tomorrow there is a bill to stop all H1B from coming to USA or to make life difficult for H1B, do you really think we will keep quiet just because we have filed our greencards?
Do you know IV worked hard for decoupling of H4 time from H1 in 2006 and we thought nothing may happen and started to focus on next action item. Then few months later it was changed. That was the first small step.
I would appreciate if you ask your spouse if she/he can volunteer time for IV. You both can get more involved. Send us an email if you are interested. We are always interested in people who can volunteer more time than us (We do full time jobs too. A couple of us also are enrolled in a part time degree program). We are willing to have such an H4 be a leader in IV.
IV is a platform that will allow you voice your plight. But you will need to come forward and be willing to actively work on it with others. If the strategy is right, you are committed and have right intentions there is no reason why IV will not help.

What do you mean by priority dates were added?
Until Dec.2004, all EB categories were 'Current', but in Jan.2005 the EB3(IN/CH/PH) dates retrogressed to 1st Jan.2002. I believe this is what Coopheal is trying to convey. Not 'Addition', not 'Introduction', but just 'Retrogression' :-)

I only came to know about USINPAC recently with this flowergate.
And i don't know about USINPAC mission or robinder.
But, if USINPAC is such a great organization, then IV and USINPAC should sit together and support each other.

I have citizenship already. I am just waiting for GC:)
My parents are getting old. I am going back in 3 years. Heard from friends, earn enough and go. There will never be enough.
Almost, all of us started here from Nothing. Now we have atleast something to start with. Yes there is always things for Pros and Cons.
I am not worried about GC. Waiting for a good opportunity to jump back to India.
It will be really nice if I can get work from home job from US and settle down in a hill side with nice estate in India. :cool:

In trying to play the "devil's advocate", you still did not answer my question. i.e. "Let me ask you a simple question. What CAN be the "perceived benefit" from a rally like this that would make you think that it would be worth attending? Is it something like a guarantee for a GC in 2 months or a bill that passes next month that does everything we legals want? What is it?"

My first reaction. You're kidding, right! Ever worked in marketing/sales?? When you go to sell your product or service, you try to sell it from the point of view of the customer. In this case, what the benefit can be from the point of view of the US govt and US economy. Yes, our primary aim is to get our GC's in a reasonable time frame. The slogans and messages are in support of these ( By the way both happen to be true).
Incidentally, even the spark in Gandhi was ignited when he personally was insulted and thrown from a train. My point being that it is only when we personally are affected by an issue that we react to it. The reaction ofcourse differs based on our own individual character, personality and other traits.

just to take the "popular" Gandhian analogy a step further......There was Home Rule League and Congress in existence in India for a long time.....their objective was to petition the British Govt for small changes........and their ultimate goal was to get dominion status for india......only when Gandhi came on board plus supporters of other proactive forms of protest.....like Subhash Bose.....Tilak etc and the armed freedom struggle started (Bhagat Singh, Azad et al)......did Congress wake up and ask for "purna swaraj" (complete independence).......so from 1885 (founding of congress) to 1930 (Lahore Session of Congress when purna swaraj declaration was made) - nothing happened......british empire went from strength to strength.......then in 17 years - India got independence.......

That apart Prudential has a term life policy where you get back the complete premium paid under this policy at the end of the term�. say for a 30 year term you paid a total premium of 30K in 30 years,, at the end of 30 years if you are still alive you will get back the 30K..

Thanks Belmont for support, as explained in other thread for some guy who is beating me or people like us, it's a mistake/accident. It can happen with ones mistake or without mistake (Car accident).. Some one get caught and some one don't... as example I knew many people who steal/use office supplies in the company they work...

We all came here looking for greener pastures. But How many of you think this Country and this Culture is great ? Now think about the Economic Growth - The US is still the most competitive but they are not the Number One anymore.
Or maybe some of us came here precisely for the reasons you mention, seeking greener pastures but fell in love with the openness, informality and the possibilities here :).
A lot of people wait until they get green card and then make a move back home primarily because they are hedging their bets. They hear all those stories about growth and opportunity in India but are not so sure if they will able to fit in after staying away for so many years. Having a green card gives them the opportunity to test the waters so to speak and come back if it does not work out.

From reading all the testimonies , I didnot see any argument of unfairness to employment based immigrants.
Senate was interested in hearing the plight of a gay american citizen who could not live with his gay partner because his student visa was refused on reentry from Brazil and this gentleman couldnot sponsor him as a family member because the immigration act doesnt recognize gay partners as family members.
I suppose being a gay is going to be a much faster way to becoming a legal permanet resident rather than being a highly skilled indian immigrant.
