Based on one of the core member's request, I did the research and shared the information with IV members, so that when you get the GC, you could make informed decision.
Please be optimistic. You getting GC should not be a question of “if”, it should be a question of “when and how soon”.

I did read about a case long back in 19XX there was a brink mason who came here on an EB GC and worked for his original employer for just 1 day and switched the employer sued or may be the INS charged him (Not to clear on it) but the gist is that he got his GC and courts ruled in his favor because he showed that the work promised was not the one he was asked to do the conditions were different and hence he was not bound to work in those conditions.
BTW I think this is very relevant thread gave you some green. (Actually my green turned your status from Red to Green):D

Why don't you contact some senator! You have been current for so long ..
because USCIS is not even willing to talk if the Service center does not have processing dates current. And if my case is in California (which website says), then the processing dates are not current and have never been current and probably will not be current for a very long time. CSC does not process 485 applications at all.

I think what this is saying is that "other workers" can only use 10,000 of the spillover, and the rest will be for general EB3. Not the other way around as you have interpreted.
However, I am not disputing the rest of your post. If the job is there and you can prove EB2 qualification, go for porting.
If only USCIS releases stats regarding the applications in various stages,we can make accurate predictions. It borders on silliness that a government organization in the super power cannot accurately count it's work load.
That will atleast set expectations to people who are waiting and help them to plan their lives accordingly.

Same here switched jobs in April with approved 140 in EB3 and hoping to get in the EB2 line with earlier priority date and now have nothing with EB2 PERM in audit. Hope to keep the priority date atleast.....

It certainly seems like the RFE rate for supportive evidence has increased recently. Certainly for the 140 cases but also for other petitions as well. I had never received an RFE before, but recently got 2 for different petitions. An RFE always makes you a little antsy no matter how routine it is.
We are also hearing about PERM audits higher and denials also more frequently.
So far the RFEs seem to be for the common issues, like ability to pay, education qualifications etc.
It might be a good idea for someone to compile a list of typical RFEs at various stages. The rest of us can start adding for the benefit of those who get one in the future. In fact it might have been done already. I remember Logiclife putting something together during that 485 filing time in July/Aug.

i just havnt seen the benefits of it yet... for now ill just stick to flashing clients ;) lol (heh i say it like ive had hundreds already as well! :P )
so wuld u suggest i learn it if im to go into web designing or concentrate more on mastering Flash MX and Fireworks MX (and wen i eventually get it Dreamweaver MX) for now?

I am not here to discuss illegal immigration. I am here to discuss how we can put acceptable proposals out there so we can all get out of this mess, or at least get out of here a little faster !
Folks, allow me to tell you that we cannot succeed in this fight if our strategy remains wrong. By no means we shall find ourselves supporting what is against public opinion in our host country, which is now America. You guys from time to time, now what is called senior members from IV, pst phrases which may be PERCEIVED as an attempt to disguise the status of illegal aliens movement. Undocumented immigration simply doesn't exist. There are numerous ways one can find oneself without documents. I outlined an example before. "Immigrant" is not the correct designation if you never immigrated here. Start by showing our alignment with this country by using the correct term. We may be better accepted that way. By the way, wake up, is in major part thanks to the illegal aliens that many of us are stuck.
Tomorrow you can go to India as an immigrant. The day that you find yourself pushing for more immigration than Indians want, it is the day you will not be welcome in that lovely country anymore. Italy is a sweet country, but people are fed up with immigration there. How about France ? America is next. The lack of sympathy for immigration is in the air. Which are our chances to fight against it just because we conceal our proposals ? Minimal.

My status on USCIS Online case tracker shows,
"Current Status: Fingerprint fee rejected and notice mailed; case in suspense."
When I spoke with my attorney, he says, There are two options.
1. I can dispute and in turn get my processing delayed
2. Repay the fingerprint fees ($70) and forget about my first payment
Naturally, anyone would prefer option - 2.
Just wanted to share with you all...
Before I read the whole thing I thought why this guy is even thinking about it ... Know what I mean ...:) I read the whole thing and thought this guy is as smart as me ... hehe ...Good luck with everything

I heard that NSC is 45 days compliant in processing EAD. Is this true? I think it is not. Knowing NSC, it could take approximately 90 days +/- 30 days.

No response yet from WillIBLucky. Does any other member want to organize the call for this chapter? pls. go ahead. Members need to take active role in the state chapter and keep it alive. It is easy to give ideas and question others but is difficult to actually work for something. I urge chapter members to communicate with each other and organize a call.
