Same happened to us. The checks were cashed and we have even received the appointment notices for biometrics. My lawyer told me that there have been several cases lake this one. He is going to submit proof of the checks being cashed and copy of the notices to the USCIS.

If you want to elicit a response on retrogression, then you have to call their office and ask to speak with the person that deals with immigration issues and policy.
Or you can seek an appointment with that person and see what they have to say about this. Writing a letter will get you a generic form-letter response from a junior staffer whose job is to pick one of the 25 form-letter responses based on issue (Iraq, healthcare, immigration, veteran's affairs, crime, gun-control, abortion, judicial appointments, taxes, etc. etc. etc.) and slap your name/address and stick a postage stamp and mail it.
So, if you want to talk about immigration with them, call their office. Talk on phone or seek and appointment and meet them to elicit their position and educate them on retrogression.

eb3nepa & srikondoji, it is not just non Indians that not standup, there are close to quarter millions Indians in the queue who follow immigration news and who want things work but just do not want to standup. It could either be "fear" or "no care" attitude. It is true with immigrants from other countries too. Immigrants from all countries have a hidden fear, as it is not their country but a country they want to immigrate to and do not want to do anything that displeases the country. It is factual. Very few people actually have the guts to question.

my new 140 is file in april and is approved. got my EAD and AP. But no FP.
I also dont expect to get the GC so fast. its more of a red flag and concern what they are trying to look for.

I am still waiting. I created a SR and reply was to wait for biometrics. I am going to India in dec. Any recommendation on what to do if I still have not got the card?

I saw this on an anti immigrant site by a M*****r.
Hope some of you will learn a lesson from it and stop posting threads about Telgus, Eb3 vs Eb2.
I have also seen posts by ignorant educated illiterates on IV where they advice people to do illegal things. Some of you own consulting firms or businesses and try to promote it by posting and sending Private messages. If we see such message, let us give reds and report to IV. We also need to discourage people from answering wrong info to posts where someone is illegal/out of status. All this used against us.
They are right to be worried. The L-1 has more restrictions on it than the H-1B, because of a crackdown about 5-6 years ago (if memory serves). They were interpreting ANY IT skill as 'specialized knowledge' that would justify bringing in their folks, then shopping them out to displace ours. Even that notorious traitor, Harris Miller (former head of ITAA) warned them to cut it out, but Hindu hubris prevailed. Until the crackdown. There are two types of L-1 visa, one for managers and one for subject specialists.
One interesting thing: over on Immigration Voice and on any board that allows posts, as soon as we start nailing the problems of the H-1B visa, they start whining, 'what about the L-1' and 'what about the illegals from Mexico' (as in, go worry about them and leave us alone). When the seat gets really hot for them, then the internal ethnic and caste hostilities often start to show. 'It's those gultis' (Andhra Pradeshis), 'It's those gujjus' (Gujaratis), 'It's those greedy Banias' (large merchant class), 'It's the northerners (or southerners)' and so on and so forth.
Another interesting thing: In all the years that I've been watching Immigrationvoice.org, I've seen many situations where an H-1B has fallen out of status. Firing, layoff, botched job switch, etc. In only ONE case have I seen the advice be, "pack your bags." There are a million loopholes that Americans might be outraged to learn about. 8-9 years ago, the average American had no clue about guestworkers visas, but now they know something has gone very wrong in the job market.

No, you will still have to complete the requirement or else your 485 will be denied. There is no escape from waiver. :eek:
Always remember that a J1 visa is a non-immigrant visa and H1B(waiver) is dual intent. If your spouse applies for your GC(i.e. files your 485) before you have not completed your waiver requirements there are 2 things that can happen:
1. Either you will get your 485 rejected,
or
2. Your J1 visa will be denied. Always remember residency visas(J1 or H1) are given on a yearly basis and yours will get denied the next year even if you get it for the 1st year.
Infact my wife started her residency on J1 visa and my 140 was approved. She will be starting her waiver next year. I have a PD of feb 2007. I will be filing her 485 as accompnying spouse(you can use your PD even if you have received your GC:conformed this with my attorney) once her waiver is approved and if my PD becomes current. However she will still not get her final green card until she has completed her waiver requirements.
We had decided not to let USCIS define our carreer objectives and going with the flow. Looking from the likes of it she will be done with her waiver in another 3 years and still the PD won't be current.
Now look at the bright side of J1 visa:
1. Once her waiver is approved I file for her 485(she gets her EAD) using my original PD(no need to get into family based immigrtation hassles)
2. Since we have not exhaused our H1B( she gets 6 years of the same)
3. Her 1st H1B is quota exempt.
4.You save tonns of money since J1 are exempt from social security and medicare taxes etc. :)
You will eventually have to make your own judement call depending on your family circumstances.......so far as I mentioned we just decided to go with the flow and things seem to have worked out for us well. She got the recidency in the same place as my job was and then I got laid off 3 months back and now she got her new job in the same place where my new job is.........

So if this rumour is true, then no EAD's & AC21 after I-140 and before 485 :(

To all:
I got my H1B stamping done for 8th year in Nov 2006. When I went to the officer, just before giving my application I told that I am a returning worker. He asked for the paystubs and I gave the original ones. He approved immediately.
I took all the documents as listed in the website as well as the vfs site.
Hope this info helps.

I got my FP done on 11/21.I did open a SR on 10/05, based on which I got my FP notice on 11/06.
My details:
485 filed at NSC on July 6th
Receipting done by CSC on 09/05, EAD and AP sent by CSC
485 pending at NSC
Looks like they have started the FPs for transferred cases like ours...

I did not have a exit date on the passport. At the border they just took my Old I-94 and let me go. But when i came in I got the admit stampted. I hope its not a issue right?
US do not stamp your passport when you leave. That is why they take your I-94 and make an entry of the date that you leave.

This is the trick. If you feel that it will take a while before USCIS will adjudicate your case, you can take any job or not work at all but always be ready to show that you have a job offer as per LC once USCIS ask for it.
I have friend who was interviewed and was asked for a valid offer of employment as per LC. She's able to show it. But the thing is, her PD is far from being current.

I wrote a letter with I-485 copy and said we were no where near current, and got the 1 yr EAD replaced with a 2-year one :)

As far as I know, starting a PERM application in itself does not amount to an intent to immigrate - it is simply a labor market test for a future position.Remember, the employer can port the LC to a different employee at a later date. I-140, however is an application to immigrate permanently to the US; hence a violation of the F1 visa. You may have a difficult time getting your I-485 approved or have to go in for consular processing. It is best you consult a lawyer on this one; don't count on random opinions on the forum for such a serious issue.
