Sorry, I bit the bait and got off track. Let us focus on the issue again. Let us agree on a time line and act accordingly.
I would say, this week we work on drafting the letter (I took a shot at it, available @ page 2). Having 2 or 3 differently worded letter would probably be nice, but not necessarily.
Next week we start mailing the letters. We have about 500 responses in the poll for EB3, so if we can get most of them to send the mail (email/fax whatever), it should be a start.
We probably should start drafting a mail for our representatives/senators too, so that they too can follow up with USCIS.
We will face a lot of opposition, ridicule and nasty posts, but we should persevere if we want to get our GCs any time soon.

Super news for every body. Assuming 0 approvals in September :p
only 4000 EB1 pending; even if all of them are approved, and with 1000 more in 2010, we have 30,000 EB1 rolling over to EB2. ROW EB2 quota ~ 25,000. pending eb2 row = 7150. even if we have 15,000 more approved in 2010, eb2 row consumes 22,000 and the remaining supply = 33,000 which can go to china, india, mexico and philippines.
mexico and philippines, eb2 is minimal .. maybe 700. so all of 32,000 needs to go to India and china. I dont know how the split will be here. if it is equal and china gets 16,000 they move to mid 2007 easily and India moves to Apr 2006.
However, we know the calculations wont be this precise and cut-off will move to 2007 in Aug 2010 which is when all the lucky bums will get approvals left and right.

I am EB2-I with a couple of US grad degrees (and same undergrad school as Rolling Flood, not that it matters to anyone except perhaps those who suppor the lawsuit). And I think this lawsuit is a bad idea because it is divisive and petty.
There is an old Malayalam story that most people who went to school in Kerala would have read in their primary school classes. Two guys, Greedy and Jealous, pray to God. God appears and Greedy goes, "I just want double of what you give the other guy. All I want to be is to be ahead of him." Hearing this, Jealous says, "God, please make me blind in one eye."
This lawsuit, like the story above, is a case of knifing others in the back, for no real gain. We should instead try to leverage IV's large membership for a common good, which is what has made IV successful so far.

but why do you think this is an example of the system being gamed?
The IT consulting firm or whatever is willing to hire an experienced employee with more than X years experience for a job requiring more than 5 years experience. As long as this employer does everything by the book, and the prospective employee does everything by the book, what is wrong with this? Note that the prospective employee has still waited for about 5-6 years to get his GC, its not as if they are getting it within a year of applying.
[Note that if the IT firm is taking any money from the prospective employee whatsoever for the labor application, then that is against the labor regulations (at least I think this was part of the new regulations that got rid of labor sub)]

Sorry to hear that. Hope that will not effect your I-485 application processing.
For me, I have not seen any status change to my 140. After a series of LUDs to both 485 and 140 at last today I see my 485 status has changed. It says RFE sent. Good that I have not received any NOID or Denial. This is the best case scenario that I was hoping for. I have yet to receive the RFE to see the actual cause. But hoping this is due to 140 withdrawal. I thank the IO who is working on my case as he/she is quite knowledgeable and issued a RFE not NOID or denial.
So people please keep sending letters.
Well this is what I understand - difference between RFE and NOID
If it is an RFE - you can withdraw your 485 petition and apply for a new 485 petition (if you are current) and that is not possible in NOID. So if you are retrogressed - it is almost the same.
Also remember that technically both are same - some IOs update status message to "Request sent ..." some do not. When I got to know something happened to my 140 and 485 I called customer service and they explained that "We have sent letter requesting information, so please do not panic" when I received the letter it was NOID.
Good luck, atleast you got a good IO.
Lets keep sending letters until we stop seeing denials and start seeing posts like this

If her lawyer is quick to respond then you can keep everything ready including medicals and anytime date is retrogressed should apply immediately or the second option is apply for EAD and AP and I-485 case and go tense free and use EAD if you want to change jobs and don't worry about EB2 and EB3.

If clerk is doing this as per instruction means, we are being noticed and that is precisely what we wanted anyways. I don�t think USCIS higher ups have any malicious intent. Whole issue may be due to lack of training of IOs.

It really is amazing how much hot air has been generated on this thread over a well established transit visa requirement.
The reason transit visas are required in the UK is that many passengers with an intention to transit the UK have stayed. The transit visa was introduced as a way of making sure (as much as possible) that the passenger has the intention and the ability to transit the UK and to enter a third country.
The list of nationals that are required to have a visa to transit the UK represents a list of countries where there has been a particular problem with over stayers. It is not race based, but merely an effort to target the problem.
It really does not matter what anyone thinks about the transit visa requirement because it is UK law. Everyone has a choice whether or not to transit the UK. Going back to the original post, to book a ticket without researching visa requirements and then trying to deflect personal responsibility by blaming the visa requirement is ridiculous.
I would say only this. Get yourself admitted into a hospital and get some oxygen pumped into your freaking brain (sorry, if it sounds harsh, but it is the only way to help you to think clearly). Read the post again, please, I beg you. I wrote the post only because the UK embassy overcharged and did not think it is at all necessary to return the excess amount. Regarding your comment about doing the research, let me tell you, there are �idiots� like me who would rather do something else and leave things to logic and former experience. Ordinary people like me have other things to do in life, like managing their day job, negotiating the daily commute, picking their kids from school, taking them to their extracurricular activities, managing their homework, and other things which only end at 10:00pm. Between all this cacophony, how do you think I should managed a situation when my travel agent call me and gives me 5 minutes to decide if I need to take a flight going through such and such city with all legs confirmed, and that too during the month of Nov-Dec?

Ordinary people like me have other things to do in life, like managing their day job, negotiating the daily commute, picking their kids from school, taking them to their extracurricular activities, managing their homework, and other things which only end at 10:00pm. Between all this cacophony, how do you think I should managed a situation when my travel agent call me and gives me 5 minutes to decide if I need to take a flight going through such and such city with all legs confirmed, and that too during the month of Nov-Dec?

Guys... I am all to do anything for GC, that itself is big thing..

Then you really know , what it is about...
Upto GC, it is fine to do any movement/lead..perfectly acceptable.
But do not waste energy and aggressivness on citizenship related things. It rather damages the effort, just by adding citizenship related things.
It is as equal as what happened in the past, that adding illegal and legal based reform in teh single capsule blowed out everything and no benefit came out finally.

(Pls note you shd have started your GC process on or before 2000. Then you know the things.
If you came in 1998 and started GC just 1 or 2 years back..You may not be knowing the reality.)

I am not questioning or discouraging your intentions/enthu/aggressiveness...
I am asking not to waste the energy on useless things.
Pls concentrate on GC related things which will benefit everybody.
People laugh for the resolutions you suggested , if they can be proposed to any legislative member.

Can somebody frame a letter that we can use to report L1 fraud. And, folks its big companies like accenture and hewitt too exploting loopholes in L1. in my current place, most of experienced workers will be replaced by folks on L1. I dont want to come across as negative. My only point is if there are any violations, lets report it and have everybody follow the rules and regulations...
