Yes, the same law can be interpreted like this:
EB1-ROW unused visa will go to EB2-ROW
EB2-ROW unused visa will go to EB3-ROW
Same for each country.
But its not happening. What actually is happening that they are giving unused visa from EB1-ROW to EB2-ROW to EB2-I/C. WHY?
So EB3-ROW is retrogressed bcoz it doesn't get any spillover and hence it affect EB3-I.

If waiting time for GC is reduced less than 5 years then this may not be needed except for persons those who are filed GC before 2004. The environment is so tough that they trashed non controversial recapture bill on 2008. So it has to be decided based on how the CIR will shape up this year.

I don't want to be a spoilsport.
But there is a possibility that EB2I has not yet retrogressed (inspite of heavy porting) because USCIS knows EB1C 12000 will flow to EB2 right. In that case we may not see movement of dates in par with 12000 spillover.
Maybe I am pessimistic.
In all calculations, it is mentioned that porting at max could be 6k/year. How did we come up with this number? Any proof or just a guess?

Can you please further explain how the visa flow will work if instead of horizontal flow it is made vertical flow... or you have some other interpretation?
Quite simply put EB3-ROW << EB2-I,C. So there is a faster chance of EB3-ROW going forward and being current before EB2-I becomes current. Therefore, with all other categories satisfied, it boils down to EB2-I/C and EB3-I/C. Thenceforth, as USCIS has indicated, the longest waiting PDs will be given the roll-over numbers, which is EB3-I.
So what will be the flow? I guess the following
EB1-> EB3-ROW (until current)
EB2-ROW -> EB2-I/C
Once Eb3-ROW becomes current
EB2-ROW -> EB2-I/C
EB3-ROW -> EB3-I/C

Doesn't the above constitute discrimination and illegal ? What recourse do we have when we are disqualified because of EAD ?

I don't know what do you mean by success. as far as media coverage is concerned, Fireign media (India, China or elsewhere) doesn't help. It's local media, which can create some usefull awareness. Sometime back.. I also read some comment talking about involving Indian govt. in this.... Bullshit.. What does a different country's govt has to do with it!!!
Point is.. don't get too excited for having done nothing... Do something substantial and keep doing.
Governments can and often do influence each other. Think of trade deals - they do want to sell us Boeings dont they?

No disrespect to Al-Jazeera. But putting our story on that channel is not a good idea. People view anything on it with lot of suspicion, and Fox news interprets everybody Al-Jazeera sympathizes with as you know what.
Don't come after me for saying this, its not my opinion. But general opinion that I have observed from people who are not well informed(read majority of people). Lets focus on the main stream media in US, outside coverage is not that significant anyway.

This is awesome even before getting the flowers we have achieved what was intended.
I request members to refrain from making personal comments.
Everyone has got their opinion but if that is against our idea and thoughts we should tackle it fairly.
Anyways KUDOS to Everyone participated in this cause.
The message was reched to whoever it needs to ( Media) and USCIS make it easy by posting the same in www.uscis.gov website. This is a big victory for IV and the next step is to have a big rally to carry the message forward. Please vote to join rally in DC for the week end

i do not understand how overstaying and transit visas are related.
the TV allows you to "walk from one gate to another" in the international transit area...that's all. you cannot walk OUT anyway without crossing immigration- and if you want to do that- you always need a visa. this new visa, confers (for 90 bucks per person) the right to walk to your plane- sometime the right to walk off and back on to your plane...what a joke!
even the US now requires this so the UK only did a copycat deal, but the issue here (besides money grubbing behavior) is the way people are treated. sorry lost in space...but you do not seem to understand. if you do not step on UK soil you cannot overstay. the purported reason for this "walking visa" is security. and we all know that "security" can these days be a euphemism for treating people pretty badly. personally if i had the choice when transiting i would not go through london...ever. if nothing else the taxes are astronomical and they make the tickets more expensive most times and walking from one gate to another involves serious hassles with new security checks and long lines. and i do hope that enough people vote with their feet so the UK govt pays attention. london is too wonderful a city to lose out like this....

It took 10 business days for my brother to get his passport after stamping (Chennai consulate), so plan for min 2 weeks wait.
