    Thanks trueguy!. It took me a while to realize that some people here are trying to misguide and misrepresent. Wish I had not spent so much of my time replying to those inane posts.

    There is no basis for Oct PD to be at or near Jun 2007 PD levels, it is only to lull us into inaction. And I would be more than happy to be wrong about this :o


    And it looks like some one was asked by their teacher to write imposition... and therefore we are seeing repeat dribble of the same post.

    Absolutely, I have seen misleading comments especially from EB2 guys. EB3 have to do something otherwise there is no future for us here. Now EB2 line will never end bcoz all new applications will come as EB2. Hoping for spillover after EB2-I becomes current is just a dream now that never comes true.

    In essence what the memo seems to state is that I can have another employer file an I-140 petition, and if approved, simply substitute the I-140 in my existing I-485.

    Is that right?

    Not to my understanding.

    I believe you can do interafiling if you have two approved i140 from the same employer and you have a pending 485 and the later 140's PD is current.

    Hmmm.. Level playing field. You mean the field where you set the rules? UAW did that in GM - you know?

    If there is someone who can do my job cheaper or better or more efficiently - by all means it should go to him. I need to then find something where I am good at. Thats what competition is! Of course - this "efficiency" can not come by illegal behavior. Illegal behavior (like the L1 fraud) has other hidden problems.

    So on your question about "l1 fraud": by all means I am for reporting it. However, there is another overriding concern for ALL OF US - how will the economy behave? I dont want to worsen things by "reporting fraud" at a mass scale right now and create trouble for companies that are already suffering. I will do that when that will be beneficial for the US Economy (translation - "all of us - even citizens").

    I am not for tolerating or condoning illegal behavior - however, I am all for moderating my responses and prioritizing the fights. I am also for not behaving like the UAW members.

    Finally, we got the approval emails for self & wife.

    I had got an email from TSC.Ncscfollowup@dhs.gov last friday (09/17/2010) with the update below-

    1: The review was complete
    2: Visa numbers were requested 2 months ago and all security/prints are current
    3: Files have been forwarded to officers for completion.

    In my case the email to SCOPSSCATA@dhs.gov helped a lot. They in turn sent an email to TSC.Ncscfollowup@dhs.gov to step up the processing.

    As others have mentioned IV has played a big part throughout this journey. Thank you again.

    It is already there in change.gov. I have created long back in January and there were 470 votesup for that idea. I think now that will be in the President's desk. Only thing now we have to do is accelerate this so that it again reaches the Congress.

    Not a good answer( but I reallly appreciate your frankness and I know you do speak for most of us here) and I have been doing exactly like this before 3 months. We must keep writing again and again and again. And make as many as we know also do it. It was when someone in this forum told me that I realized this and now I do it every week on change.gov. I write every week.
    Obama will not come to you or me and tell us "Nice letter Sri, I read it and am acting on it". He gets 1000s of these everyday and in this economy and everyone wants to write to him., well except us who seems to have some comfort zone. we dont realize till its too late, and when it is, we create a new thread called " I got a pink slip yesterday". No offense,but we must act when we can, and before its late. Pink slip is more painful when you are on H1 than on GC. Right??.
    Most of our folks (EB3) as it looks like want to wait.. scared to raise.. but dont realize they can contibute and help the economy.

    If 5882 is resurrected and debated, we should definitely do something - anything that time. But if not, and this (lets make calls! lets write! lets send flowers!) is another of lets do it because 10 people think its a great idea, not a coordinated campaign coming from IV core, count me out.

    I've always made the calls, contributed money, etc, but I'm getting a bit tired of this "charge of the light brigade" mentality. If there is zero chance of something happening, but everyone is told to make calls, contribute and after all the rah, rah, sis, boob, ba everything fizzles out, and it happens 4 times a year, the mood sours.

    Doesn't mean I recommend switching off the whole process and giving up. But the best way to beat apathy and cynicism to make sure we pick our fights. Fight only the winnable ones, and keep the powder dry at other times.
    Just my opinion.

    OK, unless you never initiated the EAD conversation, technically they are supposed to ask ONLY if you are legally authorized to work in the US or you need sponsership.

    OTOH I really dont like the idea of having to be quiet and hide my status. Its not something that I should be ashamed of. I have paid my dues dammit and lived here all these years. The immigraton folks should clarify this once and for all, so whoever is waiting for their GCs can think clear and hard if this shit worth it.
    After spending half my life working for this, they turn around and say its not valid for employment ? not fair.

    I was gungho with my EAD, very pleased that I could work for whoever. Seriously, I think sometimes that its better to go back. Its not like this great country is making it easy for people to contribute their skills.

    The law unambiguously states that for employment based categories - EB1 spillover should first go to EB2 and whatever is not required by both EB1 and EB2 will spillover to EB3. If the USCIS has been doing something different previously they were actually not following the letter of the law.

    Here are the relevant sections of the INA which unambiguosly states the above.


    Here is what Section 203 of the Immigration and Nationality Act states -

    EB1 -

    (1) Priority workers. - Visas shall first be made available in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (4) and (5),...............

    EB2 -

    (2) Aliens who are members of the professions holding advanced degrees or aliens of exceptional ability. -


    (A) In general. - Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraph (1) ...............


    EB3 -

    (3) Skilled workers, professionals, and other workers.-


    (A) In general. - Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (1) and (2), .........

    Its just sad that when it comes to processing immigration applications, we are too many. But when it comes to contributions or calling senators and sending emails, WE ARE TOO FEW :confused:



    Yes it is serious.....and given how many people are raring to go.....it islikely...

    As I have said before......we r just too many!!!!


    Not trying to generalize everybody, but people from india(I am from india) dont mind paying any amount of fees to USCIS without complaining, but will not contribute a small fraction of that voluntarily.

    By the way I am a contributing member myself.

    1) (copy 1)please send a separate letter to the President.
    2) (copy 2)Send a copy of that letter to IV. After the letters are sent to the President, IV will have a meeting with senior administration officials. In that meeting we will carry the copies of the letters and deliver to them.


    Thanks Pappu. Will definitely send in those letters. Dunno about the handwritten part (The white house may not be able to quite decipher them) but will send in those letters.

    If a bad person who is going to fail a name check is already in the country, then name checks are not going to deter him from doing his thing. Just because a name check is pending without a GC means nothing to a potential bad guy.
    If a foreigner tries to become a governor or tries to join a govt agency he goes through a lot more special screening than just name checks. It should be up to the FBI to fail or pass a name check and all benefits should be revoked if the FBI fails a name check. This is going to be rare and there is no need to fight the battle for somebody who fails a name check (which is where your argument is so extremely stupid). It happens in other spheres too, sometimes people lose their jobs after many years if the company finds that you falsified information like degree etc.

    I am not going to stretch this discussion beyond this as it seems to me spiraling out of limits of reason. Of all the things you said to support your argument, the first part of your latest mail will kill any support you might get from any normal person. From your arguments I think may be you should change your name to "stupiddesi". YOu would even clear your namecheck easily; or may be not - too many of them ;-)

    We are running a small funding drive as a gesture of support IV for answering each other's questions in times of need.

    If your question is answered by a fellow member, do make a point to contribute some amount. It will help continue this effort.

    We understand everyone is busy with I485 filing and have put everything on hold. But we have not put our efforts on hold in the interest of this communty and this cause. Core is working on this issue despite being busy on their own I485 filing.

    We are also working with our lobbyists on CIR and as soon as there is an action item we will post it on the forum for all to participate.

    At this time, do take out a couple of minutes off your busy schedule with I485 filing and contribute towards Immigrationvoice.

    on as side note, only 3 co-sponsors were added in this month, meaning our efforts ARE paying off but need more momentum.

    My attorney's office contacted USCIS and was told that USCIS has current address on system :cool: They told that since the case is waiting for RFE it must have happend by mistake :confused:

    I am surprised by the disqualification since the Department of Homeland Security (DHS) had issued the EAD. DHS has set clear guidelines not to discriminate based on any of the authorized work documents issued by them, EAD being one of them. The I-9 form required to be filled in by every employee (citizen or otherwise) clearly mentions this.

    Are you sure CapitalOne does not allow candidates who are on EAD specially when it does not require sponsorship from the employer ?

    Response that I received for the above email:

    Thanks for your message. The information regarding Capital One's policy on pursuing EAD card holders is correct. We are only able to pursue US Citizens or Green Card holders for these roles. I'm sorry, but we won't be able to consider your candidacy at this time.

    HRs generally "quote" the policy word in every sentence they speak or write. It is a matter of interpretation. The HR may not have a decision making power and is just following what he/she is asked to do. No company has a policy that says GC or citizen, but policy can says "Authorized to work for any em ployer in the United States. I guess it is a matter of interpretation.

    The HR seems to be ill informed. Many companies do accept EAD and they are quite aware of the delays in EAD renewal - and that has rarely been the basis to reject a petition.

    If this is a trend then it is an issue to all, but if this is an isolated case then definitely you can look into places other than Capital One.

    If you want to spend time and resources you can go to a lawyer, but you have no guarantee that you will get the job there too.
