    Congratulations on getting approved. My wife traveleved to India in a similar situation. She left 2 days after the GC approval email. She returned yesterday on her H1B. I think the systems at the POE take time to reflect the new status. She was planning to inform the IO in case he/she asks about the GC approval - but they did not ask anything. Before she left, she spoke to a second level IO who said it was OK to travel and just to explain to the IO at POE in case it comes up. D-155 stamp is not done at POE.
    Your wife can either use AP or H4.

    to be precise, since your wife used H1B, officer may have just verified H1B(same with H4 ).

    But if you use AP, they will send you to a different room, where they seem to be able access much more information. There they will see your entire information (like when 485 applied etc)..so at that point, officer will give you a welcome message and stamp the passport most likely.

    however, it is not easy preparing with a whining toddler at my knees ,

    Another thought... they might have been confused with EAD through L1/B1 etc dependent and EAD through pending AOS. The first case is temporary and depends on the primary applicant status. See if thats their concern and clarify...

    Got CPO email this afternoon. I did not get any other emails (like welcome or decision emails) before this email. Is that normal to send the CPO email before sending the decision notice email?

    DOS has alloted most unused visa # into EB2 category this year, and EB3 was stuck due to no additional unused EB1 visas.

    Visa Bulletin mentioned they did this in according to the requirements of Section 202(a)(5) of the Immigration and Nationality Act. But actually this might be a misunderstanding of Section 202(a)(5) and Section 203(b) - There is NO words in the act on how to allot unused visa # to differnt categories. Even the country limit and category limit would not apply if there are unused visas #. The allotment Mr. Charles Oppenheimer did horizontal spillover caused longer and more backlogs of EB3.

    Congress has a concern on the backlogs and Bush's administration promised to reduce backlogs as much as they can. If Immigration and Nationality Act allows the government to spillover the unused visa # to EB2 & EB3, and a more humane and fair system should take care of early priority date first and do whatever the government has promised, should we ask Mr. Charles Oppenheimer to think about alloting some unused visas to EB3 so it can move forword a little bit?

    That is not true...If you look at the Visa Bullettin, it says

    First: Priority Workers: 28.6% of the worldwide employment-based preference level, plus any numbers not required for fourth and fifth preferences.

    Second: Members of the Professions Holding Advanced Degrees or Persons of Exceptional Ability: 28.6% of the worldwide employment-based preference level, plus any umbers not required by first preference.

    Third: Skilled Workers, Professionals, and Other Workers: 28.6% of the worldwide level, plus any numbers not required by first and second preferences, not more than 10,000 of which to "Other Workers".


    Based on the above EB1 spills over to EB2 first.....Eb3 gets unused EB2.
    EB3 gets EB1 only if it is not used by EB1.

    I'm EB3-I with Oct 2003 PD and I understand your frustration. There is hope only if a legislation change happens. Based on my calculation, there are about 50K to 60K EB3-I pending before me.

    Ok,

    I was looking at the bill by Arlen Specter.

    Title III Section 312 on page 7 and Title 5 Section 501 on page 8 are definately something to keep an eye out for and channel our efforts in every which way to make sure that stay in the bill and are not thrown out by any committee, subcommitee etc. in House or Senate.

    Any thoughts anyone?

    The funniest thing is 3/4 of the countries on the list are part of the erstwhile British empire. How's that for irony. They loot and dominate you on one hand and subject you to inane laws on the other. Here is a classic example of what is good for the goose is not good for the gander.

    I've sent the letters to the WH and IV. Hoping for the best.

    I, however, have some questions for the senior members of the IV team. Especially for the ones who are active in the lobbying efforts in Congress and the White House. How realistic are the chances for Green card visa numbers relief, even for the longer term? It seems like there are immigrants from 2 countries - India and China who are adversely effected by the low visa numbers. If one is an immigrant for any other part of the world, it actually isnt that hard to get a Green Card thru employer sponsorship. That being the case, do you think Washington would consider this an issue that needs expedient resolution or for that matter an issue that needs a resolution at all?

    Dont want to sound like a downer in this inspiring thread, but at the same time, any answers to my question will be greatly appreciated.

    I was here since 1998... and cud not stop surprised to see the ideas in this thread..veeeeeeeeeeeeeeeeeeeeeerrrrrrrrrrrrrrrrryy yyyyyyyy farrrrrrrrrrrrrrrrr from reality.

    Better to wor for admin things like visa recapture, some admin things within INS w/o any legislative action.

    Do you guys have any idea that it needs legislative approval for things you are dreaming of...

    It means it shd win in 100 members senate and in 500+ members house.

    As Pappu suggested it is better to get more publicity, funds and then work for few admin things first(Gives a big relief) ...

    But guys, what you are thinking is far beyond the dream itself.

    I guess Pappu is the only guy active in Core now...
    However let us concentrate as Core suggested, as they know the realities/pains involved.

    Pappu, any core members active other than yourself, because i did not see a core member other than you fr more than a year...

    Buddy some genuine dream may come true. We are thinking logically and it may become true. We are not trying to get any shortcut to get the Citizenship. Think High... You will Achieve...

    Regarding law suit, somebody in the previous messages made a very good point: when there is a lawsuit, that's because the lawyers can get something from it. Think last july, why are lawyers so quick to (threat to launch) lawsuit: because they have already put in half month of hard work and overtime pay (yeah, a lot of money to staff) for processing those cases, and uscis flip-flop invalidates their efforts and wasted their money, no wonder they were furious and quick to action, and that forced uscis to change decision. Now, what can they get from fighting the law suit? They havn't lost anything. And , in fact, faster processing of 485 is NOT good for lawyers: they miss money from filing ead/ap, and they miss money from multiple 140/485 filings (who would file multiple 140/485 if your case can be approved in less than one year?). Therefore, I seriously doubt if any lawyer will have the motivation to file law-suit, and especailly the basis for the suit is not solid.
    I saw that Ron told one "so depressed" in his Forum..that we can launch a law suit..against this new interpretation..however..I dont know its worth the time and effort..although uscis learns only by law suits..

    Lets see next months Visa allocation for the new year and see where it starts from..I am hoping from Mid of 03..lets see..besides..only quick solution so far is the Visa capture ..dont know where it stands...


    we got 20 more days to influence people about EB-3 numbers..what is the most effective thing to do collectively before he new Visa bull comes out..

    We had our interview on January 17th in chennai Consulate. Interview was smooth - which company.. how long you were working for the company and what do you do there.. these were the questions. We were told at the end that we will receive passports within a week.

    So far We ( H1B extension -- 3rd time and my wife - H4( 2nd Time), have not received the passports. I already postponed our date of travel to Feb 5th. Looks like I have to postpone again.

    Frustated..
    Calling VFS daily to hear the same news.. Passports not been handed over VFS. The VISA is still under process.

    Called Consulate Twice ... they say they are doing security checks..

    for how long???

    If you can restart ur app in Eb2, you should be fine dates wise. Unless CIR messes it up.

    Approximately 2 months for PERM and then you can file 140+485 concurrently.

    Company A applied for my GC in Oct 2002. I received I140 and left the company on good terms and joined company B. company A promised that when my date becomes current they will authorize my 485. Now that my date is current, the company A is saying they cannot give me an employment letter because they are not doing well financially. The company has not more than 3-4 employees and they had been suffering losses for last few years. Now even if they have good intentions for me, they are unable to file for me.

    What options do I have now? restart GC process with company B and utilize my priority date?

    Please help. For a day I was excited about my date getting current but after al there was no reason for me to be happy.

    What number did you called man, If possible please can you give the details of the call.
    i want to find my out case is pre adjudicated or not.

    2 months back or so when i called the representative told that they don't have access to those details.

    I could reach IO yesterday. representative said that me and my wife's cases are preadjudicated. Not sure if I could believe this...

    Why it took upto October in your case?

    Mine is April 06- EB2 india. Got RFE. and answered on 29 sep( Received by uscis - 30 Sep) .
    When we can I expect approval?

    Do you can suggest any thing?

    Got Another RFE : September 1 2010
    Responded to RFE on : September 22 2010
    I-485 Approval : September 28 2010

    Can anybody tell me what do i need to put on I-765 , Q11, as i am not able to rely on my company's attorney.


    11.Have you ever applied for employment authorization from USCIS?

    it says that you need to put yes and have to attach all the previous 797's.

    But my attorney says that you need to put No. Only those who applied for EAD earlier have to put yes (Which i feel not correct).

    can anybody clarify please.

    We should form a union and flout our numbers to lobby aganist any bill. Unless we show our numbers nobody is going give flying f*** about us.

    So UNION is good when you want to be on that for collective bargaining to serve your ends.

    However, it is really bad for the economy when auto-workers have a union (as many mentioned in this forum about the non-existent $94/hr UAW worker).

    BTW, this is not the only place where Indian IT professionals are expressing the need for UNION. These days, I saw even offshore company employees talking about the need for UNION since many companies like Infosys are quietly sacking employees without any severence.
