USCIS website says NSC are working with August 2007 received AOS applications. However, I haven't heard any sort of communication pertaining to my pending application with USCIS. USCIS Customer Service would not pull up my application information in the system yet. Seems like USCIS is either not following the First in First out (FIFO) process for sure or the figures are misleading.

Several people on the forum seem to be getting fingerprint notices, EAD, AP etc. in mail.
I am one of the few July 2nd filer who has not seen any activity on my case yet..no checks cashed, no 485 receipt, no EAD etc. etc.
I am just trying to guage as to how many of us July 2nd filers are in this boat.... my 140 was approved from TSC, 485 was mailed to NSC..

I heard that we have to provide all the address where we stayed in USA for filing I485. But very first time I came to USA almost 6-7 years back for short term and I do not remeber the actual address. Basically i do not remeber very first two address when I came here for short term. Is it a matter of concern.

All these statistics are based on wage rate specified on LCA. But in many cases LCA wage is treated as a minimum wage by companies. I don't think many companies get a new LCA when the salary rises, I don't think they are supposed to. It also does not include bonuses as companies often don't know what the bonus is going to be when they apply for an LCA.
Even based on the LCA salaries 10% H1Bs in 2006 were for 100K or more. (Unlike what the programmer's guild wrongly says (1%) )

My priority date is current now and my company has already filed for my I-140. I have have two questions:
1) My wife converted from H4 to H1b last year end and she has not gone out of the country to get any H1b stamp. Will this complicate things? Does she need to go out to get a valid H1b stamp? In case of any trouble, will it be easy for us it she converts back to H4 again?
2) I saw that I485 processing times are taking about 6 months at the CA service center. Hence, under the current conditions, what is a better choice go: for Consular processing or Adjustment of Status? Thanks. :confused:

Look at sections 312, 313 and 311 (H1b cap). Looks like cap will be removed for science, tech, math etc...and maybe for families as well, + cap is going up. So overall very very good news...or am I seeing things?

Seems like there might be an internal memo or understanding between USCIS and DOS not to approve many Eb2 India 485 even though there dates are current, this is the only explanation I can come up for the lack for eb2 india approvals in October. Even with the limited number of visas every quarter I was hoping there would be lot of approvals because of Visa spillover occuring every quarter instead of once every year, but looking at the USCIS performance in the first week of october it seems like there wont be any quarterly spillover at all.
Correct me if I am wrong but to my knowledge quaterly spill overs if any would be in the last month of the quater which should be in Dec 2009

I think you should be able to file the 485 yourself. The form is simple. If you can get a lawyer to do it and get all the appropriate 140 approval docs- the better, but I don't foresee any issues "doing-it-yourself".
Advace Parole is a travel document that lets you return back into the US without a H1B stamp on your passport. The AP has to be renewed every year along with the EAD (employment authorization doc) card.
Hope this answers your question. -- Now lets go back to sending faxes and calling senators.

The Gandhi Protest
Several readers commented on a posting earlier this week about 200 skilled immigrants from India who tried a Gandhi-like tactic and sent flowers to the government's immigration director for help in moving their green card applications along. The U.S. Citizenship and Immigration Services forwarded the flowers to soldiers recovering at Walter Reed Army Medical Hospital, saying it understood the intent of gesture.
Here's a sample:
"I wonder if USCIS really understood why the flowers were sent. It was a symbolic protest by legal immigrants AGAINST the way USCIS treated them. How could they send it in the 'same spirit' to soldiers whom we all empathize with?"

"What an inspirational act. Too bad the message did seem to have gotten lost in translation. Just imagine what would have happened in WWII if the US would have turned away the immigrating sciencists and engineers. How come some 50 years later, the US is struggling to see the value of inviting the world's best and brightest to immigrate here."

"I'm sorry that these people were tricked into coming to America with the promise of a welcome and eventually a Green Card. The fact is that H1-B immigrants were brought here in order to replace US workers."

"Viceroy Lord Wavell and his assistants laughed when M.K. Gandhi told them that one day they will be forced to leave India. What they did not understood that they were not politicians, they were bureaucrats. When the political power behind peaceful civil disobedience was unleashed, a nation took shape, and what Gandhi told Wavell became a reality.
"Something similar repeated in United States recently when thousands of legal immigrants were given a cold shoulder, despite of their merit based claim for an American Green Card. NY Times, Washington Post, Reuters, Yahoo News are a few to name. "An American way of fighting injustice 'A law suit' is on its way, the usual rallies and demonstrations are about to begin. However, in America, its first time after Martin Luther King Jr., that someone has tried to apply Gandhi's way to fight injustice. It is yet not clear that what would be the outcome of this campaign, but there are rumours that USCIS is already discussing internally to reverse the discriminatory decision which caused this embarrassing flower campaign against them.
"It's amazing to witness that 60 years after Gandhi's demise, his ideology is still relevant. We are sure its gonna remain relevant till there are Lord Wavell's in this world. Lord Wavell's can momentarily laugh thinking that unorganized immigrants are helpless, but when the peaceful protest will demonstrate its political power, they surely will realize what Gandhi and Gandhian ways are all about."

As a highly skilled H1B worker in the US, let me the set the record straight on a few common misconceptions:
- Many of us come from upper middle class families and didnt come to the US 'seeking quality of life'. We already had it.
- Many of us have graduated with distinction or higher from TOP US universities where we competed with 'local' talent and aced the programs, with NO SPECIAL FAVORS
- All of us are PASSIONATE about the PROMISE of the GREAT AMERICAN DREAM. We work hard because we want to, not because we need to. (Hint: We are ambitious and can hence go to any country in the world!)
- All of us are an INTEGRAL part of this society, paying 28%-33% of our $100K+ jobs as TAXES that go back to the US economy
- All of us continue the great tradition of the US being a melting pot
Go back to the age of the Gold Rush. We are the new Gold Rush. We are the new Lewis and Clarke. We are adventurers, learners, experiments, believers, doers.
We are not lowly paid 'tech slaves'. Get the media misconception out of your heads.
We are PROUD to be part of the Great American Fabric. We strengthen this country with our diversity. We will continue to contribute selflessly to make this a greater, stronger nation.
And while we are it, we wont forget that our own future generations might take it more lightly and risk messing up their careers. Anyone that has 'life handed to them in a platter' ends up messing it.
So, please take your heads out of the sand, quit being protectionist and complaining the someone moved your cheese. Look at how you can move and be flexible, nimble and adaptive.

Does it work well with Home security systems Like BRINKS? How good is the call quality if you have DSL at home. I have DSL with 1.5 MBPS download. Thus the voice garbles when you are actively downloading on Internet.
It will not work in case of power failure unless you have UPS back up for your modem. You will need standard landline to work with Brinks. I would advise to get cellular backup and make that number is first number to call in case of a break in. Burglars generally cut phone line when they become aware of security system. There have been some complaints where security companies just called the landline and since you didn't answer they left a voicemail. Logically they are suppose to all cops.

I think you need to send an email via vonage account to refer someone and the system automatically gives your account a credit when the other person signs up. Dont know if you can give a phone # and say that MR ABC should get the benefit of 'refer a friend'
