    This guy doesn't have a clue. He is deviating so much from the core US policy, I don't know where it might end. I wonder whether we are better off with the last one????

    If Obama signs this bill into a law, this will be the end of Capitalism and some extent Indo-US relations. India may drag US at WTO followed by backlash here. so this will make things for immigrants really tough in this country. So go figure out....Obama & socialism loving maniacs. Durban & Grassley did not have permission to visit Bush's whitehouse. But ofcourse Obama loves these clowns.

    There is nothing wrong in reporting fraud.
    However your argument that you are reporting it since you cannot tolerate fraud isn't that convincing.

    If you were always against injustice/lawlessness, you will see a lot of it in your daily life. Do you report or take action against each of those ? I don't think so.

    After living in India for long and seeing people put up with all injustice and sometimes doing it themselves, it is hard to believe your argument that you are doing it just for the sake of law.

    I does not matter whether we are exposing L! fraud by these outsourcing companies for the love of law or pure selfishness. As long as there is a greater good out of one's intentions it does not matter what my intentions are.

    I am an architect now and i know for sure that this profile is no longer immune to outsourcing. I am ok with that. I am reconciled with that fact and I am moving on to another field. However, my point is, if you want to outsource take the job to the low wage country. Do not bring low wages here. I am ok if outsourcing would increase because of the Grassley bill. I am not ok if the low wages are dumped in here. I hope you people see the difference.

    My self interest in preventing this dumping of bodies is to ensure that this doesnt happen in the new field I am entering into. Remember, most aspects of manufacturing are outsourced to China. However, I do not see the chinese companies dumping in low wage manufacturing workers here.

    Dude are you kidding me ... I am reporting a violation/fraud and I should hold my head down?? what kind of moral/ethical values you have.. I am keeping my head up (may be an inch or 2 higher than last 3 weeks) as my project manager and director (middle management ) fully supports me in this crusade. Most of the cases, upper management decides to replace all the local contractors with these outsourcing firms and once the contract is signed these companies dump all their L1 resources to projects and middle management who deals directly with the resources has minimal say in the process.

    Let me ask you a simple question.. WHY ARE YOU SUPPORTING THIS FRAUDULANT ACTIVITY??? .... think for a minute and then decide whether to reply me back or not.. bye.
    'Mileage for this complaint'.. in an economy when millions with eligibility are job less .. case regarding this fraud will have ZERO mileage! want to bet me on this .. come on dude.. come on. If you are on L1 visa talk to uer management and get it changed to something legally eligible to work on your project, instead trying to measure the mileage of L1 fraud, ICE/USCIS will measure that and we'll see whos head is going down here...

    I am neither supporting you, nor am I supporting TCS/WIPRO. But I am seeing things from your client's perspective. Your client and director who ever they are , they might be saying one thing on the face and getting ready to save their company in the background. You know corporate world is a nasty place. Every recruiter who talks to you makes you feel as if he is the hiring manager and you have got the job, but does it happen that way? No. Similarly, your client is buying time and soothing you, I am not sure they are sincere about their comments. Everyone has some motive or personal interest in supporting things.

    And to be honest, I doubt if you can come clean , hold your head high and say in public, I did it. If you do so , I will respect you as a whistleblower. Other wise, you are just mad that your are losing the job to others. If they cant get l1 on site, they will send the job offshore. There is not much you can do. Your client is towing your line until a smooth transition and then they are done with you , anyways. Its better you read writing on the wall and move on. You can invest the same time in finding other work and still have good relations with the current client. You never know when economy gets good, they may want you back at a higher price. But if they get to know you are doing this, most likely you will end up on some blacklist and I am not trying to scare you but world is a small place and you will run into same people many times.

    My moral ethical values here are, someone doesnt want to work with me for some reason, whether they are doing their business with others ethically or unethically or illegally is upto them. I am moving on without a bad taste in mouth or complaint. It is company's choice whether they want to pay me or someone else. If they want to send my job offshore, they dont want to work with me for whatever reason, so I got to move on without complaint, thats my ethical value. whether others are doing it ethically or unethically is not my problem. You can choose to fight this, but your victory will only be temporary, say 6 months.

    My appointment was on the 12-Dec. Visa was approved immediatly - was told I'll get it in 7 days - but haven't received the passport yet 56 days to date. I receive the same response when I call.. that its under PIMS verification. No ETA of when I can expect it to be done..

    I had a H1 transfer to a new employer and 3 year extension happen at the same time

    I am sure you must have given this information earlier but can you please tell me where did you apply? And was it your first stamping or a renewal case?

    Also are u stuck coz of PIMS or 221 g clause?

    I dont think you need police clearance for US immigration. do you? I think that's canadian immigration where you need police clearance.
    You only need a police clearance record for consular processing.

    I must say y'all are doing a commendable job. I have contributed $$ and would do so more in the future if needed.

    I remember Senate Majority Leader Bill Frist saying that the comprehensive immigration reform bill will be handled in February 2006. Is the schedule still the same. I am keeping my fingers crossed and hope that everyone of us stuck in this immigration hell-hole will get a relief from the comprehensive immigration reform bills that (hopefully) will be passed in 02/06.

    what r u...
    Mind your langauage-Did u face any serious problems from some H4-

    before you try to supress some ones feelings change your attitude-

    My intentions was not to offend anyone...all I am trying to say is blaming the H4 visa is unfair...H4's intention is to have the dependents be able to join the H1 visa holder....just that, nothing more....it is another story that most people want to do more than just that while on a H4. And for that several other visa options are all open..

    Yes, my spouse too was here on a H4 and we had faced some problems...but to be honest, I had educated myself very well on what problems we will face before getting onto a H4..we thus never cribbed about her being on a H4....and I had always insisted to my spouse that if she wanted to do more..she would have to fight for her own F1/H1 visa..

    Also, does anyone remember where the I-485 was mailed? NSC or TSC? From what I remember it was based on what state you lived in when I-485 was filed.

    It was NSC for New York residents... Can someone confirm that please.

    Yes, it was based on the State you lived. One other thing, you may want to check with Customer Service, since when are you have been actually considered a PR. If they have considered you as a PR since 2008, it is good for you, you will be able to apply for Citizenship sooner

    If the rumor turns out to be true in two days, I strongly believe it's a conspiracy.

    When the CIR was revived, there was a strong feeling that the senate will pass based on the negotiations. Since CIR is horrible for those who are currently in line(including us), somebody/some group panicked and triggered the bulletin.

    Now that CIR is officially dead and buried, status-quo is OK, so thought that somebody/some group.

    Oh well....
    I only pity the H4s out there.

    Since this campaign is endorsed by IV, I think you must mention in your letter that you are a member of Immigration voice so that it is easy for IV to follow up..

    Yes, we must all understand that AC21 is not a law.

    The correct way of stating it is AC21 Act of 2000, signed by Pres. Clinton is law of the land. But, that law doesn't come into effect until and unless the concerned Government department (in this case USCIS) publishes the regulations in the Federal Register. This hasn't happened so far with AC21 law, though we are approaching a decade of it's passage.

    An unfortunate example I can give to illustrate the point is the U & T visas created by US Congress some years back to help victims of sexual-trafficking and domestic violence to remain in the country and adjust status to LPRs. Unfortunately for these hapless victims, they couldn't get the benefit of these visas as USCIS did not make the regulations for years. ( I'm not sure of the status now).

    There is a saying that 'what the legislature gave in the law, the department took away in regulations'. Department can deny the benefits in two ways. Delaying/not framing the regulations or framing them in such a way as to take away the benefits of the law.
