create a yahoo group or blog..and have ppl publish the name anonymously of the desi bloodsuckers...some kind of activism is required..instead of coming on this board like some ballless buggers and crying like babies...grow up and take back ur life...bytch..;-)
btw..i am not in IT so..i dont have to deal with suck suckers.. i have read so many posts abt this.. i am fed up..

I am very happy for India.
1.Now most of the work that is being done here by H-1B professionals will be done in India.
2.Innovations will be made in India. As more money is available for the companies to pump in to R&D
3.Indian IT infrastructure will improve.
I am not so happy for USA.
1. They are doing a big mistake on immigration. They do not have enough resources with right skill set.
I am not so happy for myself.
1. I am disappointed by the fact that USA is going in the wrong direction.

Tina, my wife has the exact same issue. Pl advise. She is workng on H1 but getting delayed pay and paystubs and no W2 for 2006 since she dd not have SSN until feb 2007. To be safe, she wants to apply for H4 in Chennai although she still has valid H1. have 2 questions.'
1. can we fix a web appointment thru VFS for H4 visa stamping for her, even though she is on H1 right now and does not have H4 I797? I will add he as my dependent, since I am doing my H1 renewal as well and my case is strong

My question involves employment and labor law for the state of: CA
I have worked with a company on h1b from 1st jul to 12 nov in 2007 on h1b visa. They did not pay me for last 45 working days. My employer is telling about the following clause in in my offer letter:
SALARY: You will be paid an amount equal to a 70% basis of your bill rate based on the understanding that you will work with us for a period of at least one year. If you leave Company before completing 1 year of employment your compensation will be adjusted to a $55,000 per year basis and the excess amount paid to you will be deducted from the last two months of your salary.
Please let me know whether this is legal to have this kinda clause in offer letter. Is there any way to get my salary?

Assuming @gc28262 doesnt know this because of his personal experiences and exposure, do you guys think *all* consulting companies charge their employees money for the Visas? I know personally only those who doesnt charge. One of the consultants I know strives to differentiate himself from these. He provides benefits like in a large company.
One thing guys, if you know abuse and are silent because of any reason (could be you want your spouses/brother's H1Bs to go through or any reason), you are all guilty. So, dont try to be naive..
I dont want to tell anything about L1B because I dont know if there is anything illegal in anything companies are doing. First this is no slave labor. It is a free will employment. Just because somebody is ready to do some work for less, legally, you should not be worried too much. Instead of worrying about billing, try to upgrade yourselves to become better in skills, capabilities etc...your market value will automatically be upheld if not become more. Being an L1B myself, I dont see any single day I felt like I was abused or I am cheated by my company.

May be the person who leaked this news and the person who posted in post 3205 is the same. He purposefully leaked same dates at 6.35 PM and later leaked this.
But also it looks like the firm may have got hold of a draft bulletin from somebody in the USCIS.

If the USCIS cashes the checks and then returns the packets (total $1490 in my case), is there any legal recourse to get a refund from them? Since they are pretty much doing whatever they want, this thought just occurred to me.

As many of you are well aware, it has been about 50 days since IV was started. Since then, we have come a long way in setting up a platform to voice our concerns. We also established an able alliance with QGA to have a powerful channel for our voices to be heard on the hill.
It is now game time!!
Two very significant legislative vehicles, namely the PACE bill and Comprehensive immigration bill are right on the corner. PACE is scheduled for discussion end of Feb, and the comprehensive Immigration bill beginning of March. In this dynamic legislative climate, it if very difficult to predict which of these potential vehicles could bear fruit, or even predict the timeframes accurately. IV�s strategy is to pursue both the bills and push for our goals to be on them.
We are in immediate need of funds for that very purpose. We are seriously low on gas right now, for the journey ahead that we are only just starting on. We have only raised $30,000 in the last 50 days; even more alarming, fund raising has gone down drastically in the last 2 weeks. At our current burn rate, we will be out of money in a month or so, just when we expect the bills to come up for discussion on the Senate floors. As you can expect and appreciate, there is a cost for achieving anything politically. IV has already demonstrated a great deal of leadership and persistence to work on retrogression relief and labor backlog elimination. Many IV members will start making trips to DC in the coming weeks to meet lawmakers at the hill. We need your help NOW!
Members that have not yet contribute money, please do so TODAY! And members that have already contributed please consider another contribution. We need all hands on deck. Also pass on the message of the immediate need of funds to your friends.

I am applying for AP (new). Are they issued with 1 year validity or 2 years ( now that EAD is being given for 2 years)?
I have not heard 2 year AP yet from USCIS. As far as EAD is concerned, we will start getting 2 year EAD from Jun 30.
There was some proposal of single EAD/AP card, but heard no progress on that.

Like the other guy you said, I have an equity of 200,000 in one house and 50,000 in other house. I still don't have green card. I have around 300,000 in
401k and 150,000 in brokerage accounts. My net worth is around 800k, most of my money is in this country. If I want to continue my lifestyle, I need my GC, that will secure my right to live in this country. That doesn't contradict anything I said. I was referring to the 38 occupations where you do not need Canadian work experience. I agree that the list is much more restrictive than before. The other way around it is to have a job offer. All I said was that Canadian work/student experience is not mandatory.
I get it....they will keep tweaking it...if too many start applying with the HRDC approved job offer then they will crack down on that.
It happened to H1B to EB2/3 GC thing as well. In early days people even with MS could get Eb1 till there was court case after which
the requirements were tightened.
Now with PERM even EB2 is becoming harder.
The problem is that more people want green card than what the govt wants to give. So they try to come up with filtering criteria
in a varierty of ways...tightening the rules, country quota (in case of US). visa post processing quota in case of Canada etc.

I have listened to a couple of speaches by Bernake in NPR. Basically that guy is completely in the blank on how to handle the economy. He simply says, we are in this mess, because the lenders were very lenient.
Had you left your first paragraph off, may be people would have paid more attention. To say that the fed boss is clueless shows that you have simplified the problem way too much.
Have you seen the BearStearns tumble and do you understand the cause and effect it may have had if Fed/JPMC had not come to its rescue? There is a very valid speculation that it may still have a ripple effect on all mortgage brokerage firms. For now, the Fed with its tourniquet with help from JPMC seem to have tried to stop the bleeding.
And regarding your solution, the market is in a deep trouble with the 30 year loan rates around 7%. There is a very high chance that it may go up because of the risks involved in buying mortgage bonds. This is amidst news that the housing market is yet to bottom out and it may continue to fall at least for another year.
Good try, even if I had a GC, I would be a little careful to jump into this market. Ofcourse, if I had a 30% down for a 250K home, may be I might get a good deal, but not many can afford a 30% down...
