Here is what I found from Murthy Forum --
According to the AILA-NSC Liaison minutes of 04/12/2007, the following standards generally applies in determining EB-2 requirement:
(1) U.S. master�s degree � as long as it is in the field required no additional documents would be required
(2) 4 yr bachelor�s degree + 2 yr master�s degree (India) � with degrees in the same or related fields this will generally be considered the equivalent to a U.S. master�s degree with no additional documents required
(3) 3 yr bachelor�s degree + 3 yr master�s degree (India) � with degrees in the same or related fields this will generally be equivalent to a U.S. master�s degree with no additional documents required
(4) 3 yr bachelor�s degree + 1 yr postgraduate diploma + 2 yr master�s degree (India) with degrees in the same or similar field : generally be considered the equivalent of a bachelor�s degree plus one additional year of education so the beneficiary would also need to have 5 yrs progressive experience. These are just guidelines from a law firm. Most of the law firms were making money in porting cases for last two years, as number of new applicants were less due to economy. That does not mean that USCIS is going to approve these cases based on number of years of education. Porting within a company is a risky deal. Even though lawers dont make it sound like a big deal, for getting new clients. The old eb3 job that was used to file the first labor needs to be filled. If you are working with a desi bodyshop, be careful. You are inviting an audit.

USCIS Knows the numbers now or they would not predict April 2006 if they did not know. I believe that If you read the predictions of QSK then you will know exactly what might happen. It will go up to Sep 2006 and might stay there or move back to April.

"There has been going around a rumor lately that the USCIS was internally discussing retreat from the 485 rejection decision. It appears that this rumor probably started from the USCIS HQ order over the Texas Service Center to hold all the July 2007 EB-485 applications abeyanbce and not to return the applications to applicants. Unconfirmed sources indicate that because of the order, the Texas Service Center is not returning the EB-485 applications which have been received since July 2, 2007. However, there is no evidence that the decision is necessarily related to its potential decision to withdraw the rejection decision. At this point, its reasons are completion unknown. Please stay tuned. "

I am under the impression that atleast in Illinois, the local law enforcement (police) CANNOT ask for the legal status or check any documents if it is a routine traffic stop or just pull you over and then ask for the documents. I know for a fact as this had become a big issue at one of the Chicago's northern suburbs recently and was in news for quite some time. There were two sections of citizens who wanted police to check and others (ACLU) argued that legal status was a federal jurisdiction and the local law enforcement were not authorized to check and violated the rights.
I think only ICE or CBP can ask that and how many of them are around in cities/ towns far away from the border?
I assume the same is true with other Police Depts.

Having a special quota for masters or any other criteria would be absolutely beneficial as long as it does not come from the existing quote (like adding 20000 for Masters on top of 65000). Having any additional numbers would significantly reduce the stress on the exciting queue. I do not think there should be any reason why anyone would object. If we can get any reason to add additional numbers, that should be welcome. Several other reasons can be there including the founders visa which was talked recently as long as they are additional numbers.

I am in 9th year extension with priority date 09/2002.
My I-140 denied on 06/18/08n and immediately I485 also denied.:mad:
I have Visa vailid till Jan09.
1.If I change employer and able to get labor cleared before jan09 , can I apply for I140 PP and get H1B exension.
2.Is the Priority date transferrable if I change the employer?

Different jobs have different requiremends Hi_Nu, for example, a website for a local golf course has different requirements than a huge corporate e-commerce site. Voets is right, the clients don't usually care how old you are. My clients are always really cool about it and astonished that I am so young and know so much.

I had the same problem with my desi employer about a couple of years ago. Tell him that you are going to call the IRS if he does not correct the W2. then go ahead and call the IRS. they will send him a letter, most often than not it should take care of things, otherwise the IRS will investigate the employer.

Although I agree with you on principle...that cannot bring people in numbers. There will always be people who don't agree with each other. leadership involves channeling both parties energies, those who agree with me and those who don't agree. Sounding arrogant, feeling proud of what I did better than others and looking down upon people who don't agree with me, doesn't help me, right? Who am I to judge somebody's attitude and achievements?

If people believe a cause is worthwhile and will benefit them, they will come - and registering will not be an issue for them.
If people don't want to do the heavy lifting, they will give any excuse - including registering as the detractor to join the cause. The change has to come from within and cannot be forced. You can talk to a person who has a question on what needs to be done during the advocacy days, you can talk to a person who has doubts - if he/she can be reasoned with, but you are wasting time with people who have no intention of participating to begin with!

I�m bachelor. I�m planning to get married in another 6 months. Should I apply for I-485? If I should, can I add my spouse later to the I-485 application before I-485 is approved and priority date is not current. :confused:
Here is one of my friend in the similar situation planning to do. He is filing 485 without any medical exam. Certainly, he is going to get query and after query you have 40 days (double check this number) to reply. So, he'll get some time to go and do wife hunting.
